TRANSFERS/VACANCIES. 12.01 When a vacancy occurs within a classification covered by this Agreement, all employees will be advised by way of a notice of vacancy which will outline the qualifications set out in the classification,shifts, status (full-time or part-time), the commencement date of the job, Such notice of vacancy will be posted on the appropriate bulletin board(s) for a specified period of at least seven (7) calendar days duration and will be copied to the Union District Chairperson. 12.01.01 In filling vacancies, the requests of employees under the provisions of Article 10.05, 10.06 and 12.02 will be handled in order of seniority, dependent on requirements of the position. 12.02 Employees wishing to fill a posted vacancy will apply, in writing, in accordance with the instructions contained in the Notice of Vacancy. The Company will provide a copy of the application to the Union District Chairperson. 12.02.01 All employees will also have the ability to request a transfer to another classification via the Letter of Preference form. All letters of preference will be maintained in the employees file for a period of twelve (12) months and must be renewed annually. In the event the employee fails to signify their acceptance it will be deemed to be a refusal and the employee shall be restricted from submitting a new request for a period of twelve (12) months from the date of their original confirmation. 12.03 In filling vacancies, the job will be awarded to the senior qualified applicant. 12.04 The employee will be given no less than three (3) clear calendar days’ notice of a transfer (not less than seven (7) clear calendar days if the transfer results in a change of days off) unless mutually agreed between the Company and the employee. 12.05 An employee who is transferred to fill a temporary vacancy arising from the absence of an employee due to illness/injury or a Leave of Absence for Employees with Child Care Responsibilities will be returned to their previous position upon the return of the absent employee, unless they have been the successful applicant for another vacancy. 12.06 All notices to an employee under this Article will be in writing, copied to the Union District Chairperson. 12.07 Lead vacancies will be filled by the senior qualified applicants who have successfully completed and passed the written test and interview. Qualification criteria will be developed jointly by the company and the union.

TRANSFERS/VACANCIES. 12.01 When Section 1. An employee may be transferred from a classification in one department to the same or equivalent classification in another department provided the transfer is to the advantage of the County and/or results in better utilization of the education, experience, or interests of the employee. No transfer may be made without the knowledge of the receiving Department Director involved, knowledge of the employee involved, and prior approval by the County Administrator. Employees subject to involuntary transfer will receive no less than five (5) working days’ notice. Section 2. Employee compensation in connection with Department transfers shall be made as follows: A. An employee involuntarily transferred to another department with the same job classification will not change the employee's pay grade, rate, performance review date, or classification date. B. Employees transferred at their own request shall serve a three (3) month probationary period in the new department. The probationary period may be extended an additional three (3) months at the request of management. C. If during the probationary period, the employee is found to be unsuited for or unqualified in the new position/department, the employee may return to the position he/she left, if a vacancy occurs within a classification covered by this Agreementexists. If the former position is filled, all employees an effort will be advised by way of made to place the employee in a notice of comparable position. If a vacancy which will outline the qualifications set out in the classification,shifts, status (full-time or part-time)does not exist, the commencement date employee shall be laid off and will have recall rights as provided in Article 39. D. Transfers shall not change the employee's performance review date. Section 3. When an employee becomes physically or mentally disabled and unable to perform the essential functions of his current position, the jobCounty Administrator may authorize a placement to a position which the employee has the ability to fill. Section 4. The County Administrator may grant an employee's request to be placed into an equal paid position, Such notice the employee so placed will keep his/her current rate of vacancy pay. An employee placed into a lower grade position will have a pay reduction of five percent (5%). Section 5. All bargaining unit vacancies shall be posted on the appropriate bulletin board(s) for a specified period of at least seven (7) calendar days duration and days. Positions may be advertised for outside candidates concurrently with the internal job posting. An employee must apply electronically for the open position using the County’s system for such application. Section 6. Applications not filed by the closing date published for the vacancy will not be considered. It is the County’s practice to attempt to fill vacancies by promotion of current employees whenever practicable (see Article 18).
