VACANCIES & TRANSFERS. A. For purposes of this Agreement, a “vacancy” shall be defined as a Board-authorized position which is unfilled and to which no bargaining unit member has a right to return to (i.e., from leave of absence or recall), or when the authorized hours for a position increase five (5) or more hours per week.
B. When the Board determines to fill a vacancy or create a new position, notice of such vacancy or newly-created position shall be publicized by giving written notice to the Association President, and the Superintendent or designee will provide an appropriate positing in every school building.
1. No vacancy shall be filled on a permanent basis until ten (10) work days after such notice has been given.
2. When school is not in session, all vacancies shall be posted in the Central Administration Office as described above for at least ten (10) work days before being filled.
3. If a vacancy is to be filled through recall of an employee on layoff in the same category, Section B of this Article does not apply.
4. The ten (10) work day period in Section 1 above, will be reduced to five (5) work days for Special Education paraprofessional postings during the period of August 1 to November 1.
5. The ten (10) day period will begin from the date a posting is placed on the District’s website. The paper copy of the job posting will indicate the date the posting was placed on the District’s website and the date the posting is closed. Copies of the posting(s) will be provided to the Association President and the secretaries in each building at the time of the posting.
C. Any employee may apply for a vacancy or new position by submitting a letter of application to the Central Administration office. In the recruitment, selection, and appointment to vacant positions within the District, the Board shall recruit, select, and appoint from within the ranks of its employees whenever practicable. In the selection and appointment process, the finalists among the internal and external candidates shall be chosen as follows: The position will be awarded to the most qualified individual taking into account his/her knowledge, skills, ability, and experience. If the candidates are equally qualified and one is internal, the internal candidate shall be offered the position. If more than one of the equally-qualified candidates is internal, the employee with the most seniority shall be offered the position. VACANCIES & TRANSFERS. 693 A. The College retains the right and responsibility for determining the number and type of faculty 694 positions required at each campus or division, and for the selection of individuals to fill these 695 positions. The College recognizes the importance of conferring with faculty in the transfer of 696 full-time faculty members. 697 B. Faculty members will be assigned to a campus location: Titusville, Cocoa, Melbourne, Palm Bay, 698 or any established center/institute. When a new faculty position or vacancy appears at any such 699 location and the College President intends to fill it, the faculty position will be filled by the 700 Administration in accordance with the following guidelines:
701 1. Email notification of the position shall be sent to all full-time faculty members, it will be 702 advertised in a College publication with College-wide distribution. All position openings 703 at the College will be advertised by intra-college publication or by special bulletin, and 704 by email to all faculty. Currently employed full-time faculty members shall be given a 705 minimum of five (5) business days’ notice of, and opportunity to apply (internal 706 advertisement) for, a faculty position opening prior to advertising outside the College 707 (external advertisement).
708 2. To request a transfer to a new or vacant full-time faculty position within the faculty 709 member’s discipline or from one discipline to another, a qualified full-time tenured 710 faculty member shall submit a request for transfer to both the faculty member’s 711 immediate Supervising Administrator and the Associate Vice President of Human 712 Resources by the job close date as printed on the job posting. In the event of a request 713 for transfer between disciplines, the Supervising Administrator, or designee, will verify 714 qualifications before proceeding.
715 3. After the close date for the internal advertisement, Human Resources will forward the 716 request to the appropriate Supervising Administrator for review and approval.
717 a. The transfer request shall be considered by a screening committee of faculty 718 members from the same or a related discipline. The screening committee shall 719 consist of at least three (3) tenured faculty members and all members shall be 720 from the campus where the opening exists.

VACANCIES & TRANSFERS. Vacancies
A. A Notice of Vacancy shall be advertised inside and outside the District for ten (10) working days. The Notice of Vacancy shall be posted in two (2) conspicuous District locations.
B. Employees who wish to be considered for any posted vacancy will complete the full application process; letters of reference will be considered optional for internal applicants. Rural instructional assistants who wish to be considered for instructional assistant vacancies in urban classrooms will be provided interviews for such vacancies based on submission of a letter of interest.
C. All qualified internal applicants will be included on the list of applicants to be interviewed.
D. When candidates are deemed to be equally qualified, the internal applicant will be given preference.
E. Classified employees hired to positions in a higher classification range will be placed on the new salary schedule with applicable credit for experience. However, if the employee’s pay rate at the previous range/step placement exceeds the step placement on the new salary range, the employee will remain at the higher pay rate until the pay rate at the new step placement converges.
F. In the event the district determines no applicants meet the qualifications for the position, the vacancy will be re-advertised.
G. The Notice of Vacancy shall include, but not be limited to, performance responsibilities from the current job description, starting salary, and job location, if known at the time of posting.
VACANCIES & TRANSFERS. 14.1 All regular bargaining unit positions which are vacant and for whom employees are being recruited shall be posted in an agreed-upon location and such information shall be made available to the Union within forty-eight hours of the posting. Such positions shall be posted for one (1) week by the Employer.
14.2 During the posting period, internal applicants shall be given preference and if no qualified internal candidates apply following the posting period external applicants may be considered. Among qualified, internal applicants, the employee with the highest seniority shall be selected.
14.3 In the event the Employer needs to temporarily transfer an employee from one department to another department, the Employer will first seek volunteers. If no volunteers can be found, the least senior employee shall be transferred, provided that a temporary transfer shall not exceed three (3) months. No employee shall suffer a loss of pay or status as a result of a temporary transfer. Further, the Employer shall provide an adequate orientation to the new position. Bargaining Unit members temporarily working in a non-Employer service area shall remain covered by this agreement.
VACANCIES & TRANSFERS. A. When school is in session, the Central Office, through its principals, agree to post in each building a notice of all positions which must be filled (including administrative and supplemental positions) exclusive of leaves of absence. When school is not in session, for openings prior to August 1, a notice of all positions (including administrative and supplemental) will be posted on the district website and a general email will be sent to all users. Openings that occur from August 1 to the first student day do not need to be posted.
B. Persons wishing to transfer should send a request to the superintendent within five (5) days after the announcement of the vacancy and will have an interview with the Superintendent or his/her designee before the vacancy is filled. Bargaining unit members who apply for more than one transfer during any school year shall be granted only one interview per year (July 1 through June 30). The applicant may arrange a conference with the receiving principal if he so desires.
C. An employee may withdraw a request for transfer anytime prior to the actual notice of transfer.
D. The administration will advise candidates of the outcome as soon as possible following selection of a candidate for a given position. If so requested, a post-conference may be arranged by the applicant to discuss with the Superintendent reasons for the applicant’s rejection.
E. A transfer initiated by the administration will be made only after a meeting between the affected employee, their Union Representative, and the Superintendent or Superintendent’s designee.
VACANCIES & TRANSFERS. A vacant or new full-time tenured faculty position will be filled by the Administration in accordance with the following guidelines:
A. To request a transfer to a new or vacant full-time faculty position within the faculty member's discipline or from one discipline to another, a qualified full-time tenured faculty member shall submit a request for transfer on the Request for Transfer form, (Appendix H), to both the faculty member's immediate Administrative Supervisor and the Executive Director of Human Resources by the job close date as printed on the job posting on the College's website, or five (5) business days, whichever is greater. In the event of a transfer between disciplines, the Vice President for Academic Affairs or designee will verify qualifications before proceeding.
B. After the job close date for the advertised position, Human Resources will complete the Request for Transfer form and forward the form to the appropriate Campus President for review and approval. The Campus President of the campus to which the faculty member seeks a transfer will retain the sole right to select or reject any request. After reaching a decision on the transfer request, the Campus President will complete the Request for Transfer form and forward the decision to the Executive Director of Human Resources and the Vice President for Academic Affairs. The Campus President making the transfer request decision will notify the requesting faculty member of the decision in writing.
C. If the Administration determines that it is necessary to transfer a member to a new campus or center, the Administration will first request qualified volunteers. A faculty member will be considered qualified if rated "satisfactory" on the most recent evaluation.
D. The Administration shall not involuntarily transfer a faculty member for arbitrary, capricious, or punitive reasons, including a faculty member's refusal to accept managerial responsibilities.
E. For a new or vacant full-time faculty position that is different from the faculty member's current discipline, a tenured faculty member requesting a transfer must meet the minimum qualifications for teaching in the new discipline by the application deadline date for applying as printed on the job posting on the College's website announcement.

VACANCIES & TRANSFERS.
11.01 When the Board determines that a vacancy exists in a classification, notice of such vacancy shall be made known to all personnel through an electronic format. The notice shall include the particular job classification and department, the hours of work (where known), and the rate of pay. Employees interested in the position shall inform the business office in writing within ten (10) days of receipt of notice. Current employees will be considered prior to employing new applicants. In the event the administration knows in writing that an employee will be absent for more than thirty-five (35) calendar days, the position shall be posted and filled as a temporary position per this Article. There shall be only this one (1) move, and when the absence ends the employee who filled the vacancy shall immediately return to his/her position.
11.02 Employees may express interest in the vacancy or position in the same classification in which they are presently employed. An applicant for a vacancy who is a current member of the bargaining unit in the wage classification of the vacancy shall be given first consideration. However, no employee will be considered for more than one (1) transfer in the same classification in the same year (July 1 through June 30) unless the vacancy is a promotion. For purposes of this article, a promotion shall mean a position with a higher hourly wage, more hours per day or a day shift position. When more than one (1) employee is being considered, date of hire shall be the tie-breaker. If the transfer is denied, the employee, upon request, shall receive the reason(s) for denying the transfer.

VACANCIES & TRANSFERS. PROMOTIONS AND DEMOTIONS 17.01 - Whenever the Employer determines that a permanent vacancy exists within the bargaining unit, a notice of such vacancy shall be posted for a period of seven (7) working days, internally, to allow for promotion, transfer or voluntary demotion application requests. Internal posting dates will be identified as “Internal Applicants Only.”
A. The posting deadlines;
B. The classification title of the vacant position;
C. The minimum rate of the vacant position;
D. The Division, work unit and geographic location of the job (transfers only);
E. The experience, training and/or educational requirements as specified in the Position Description for the vacant position;
F. Job duties description. Interested full-time and regular part-time permanent employees may apply and be considered for the posted vacant position by filing an application with the Human Resources Office during the specified posting period. Once a vacant position has been posted, the vacant position shall be filled pursuant to this Article as soon as is practicable under the circumstances.
VACANCIES & TRANSFERS. A. All routes or shuttles that become open will be posted for three (3) days by the supervisor of transportation. All bus drivers shall have the right to bid on the opening, the most senior qualified bus driver who submitted a bid will be given the open route or shuttle. A bus driver may have one successful bid on a route, one successful bid on a kindergarten route, and one successful bid on a shuttle per contract year. After all bus drivers have had an opportunity to bid on the open route or shuttle, it will be given to the most senior qualified substitute driver who wants it. The Employer reserves the right, after consultation with the Executive Board of the Association, to transfer, assign, or reassign drivers to better support the program and/or the affected drivers. Bargaining unit members on unpaid leave of absence pursuant to Article XIII, Section M. will not have the right to bid on a vacancy unless, by the mutual agreement of the driver, the Association, and the Employer, there is an early termination to such leave.
B. Bus routes shall be established by the Board or its designee. Routes shall be an AM/PM combination whenever possible.
C. Before the last day of each school year, a bus driver wishing to return the following year will notify his/her supervisor in writing. Failure to notify the supervisor as required will be deemed a resignation by the employee and will be recorded as a resignation without notice in the employee's personnel file.
D. In the event that an assigned route is eliminated, the driver will be assigned to the position held by the driver with the least seniority.
E. If a driver leaves a regular route voluntarily and chooses not to go to the substitute list the driver’s employment is terminated and if rehired would receive no seniority for previous service. If a driver leaves a regular route voluntarily and chooses to go to the substitute list their seniority for purposes of bidding back to a regular route will be the date they voluntarily left the regular route.
