Vacancy of Key Positions. If during the course of normal employee turnover, any of the above-described positions remain open for a period in excess of 30 calendar days, ATN may deduct from payments due CONTRACTOR the salary and benefits of the position, plus a penalty of $200.00 for each day in which the position remains unfilled beyond the first 30 days.
