Tuberculosis (TB) Testing. In the event that the services required under this Agreement will be performed within a CDCR institution/parole office/community-based program, Contractors and their employees who are assigned to work with, near, or around inmates/parolees shall be required to be examined and tested or medically evaluated by a licensed healthcare provider for TB in an infectious or contagious stage prior to the performance of contracted duties, and at least once a year thereafter (within 12 months of their initial or previous TB test under this contract), or more often as directed by CDCR. Contractors and their employees who have any contact (physical or nonphysical) with inmates/parolees, shall be required to furnish to the CDCR Program/Institution Contract Manager, at no cost to CDCR, a documented Tuberculosis (TB) evaluation/test for TB infection (Tuberculin Skin Test (TST) or a blood test Interferon Gamma Release Assay (IGRA) completed within (30) thirty days of the start date of the services and be certified to be free of TB in an infectious or contagious stage by a licensed healthcare provider prior to assuming their contracted duties and annually thereafter.

The Contractor is required to provide updated evaluation certificate(s) for each applicable employee annually thereafter for the duration of the Contract. U. PRIMARY LAWS, RULES, AND REGULATIONS REGARDING CONDUCT AND ASSOCIATION WITH STATE PRISON INMATES Individuals who are not CDCR/CCHCS employees, but who are working in and around inmates who are incarcerated within California’s institutions/facilities or camps, are to be apprised of the laws, rules and regulations governing conduct in associating with prison inmates. The following is a summation of pertinent information when non-departmental employees come in contact with prison inmates. By signing this Contract, the Contractor agrees that if the provisions of the Contract require the Contractor to enter an institution/facility or camp, the Contractor and any employee(s) and/or subcontractor(s) shall be made aware of and shall abide by the following laws, rules and regulations governing conduct in associating with prison inmates: 1. Tuberculosis (TB) Testing. In the event that the services required under this Agreement will be performed within a CDCR institution/parole office/community-based program, prior to the performance of contracted duties, Contractors and their employees who are assigned to work with inmates/parolees on a regular basis shall be required to be examined or tested or medically evaluated for TB in an infectious or contagious stage, and at least once a year thereafter or more often as directed by CDCR. Regular basis is defined as having contact with inmates/parolees in confined quarters more than once a week. Contractors and their employees shall be required to furnish to CDCR, at no cost to CDCR, a form CDCR 7336, “Employee Tuberculin Skin Test (TST) and Evaluation,” prior to assuming their contracted duties and annually thereafter, showing that the Contractor and their employees have been examined and found free of TB in an infectious stage. The form CDCR 7336 will be provided by CDCR upon Contractor’s request.

Tuberculosis (TB) Testing. As required by California State law, all unit members must have a Tuberculosis (TB) risk assessment and/or examination every four (4) Calendar Years. This test can be waived if a qualified health care provider certifies that the unit member is at risk for excessive x-ray radiation, will test positive to the Tuberculin Purified Protein Derivative (PPD) skin test, and is clinically negative for tuberculosis. The unit member shall not be responsible for the cost of the Tuberculosis (TB) risk assessment and/or examination after initial employment. All subsequent risk assessments and/or examinations will be at District expense, or otherwise reimbursed by the District. Unit members can receive the Tuberculosis (TB) risk assessment and/or examination without charge at either College’s Student Health Center. Unit members who do not have current Tuberculosis (TB) risk assessment and/or examination results on file with the District will be placed on an Unpaid Leave of Absence until the Tuberculosis (TB) risk assessment and/or examination results have been received and acknowledged by the District Office of Human Resources. Unit members will be given written notice on or about forty-five (45) days before they are required to submit their Tuberculosis (TB) risk assessment and/or examination. The notices will inform the unit member that if they do not have a current Tuberculosis (TB) risk assessment and/or examination result on file with the District they will be placed on an Unpaid Leave of Absence until the Tuberculosis (TB) risk assessment and/or examination results have been received and acknowledged by the District Office of Human Resources. In the event that a unit member’s primary care physician recommends the unit member to receive the QuantiFERON TB blood test, the District will reimburse the unit member for any cost incurred that is not covered by the unit member’s health insurance.

The unit member shall be responsible for the cost of the TB test upon hiring. All subsequent tests will be paid for by the District. Faculty can receive the TB test without charge at either College‘s Student Health Center. Unit members, who do not have current Tuberculosis (TB) test results on file with the District, will be placed on an unpaid Leave of Absence until the Tuberculosis (TB) test results have been received and acknowledged by the District Payroll Office. Unit members will be given written notice on or about 90 days, 60 days, and 30 days before they are required to submit their TB test. The notices will inform the unit member that if they do not have a current TB test result on file with the District, they will be placed on an unpaid Leave of Absence until the TB test results have been received and acknowledged by the District Payroll Office.
Tuberculosis (TB) Testing. In the event that the services required under this Agreement may be performed within an institution/facility, office or community-based program, Contractor and its providers who are assigned to work with, near, or around CDCR/CCHCS patients and/or DJJ youth shall be required to be examined and tested or medically evaluated by a licensed health care provider for TB in an infectious or contagious stage, prior to the performance of contracted duties and at least once a year thereafter (within twelve (12) months of their initial or previous TB test under this contract), or more often as directed by CDCR/CCHCS. Contractor and its providers who may have any contact (physical or non-physical) with CDCR/CCHCS patients and/or DJJ youth, shall be required to furnish to CDCR/CCHCS, at no cost to CDCR/CCHCS, a documented TB evaluation/test for TB infection (Tuberculin Skin Test or a blood test, Interferon Gamma Release Assay) using Tuberculin Skin Test and Evaluation form (CDCR 7336), that has been completed within the thirty (30) days prior to the commencement of the contracted duties associated with this Agreement. Each evaluation/test must certify that Contractor and its providers are free of TB in an infectious or contagious stage by a licensed health care provider, prior to assuming their contracted duties. The Contractor is required to provide an updated Tuberculin Skin Test and Evaluation form (CDCR 7336) for each provider annually thereafter for the duration of this Agreement.

The parties and their employees who have any contact (physical or nonphysical) with youth/inmates/parolees, shall be required to furnish the other party with a documented Tuberculosis (TB) evaluation/test for TB infection (Tuberculin Skin Test (TST) or a blood test Interferon Gamma Release Assay (IGRA) completed within (30) thirty days of the start date of the services and be certified to be free of TB in an infectious or contagious stage by a licensed healthcare provider prior to assuming their contracted duties and annually thereafter.
