User’s Equipment. USER shall be responsible to obtain and maintain all his/her radio equipment to transmit on the frequency 467.675 MHz and receive on the frequency 462.675 MHz in order to utilize the REPEATER system.
User’s Equipment. User acknowledges that Xxxxxxx has advised the User of the computer requirement for the proper use of the service and that use of any other equipment or software by the User may affect the quality of the service for which Xxxxxxx is not responsible, and that the User remains responsible for the User fees and also continues to be bound by the terms of this agreement. Xxxxxxx makes no representation, warranty or covenant that any future modifications to the service will be compatible with the equipment or any other equipment or software. In such event, your sole remedy will be to terminate the service agreement within 15 days notification to Xxxxxxx and upon verification of equipment incompatibility by Xxxxxxx.
User’s Equipment. 2.1 Subject always to the User’s system being approved by Scottish Ministers, Scottish Ministers grant the User permission to access the traffic images through connecting the User’s system to the Scottish Minister’s telecommunications system in compliance with Scottish Ministers technical requirements specified in Schedule C1 of Appendix C to this Licence and all relevant British Standards or their European equivalents statutes or other Codes of Practice bylaws or statutory instruments which may be in force or come into force during this Licence.

  • Contractor’s Equipment Payment for required equipment owned by the Construction Manager or an affiliate of the Construction Manager will be based solely on an hourly rate derived by dividing the current appropriate monthly rate by 176 hours. No payment will be made under any circumstances for repair costs, freight and transportation charges, fuel, lubricants, insurance, any other costs and expenses, or overhead and profit. Payment for such equipment made idle by delays attributable to the Government will be based on one-half the derived hourly rate under this subsection.

  • UNIFORMS & EQUIPMENT Uniforms and equipment required by the Department to be worn/used by employees will be furnished by the Department.

  • Safe Equipment The City shall furnish and maintain in the best possible working condition, within the limits of its financial capability, the necessary tools, facilities, vehicles, supplies, and equipment required for members to safely carry out their duties. Members are responsible for reporting unsafe conditions or practices, for avoiding negligence, and for properly using and caring for tools, facilities, vehicles, supplies, and equipment provided by the City.

  • Customer Equipment Customer represents and warrants that it owns or has the legal right and authority, and will continue to own or maintain the legal right and authority during the term of this Agreement, to place and use the Customer Equipment as contemplated by this Agreement. Customer further represents and warrants that its placement, arrangement, and use of the Customer Equipment in the Internet Data Centers complies with the Customer Equipment Manufacturer's environmental and other specifications.

  • Rental Equipment 7.1 We will at all times own all Rental Equipment supplied to you. You will not let, sell, charge, assign, sub-license or allow a third party to use the Rental Equipment nor remove any labels, and shall not prejudice our rights in the Rental Equipment in any way. We may replace the Rental Equipment from time to time either with your prior consent or provided that the replacement Rental Equipment is of a specification that is at least equal to the Rental Equipment originally supplied and such change does not materially disrupt the provision of the Services.

  • Stored equipment We accept no responsibility for any stored equipment or other property brought on to or left at the premises, and all liability for loss or damage is hereby excluded. All equipment and other property (other than stored equipment) must be removed at the end of each hiring or we will charge fees each day or part of a day at the hire fee per hiring until the same is removed. We may, in our discretion, dispose of any items referred to below by sale or otherwise on such terms and conditions as we think fit, and charge you any costs we incur in storing and selling or otherwise disposing of the same, in any of the following circumstances:

  • Lease of Equipment Lessor leases to Lessee, and Lessee leases from Lessor, all the property described in the Lease Schedules which are signed from time to time by Lessor and Lessee.

  • Premises and equipment 6.1 If necessary, the Customer shall provide the Supplier with reasonable access at reasonable times to its premises for the purpose of supplying the Services. All equipment, tools and vehicles brought onto the Customer’s premises by the Supplier or the Staff shall be at the Supplier’s risk.

  • System Upgrade Facilities Transmission Owner shall design, procure, construct, install, and own the System Upgrade Facilities described in Appendix A hereto. The responsibility of the Developer for costs related to System Upgrade Facilities shall be determined in accordance with the provisions of Attachment S to the NYISO OATT.

  • Your Equipment All equipment and facilities provided by you for use with your Services is “Customer Equipment.” You are solely responsible for installing, maintaining, configuring, repairing, replacing, upgrading and using your Customer Equipment. Astound has no responsibility whatsoever with respect to your Customer Equipment. If your Customer Equipment impairs the Services, you will remain liable for payment of the applicable Fees for your Services. If, at your request, Xxxxxxx should attempt to resolve difficulties caused by your Customer Equipment, such efforts will be performed at Astound’s discretion and at Astound’s then- current standard hourly rates for such work. Any Customer Equipment you use in connection with the Services must meet Astound’s then-current minimum technical and other requirements.
