Using the Vehicle. (a) When you are operating the Vehicle you must always do so in a safe manner. You must not: (i) operate the Vehicle at any time that it is unsafe to do so; (ii) operate the Vehicle or allow the Vehicle to be operated in any illegal manner; (iii) operate the Vehicle under the influence of drugs, alcohol, prescribed medication or any other substance which may impair your ability to drive the Vehicle; (iv) consume or allow any passengers to consume any alcohol or illicit drugs in the Vehicle; (v) allow the Vehicle to be driven by anyone, other than approved KINTO Members; (vi) allow any more passengers to travel in the Vehicle than are legally permitted; (vii) use or prepare the Vehicle for use in any form of motor sport or contest, experiment, test, trial or demonstration purpose; (viii) if the Vehicle does not have appropriate towing attachments fitted by KINTO, use the Vehicle to convey or tow a load; (ix) if the Vehicle does have appropriate towing attachments fitted by KINTO, use the Vehicle to convey or tow a load other than in accordance with the Vehicle and trailer manufacturers' specifications; (x) remove or attempt to remove the Vehicle from Australia; (xi) remove any accessories or devices attached or fitted to the Vehicle; (xii) remove or attempt to remove any e-tag, car park access device or parking pass from the Vehicle; (xiii) part with possession of the Vehicle; (xiv) make alterations or additions or interfere with the Vehicle (including installing anything on or in the Vehicle); (xv) smoke or vape in the Vehicle or permit passengers to do so; (xvi) use the Vehicle for fare or reward (including driving school instruction); (xvii) use the Vehicle for any unlawful purpose, including carrying hazardous or inflammable goods; (xviii) take pets in the Vehicle; (xix) fill up the Vehicle with incorrect fuel; (xx) allow the Vehicle to be driven on unsealed roads, beaches or through streams, dams, rivers, flood waters, xxxx fire affected areas or any other roadway where the police or any government authority have issued a warning or caution; (xxi) drive the Vehicle until it no longer has any fuel and/or Alternative Fuel remaining in it;; (xxii) fail to comply with the terms and conditions of places where you use the Vehicle, such as parking lots; or (xxiii) when the Vehicle is not in use, leave it unsecure. This includes not leaving: (A) the Vehicle unlocked; (B) windows down, (C) boot open; (D) the fuel cap open; or (E) the sun-roof open. (b) You agre...

Using the Vehicle. 1.1 The Lessee undertakes to use and drive the Vehicle in accordance with the Highway Code and only in Majorca. It is expressly forbidden to: a) Carry passengers in return for payment or in a number higher than that authorised in the Vehicle Excise Licence; b) Push or tow any vehicle or any other objects, and take part in races, whether or not official, and perform resistance tests on materials, accessories or products for automobiles; c) Drive the Vehicle in a negligent or rash way, or when under the influence of alcohol, drugs or any other drug substances; d) Carry goods that contravene the Law and whose weight, quantity and/or volume exceeds those authorised in the Vehicle Excise Licence, and flammable and/or dangerous goods and products which are toxic, harmful and/or radioactive; e) Carry live animals (except for pets and/or domestic animals, with the previous authorisation of the Lessor); f) Use a roof rack or similar element that is not supplied by the Lessor; g) Smoke inside the vehicle . 1.2 Only the person/s identified and accepted by the Lessor in the lease contract are authorised to drive the Vehicle, providing they are aged over 21 years or over 25 years, depending on the Vehicle group indicated in the General Applicable Rates and that they have held a Driver’s Licence for at least one year. 1.3 The Lessee is forbidden to assign, rent, mortgage, pledge, sell or in any way, use the Vehicle, lease contract, keys, documentation, fixtures, tools and/or accessories of the Vehicle and/or any parts of it as a guarantee. 1.4 All damages caused due to breach of the conditions set forth in this contract shall entitle the Lessor to terminate the contract and take the Vehicle from the Lessee and to bill the Lessee and collect from it all duly justified amounts for repairing such damages.

  • Managing the Grant 7.1 Each party must notify the other of: (a) the nominated person who will act as the party’s authorised representative; and (b) the contact details of the authorised representative and any deputies. 7.2 The Commissioner requires the Recipient to submit monitoring information, as detailed in Schedule 1. These reports must: (a) be in the format set out in an Annex A; (b) be signed by The Recipient’s Chief Finance Officer; (c) contain a detailed breakdown of expenditure for the period outlined in Schedule 2; and (d) be accompanied by a progress report for the period. 7.3 The Commissioner may, in addition, ask the Recipient to clarify information provided to it. If so, the Recipient shall comply with any reasonable request. 7.4 The Commissioner may, in addition, ask the Recipient to provide him/her with forecast outturn information for the financial year end. If so, the Recipient shall comply with any reasonable request. 7.5 The Recipient must notify the Commissioner as soon as reasonably practicable that an underspend is forecast. No carry-over of funds will be allowed, except in exceptional circumstances and with prior approval from the Commissioner. 7.6 Any underspend of Grant funds must be returned to the Commissioner. 7.7 If an overpayment of the Grant has been made, the Commissioner will recover the payment. 7.8 The Recipient may not vire funds between this Grant and other grants made to it. 7.9 The Recipient’s Chief Finance Officer will ensure that appropriate professional arrangements are put in place for the management of the Grant and the reporting of expenditure. The Recipient’s Chief Finance Officer should take all necessary steps to ensure that the Grant is accounted for and monitored separately from the Recipient’s other funding streams. 7.10 The Recipient undertakes to complete the work for which the Grant is provided. The work should be completed within agreed timescales, and the Recipient will report any significant variations to spending on work funded by the Commissioner.

  • Spending the Grant 9.1 The Grantee agrees to spend the Grant for the purpose of undertaking the Activity only. 9.2 The Grantee agrees to provide a statement signed by the Grantee verifying the Grant was spent in accordance with the Agreement.

  • Continuing the Work The Contractor shall carry on the Work and adhere to the progress schedule during all disputes, disagreements or alternative resolution processes with the Owner. The Contractor shall not delay or postpone any Work because of the pending resolution of any disputes, disagreements or processes, except as the Owner and the Contractor may agree in writing.

  • Regarding the Owner Trustee Owner Participant will cause Owner Trustee to perform its obligations under each Owner Trustee Agreement.

  • ENDING THE TENANCY 1) The tenant may end a monthly, weekly or other periodic tenancy by giving the landlord at least one month's written notice. A notice given the day before the rent is due in a given month ends the tenancy at the end of the following month. [For example, if the tenant wants to move at the end of May, the tenant must make sure the landlord receives written notice on or before April 30th.] 2) This notice must be in writing and must a) include the address of the rental unit, b) include the date the tenancy is to end, c) be signed and dated by the tenant, and d) include the specific grounds for ending the tenancy, if the tenant is ending a tenancy because the landlord has breached a material term of the tenancy. 3) If this is a fixed term tenancy and the agreement does not require the tenant to vacate at the end of the tenancy, the agreement is renewed as a monthly tenancy on the same terms until the tenant gives notice to end a tenancy as required under the Residential Tenancy Act. 4) The landlord may end the tenancy only for the reasons and only in the manner set out in the Residential Tenancy Act and the landlord must use the approved notice to end a tenancy form available from the Residential Tenancy Branch. 5) The landlord and tenant may mutually agree in writing to end this tenancy agreement at any time. 6) The tenant must vacate the residential property by 1 p.m. on the day the tenancy ends, unless the landlord and tenant otherwise agree.
