Web Site Availability. Although considerable effort is expended to make our website and other means of communications and access available around the clock, we do not warrant these forms of access to be available and error free at all times. You agree that we will not be responsible for temporary interruptions in service due to maintenance, website changes, or failures, nor shall we be liable for extended interruptions due to failures beyond our control, including but not limited to the failure of interconnecting and operating systems, computer viruses, forces of nature, labor disputes and armed conflicts.

Web Site Availability. The Fund Documents Web Site shall be publicly available to users a minimum of 99% of the time during any 24 hour period, 95% of the time during any 7 day period, and 95% of the time during any 30 day period; and there will be no period of interruption in public accessibility to the Fund Documents Web Site that exceeds 24 continuous hours excluding server downtime due to scheduled maintenance. “Available” means that end users are able to access and use the hosting services and all functionality and content therein, and the hosting services are functioning correctly and accurately. To the extent that there is any applicable guidance received from the SEC or from the SEC Staff that requires Web site availability in addition to, or in excess of, these standards, the Trust will comply with such guidance.

To the extent that there is any applicable guidance received from the SEC or from the SEC Staff that requires Web site availability in addition to, or in excess of, these standards, the Trust and Distributor will comply with such guidance.

Web Site Availability. Under normal operating circumstances, the PHA-Web site will be available for access and use by Licensee and its Authorized Employees and Agents twenty-four (24) hours a day, everyday of the year. Access to PHA-Web may be interrupted as a result of things beyond the control of MCS. Access interruptions may occur as a result of computer equipment failures, communication equipment failures, Internet failures, Licensee’s Internet connection failures, software failures, computer viruses, acts of terrorism and other problems. Licensee and its Authorized Employees and Agents shall not hold MCS liable for any such interruptions, regardless of whether such interruptions result from any negligent actions or omissions by MCS and its employees and agents. MCS will make every reasonable effort to restore availability of PHA-Web for access and use by Licensee and its Authorized Employees and Agents as soon as possible. In addition, it may be necessary for MCS to schedule downtimes for computer equipment repairs, computer software maintenance, repairs to communication equipment, upgrades to equipment or programs or other things necessary to maintain or modify PHA-Web. If it is necessary to schedule downtimes, MCS will attempt to schedule downtimes in advance with notice to Licensee. MCS also will attempt to schedule downtimes in a manner that will cause the least interruption with Licensee’s operations. Licensee and its Authorized Employees and Agents agree that they will not hold MCS liable for scheduled downtimes. Licensee shall be solely responsible for the selection and accuracy of data maintained by Licensee on the PHA-Web database. Licensee shall regularly audit data entered by its Authorized Employees and Agents on the PHA-Web database. Licensee shall regularly print reports of all data stored on PHA-Web as may be required for the operations of Licensee’s public housing authority. Licensee agrees to retain such printed reports for such time and in such manner as Licensee may require to insure that Licensee always has complete, accurate and current copies of all data entered by Licensee and its Authorized Employees and Agents on PHA-Web.
Web Site Availability. Your Web site will be accessible to third parties via the World Wide Web portion of the Internet twenty-four (24) hours a day, seven (7) days a week, except for scheduled maintenance and required repairs, and except for any loss or interruption of hosting services due to causes beyond the control of (LICENSEE) or which are not reasonably foreseeable by (LICENSEE), including, but not limited to, interruption or failure of teleconununication or digital transmission links and Internet slow-downs or failures.

  • EPP service availability Refers to the ability of the TLD EPP servers as a group, to respond to commands from the Registry accredited Registrars, who already have credentials to the servers. The response shall include appropriate data from the Registry System. An EPP command with “EPP command RTT” 5 times higher than the corresponding SLR will be considered as unanswered. If 51% or more of the EPP testing probes see the EPP service as unavailable during a given time, the EPP service will be considered unavailable.

  • Service Availability You understand that Service availability is at all times conditioned upon the corresponding operation and availability of the communication systems used in communicating your instructions and requests to the Credit Union. We will not be liable or have any responsibility of any kind for any loss or damage thereby incurred by you in the event of any failure or interruption of such communication systems or services resulting from the act or omission of any third party, or from any other cause not reasonably within the control of the Credit Union.

  • System Availability Although we will try to provide continuous access to the Service, we cannot and do not guarantee that the Service will be available 100% of the time and will not be liable in the event Service is unavailable. Actual service or network performance is dependent on a variety of factors outside of our control. If you notify us within twenty-four (24) hours and we confirm an outage consisting of a period of two (2) hours in any calendar month, and not due to any service, act, or omission of you, a third party, your applications, equipment or facilities, or reasons outside of our control, you shall be eligible for a service credit. A service credit shall be computed as a pro-rated charge for one day of the regular monthly fees for the Service in the next monthly statement. Intermittent service outages for periods of less than two (2) hours are not considered service outages. Outages caused by routine scheduled maintenance are also not considered an outage. You shall receive advance notice no less than forty-eight (48) hours in advance of our scheduled maintenance. Scheduled maintenance will be performed between 12:00 a.m. and 6:00 a.m. CST.

  • Product Availability Under no circumstances shall Company be responsible to Representative or anyone else for its failure to fill accepted orders, or for its delay in filling accepted orders, when such failure or delay is due to strike, accident, labor trouble, acts of nature, freight embargo, war, civil disturbance, vendor problems or any cause beyond Company's reasonable control.

  • RDDS availability Refers to the ability of all the RDDS services for the TLD, to respond to queries from an Internet user with appropriate data from the relevant Registry System. If 51% or more of the RDDS testing probes see any of the RDDS services as unavailable during a given time, the RDDS will be considered unavailable.

  • High Availability Registry Operator will conduct its operations using network and geographically diverse, redundant servers (including network-­‐level redundancy, end-­‐node level redundancy and the implementation of a load balancing scheme where applicable) to ensure continued operation in the case of technical failure (widespread or local), or an extraordinary occurrence or circumstance beyond the control of the Registry Operator. Registry Operator’s emergency operations department shall be available at all times to respond to extraordinary occurrences.

  • DNS name server availability Refers to the ability of a public-­‐DNS registered “IP address” of a particular name server listed as authoritative for a domain name, to answer DNS queries from an Internet user. All the public DNS-­‐registered “IP address” of all name servers of the domain name being monitored shall be tested individually. If 51% or more of the DNS testing probes get undefined/unanswered results from “DNS tests” to a name server “IP address” during a given time, the name server “IP address” will be considered unavailable.

  • DNS service availability Refers to the ability of the group of listed-­‐as-­‐authoritative name servers of a particular domain name (e.g., a TLD), to answer DNS queries from DNS probes. For the service to be considered available at a particular moment, at least, two of the delegated name servers registered in the DNS must have successful results from “DNS tests” to each of their public-­‐DNS registered “IP addresses” to which the name server resolves. If 51% or more of the DNS testing probes see the service as unavailable during a given time, the DNS service will be considered unavailable.

  • FUNDING AVAILABILITY This Contract is contingent upon the continued availability of funding. If funds become unavailable through the lack of appropriations, legislative or executive budget cuts, amendment of the Appropriations Act, state agency consolidation or any other disruptions of current appropriations, DFPS will reduce or terminate this Contract.
