UNIT PRICE ADJUSTMENTS. This contract incorporates Construction Wage Rate Requirements Wage Determinations and Service Contract Labor Standards Wage Determinations from the previous service provider. In accordance with subparagraph (b) of the Fair Labor Standards and Service Contract Labor Standards—Price Adjustment Clause, FAR 52.222-43 and subparagraph (b) of the Construction Wage Rate Requirements—Price Adjustment Clause, FAR 52.222-32 offerors shall not include escalation of wage and fringe benefit rates for Service Contract Labor Standards (formerly known as the Service Contract Act (SCA) of 1965) covered employees and/or Construction Wage Rate Requirements (formerly known as the Xxxxx-Xxxxx Act) covered employees in the option periods of performance. Wage and fringe benefit rates used for the base performance period will be used in pricing labor costs for all periods of performance in the option years. In accordance with the referenced clauses, the contractor may be entitled to an adjustment in contract price only when a new Service Contract Labor Standards wage determination and Construction Wage Rate Requirements wage determination is modified into the contract and it affects wages and fringe benefits of covered employees.
UNIT PRICE ADJUSTMENTS. UNIT PRICE ADJUSTMENTS. The Unit Price is a firm, fixed price which is subject to adjustment only as follows:
UNIT PRICE ADJUSTMENTS. The price to be charged by Albemarle for Product manufactured and delivered under this Agreement shall be [redacted] per kilogram of Product actually delivered in each batch (“Unit Price”).
UNIT PRICE ADJUSTMENTS. For all Product ordered subsequent to the eighteenth (18th) month following the Effective Date of this Agreement, the Unit Price set forth in Section 4.1 shall be adjusted in accordance with Sections 4.2.2 and 4.2.3 below.
UNIT PRICE ADJUSTMENTS. The price to be charged by Albemarle for Product manufactured and delivered under this Agreement shall [redacted]* per kilogram of Product actually delivered in each batch (“Unit Price”). Pricing listed and payment of the invoiced costs is contingent upon Albemarle and Customer written agreement on security measures required for the production facility prior to start of production of Product and the reimbursement plan for said security measures. If necessary, Albemarle will perform a recrystallization upon Customer’s request. For each such recrystallization (including multiple recrystalizations for the same batch), Customer will pay Albemarle [redacted]*.
UNIT PRICE ADJUSTMENTS. The Unit Price set forth in Section 4.1 shall be adjusted in accordance with Sections 4.2.2 and 4.2.3 below.
