Use of Past Records. SECTION 37.1 The Employer agrees that for the purposes of promotion and in matters of discipline, the employees' performance records covering incidents of minor infractions shall not be used beyond the time period of three (3) years. This is no way to be interpreted that the Employer does not have the right to retain on file the complete personnel records of the employees from the initial date of hire.

Matters of discipline up to and including Written Reprimand shall be removed from the employee's file after eighteen (18) months from issuance if there are no additional disciplinary actions within the said eighteen (18) months.
Use of Past Records. In imposing any discipline on a current charge, the Employer will not take into account any prior job performance infractions which occurred more than forty eight (48) months previously, with appropriate exception, nor impose discipline on an employee for inadvertent errors or mistakes on the employment application. If the employee makes an intentionally false and material statement on his/her employment application or an application for leave of absence, he/she shall be subject to disciplinary action up to and including discharge within a period of three (3) years. However, there shall be no time limitation for disciplinary action up to and including discharge for failure to report a felony conviction.
