Vulnerable Adults. In acknowledging that some service users would fall outside of the eligibility criteria for learning disability services wherever the line is drawn, there is a need for a clear definition of other “vulnerable adults” who may, on occasion, qualify for services which are best provided within the learning disability specialism. In these cases the criteria would be: • a person who is believed to have a learning disability or borderline intelligence but does not have a definite diagnosis and • is at immediate risk from death, serious harm, serious exploitation or neglect and • help is not available from any other service In such cases, help and advice will be provided on a short term basis with the aim of moving service users out of specialist learning disability services into mainstream services as soon as possible This service user group is not entitled to ongoing services from the learning disability specialism and intervention from specialist learning disability services in relation to people who do not meet the normal eligibility criteria will be exceptional

Vulnerable Adults. 5.1 The Safeguarding Adults Policy, Procedure and Good Practice Guidance, defines a “Vulnerable Adult” as: Adults who are in receipt of, or may be eligible for, community care services. 5.2 In other words it is those whose independence and wellbeing would be at risk if they did not receive appropriate health and social care support. This includes adults with physical, sensory and mental impairments and learning disabilities, howsoever those impairments have arisen, e.g. whether present from birth or due to advancing age, chronic illness or injury. They also include carers: family and friends who provide personal assistance and care to adults on an unpaid basis. They are not a self-defined community, but a group that has been created by social policy. This document is based on the premise that “when an adult in this group is experiencing abuse or neglect, this will have significant impact on their independence, health and wellbeing.” (ADSS 2005) 5.3 People who may be included in a definition of aVulnerable Person”. ● People with learning disabilities ● People with physical disabilities ● People with sensory impairments ● People with mental health needs, including dementia ● People who misuse substances or alcohol ● People who are physically or mentally frail 5.4 The safeguarding adults policy, procedure and good practice guidance applies all residents of St. Helens, regardless of the setting, i.e. community, hospital or care establishment.   • Reporting of Non-Force Majeure Events Each Party (the “Notifying Party”) shall notify the other Parties when the Notifying Party becomes aware of its inability to comply with the provisions of this Agreement for a reason other than a Force Majeure event. The Parties agree to cooperate with each other and provide necessary information regarding such inability to comply, including the date, duration, reason for the inability to comply, and corrective actions taken or planned to be taken with respect to such inability to comply. Notwithstanding the foregoing, notification, cooperation or information provided under this Article shall not entitle the Party receiving such notification to allege a cause for anticipatory breach of this Agreement.

  • Job Postings The employee may apply for a job posting at either home based on their seniority at the designated employer. The vacancy will be filled in accordance with Article 9 of the collective agreement. Where seniority is the deciding factor the most senior candidate will be selected regardless of which home her/his seniority was accumulated.

  • JOB POSTING The following provision will appear in all collective agreements replacing any related provision that existed in the hospital's expiring collective agreement: (Any provision pertaining to definition of temporary vacancies, non-bargaining unit applications, outside advertising, interim placements or criteria for selection except as it relates to promotions and transfers that existed in the hospital's expiring collective agreement will be continued as the last paragraph of this Article). "Where a permanent vacancy occurs in a classification within the bargaining unit or a new position within the bargaining unit is established by the Hospital, such vacancy shall be posted for a period of seven (7) consecutive calendar days. Applications for such vacancy shall be made in writing within the seven (7) day period referred to herein. The postings shall stipulate the qualifications, classifications, rate of pay, department and shift and a copy shall be provided to the Chief Xxxxxxx. Vacancies created by the filling of an initial permanent vacancy will be posted for a period of three (3) consecutive calendar days, excluding Saturdays, Sundays and Holidays. Applications for such vacancies shall be made in writing within the three (3) day period referred to herein. In matters of promotion and staff transfer appointment shall be made of the senior applicant able to meet the normal requirements of the job. The name of the successful applicant will be posted on the bulletin board for a period of seven (7) calendar days. Where there are no successful applicants from within this bargaining unit for vacant positions referred to in this Article, employees in other CUPE bargaining units at the Hospital will be selected in accordance with the criteria for selection above, prior to considering persons who are not members of CUPE bargaining units at the Hospital. The employees eligible for consideration shall be limited to those employees who have applied for the position in accordance with this Article, and selection shall be made in accordance with this Article. The successful applicant shall be allowed a trial period of up to thirty (30) days, during which the Hospital will determine if the employee can satisfactorily perform the job. Within this period the employee may voluntarily return, or be returned by the Hospital to the position formerly occupied, without loss of seniority. The vacancy resulting from the posting may be filled on a temporary basis until the trial period is completed. A list of vacancies filled in the preceding month under this Article and the names of the successful applicants will be posted, with a copy provided to the union."
