UNION COMPLIANCE. The EMPLOYER/AGENCY will ensure this work experience will not impair existing contracts for services or collective bargaining agreements. When a program or activity authorized under title 1 of WIOA would be inconsistent with a collective bargaining agreement, the appropriate labor organization and employer must provide written concurrence before the program or activity begins. (29 C.F.R. Part 667.270(b))
UNION COMPLIANCE. The Union and University shall comply with the rules of the Labor Board concerning notice, objections, and related matters contained in its fair share rules.
UNION COMPLIANCE. It is agreed that the Union which complies with the requirements of this Article shall not be liable for the unauthorized action of their members or other postal employees.
UNION COMPLIANCE. The SAG Agreement shall govern the terms and conditions of Artist’s services. If there is any inconsistency between this Agreement and the SAG Agreement, the SAG Agreement shall prevail and this Agreement shall be deemed modified to the minimum extent necessary to resolve the conflict and shall continue in full force and effect. Producer shall be entitled to the maximum rights, privileges, and benefits conferred upon or permitted to Producer under the SAG Agreement for the minimum payments required, except as otherwise specifically provided in this Agreement.
UNION COMPLIANCE. CONTRACTOR shall not impair existing contracts for services or collective bargaining agreements through the provision of worksites for the Temporary Workers. When a program or activity authorized under Title 1 of WIOA would be inconsistent with a collective bargaining agreement, the appropriate labor organization should provide CSBD with written concurrence before the program or activity begins. UNION COMPLIANCE. Client agrees that it shall fully adhere to and comply with, and is a signatory of, the Union Contracts and shall remain a signatory thereto so long as this Agreement is in force. Client and Payroll Company shall abide and comply with the applicable provisions of the Union Contracts and the applicable rules and regulations of respective Unions. Payroll Company recognizes that Client may be represented by the XXX-4A’s Joint Policy Committee on Broadcast Talent Union Relations and will defer to Client’s interpretation in the event of a conflict, provided, however, that Client shall be solely responsible for compliance with the Union Contracts in connection with such interpretations. At all times and with respect to all commercials produced by Client for which Payroll Company renders services hereunder, Client shall be deemed the “Producer,” as such term is defined in the Union Contracts. Nothing herein shall constitute agreement by Payroll Company to become a signatory to the Union Contracts nor, except as specifically provided herein, to be bound by such Union Contracts.
UNION COMPLIANCE. The Supplier shall carry out all Services performed on premises owned or controlled by the Utilities connected with this Agreement in accordance with the “contracting out” provisions set forth in the Collective Agreement between the Utilities and any applicable unions, provided the Utilities has given prior notice to the Supplier of the provisions that are applicable.

The parties agree that the provisions of this Article shall not be used in any way to defeat any current or future legal action involving the constitutionality of existing or future legislation prohibiting federal employees from engaging in strike actions. The parties further agree that the obligations undertaken in this Article are in no way contingent upon the final determination of such constitutional issues.
