Water and Wastewater Service. During May through September, EMD shall not interfere with Denver’s use of non-potable water pumped from the Lake by Denver, as is reasonably necessary for Denver’s irrigation of Evergreen Golf Course in Dedisse Park at no cost to Denver. Denver will use its best efforts in complying with EMD Rules and Regulations regarding restrictions on reasonable water use imposed by EMD on its customers, and in operating and maintaining the water pump and irrigation system for the Evergreen Golf Course in an efficient manner to prevent leakage and waste of water. EMD shall provide notice to Denver of any drought or other use restrictions. EMD may install, maintain, inspect and verify the calibration of measuring devices for the Evergreen Golf Course irrigation system. EMD will maintain an appropriate accounting and reporting system for the use of EMD and Denver water rights in the Lake, including replacing evaporation from the Lake. The water rights used for such purposes will be a combination of Denver’s storage rights in the Lake and EMD’s water rights as required by State water administrators. Water and Wastewater Service. The City hereby agrees to provide continuous and adequate water and wastewater service to the Property as is required of all Certificate of Convenience and Necessity (CCN) holders pursuant to Texas Water Code Section 13.250 (a). The City hereby agrees to provide 165 water and 165 wastewater Living Equivalent Units (LUEs) for the Development. Developer and City acknowledge that Developer is working to secure wastewater easements from offsite property owners, and City agrees to cooperate with Developer as necessary to secure such offsite wastewater easements. If Developer is unsuccessful in obtaining the necessary offsite wastewater easements, City agrees to consider an Annexation Petition to annex for full purposes the portion of Tower Road right of way depicted in Exhibit D. City further agrees that it shall not delay approval of Developer’s applications for City site development and building permits for the development of the Property while Developer’s applications from any governmental agency are pending. Notwithstanding Section 2(a), the provisions of this Section 5 shall survive any termination of this Agreement, and, to the extent necessary, shall continue to be applicable to the Development.
Water and Wastewater Service. Xxxxx Xxxxxx Xxxxx Xxxxxxxxx Sales Tax Sharing Agreement The City shall extend water and wastewater services to the frontage of both Price Ford and Price Honda. The extension of City services is conditioned upon the property owner for Price Ford and Price Honda executing an out of boundary service agreement with City and that the out of boundary service extension is approved by LAFCO. The County agrees not to oppose the extension.

  • Dewatering (a) Where the whole of a site is so affected by surface water following a period of rain that all productive work is suspended by agreement of the Parties, then dewatering shall proceed as above with Employees so engaged being paid at penalty rates as is the case for safety rectification work. This work is typically performed by Employees engaged within CW1, CW2 or CW3 classifications. When other Employees are undertaking productive work in an area or areas not so affected then dewatering will only attract single time rates. (b) Where a part of a site is affected by surface water following a period of rain, thus rendering some areas unsafe for productive work, consistent with the Employer’s obligations under the OH&S Act, appropriate Employees shall assist in the tidying up of their own work site or area if it is so affected. Where required, appropriate Employees will be provided with the appropriate PPE. Such work to be paid at single time rates. Productive work will continue in areas not so affected. (c) To avoid any confusion any ‘dewatering’ time which prevents an Employee from being engaged in their normal productive work is not included in any calculation for the purposes of determining whether an Employee is entitled to go home due to wet weather (refer clauses 32.4 and 32.5)
