Paraprofessionals from the specific classification where there are vacancies will be given priority consideration and be offered positions prior to staff from outside the classification and the bargaining unit. If the summer job cannot be filled in the building or with a bargaining unit member, the position will be filled on a temporary basis for the duration of the summer program.

In the event a year-round school program is developed and paraprofessional positions are available, representative(s) of LPS shall meet with LPA representative(s) to determine the proposed schedule for paraprofessional assignments, and to develop a posting(s) for such assignment(s). Paraprofessionals currently assigned to a work site where such a schedule is to occur shall be given the first opportunity to accept such an assignment.
a. In the event a paraprofessional currently assigned to such a building does not wish to accept such an assignment, that position shall be posted internally, and the person currently holding the position shall be allowed employees when conditions permitto transfer to a vacant position.

Work Schedule. 4.1 It is agreed that during the term of this Agreement, unless otherwise mutually agreed, the fire fighters covered by this contract will be organized into three (3) fire fighter squads, each of which will be headed by a Captain or another senior station officer. Each squad will be scheduled to work a twenty-four (24) hour shift schedule, (twenty-four (24) hours on duty, forty-eight (48) hours off duty). For those employees working a 24/48 schedule, the average annual weekly hours shall be forty-eight (48) hours per week. The normal computation for pay purposes shall be based on 2,496 hours per year. Such employees shall receive one (1) normally scheduled tour of duty off (“Xxxxx Xxx”) every seventh (7th) shift. The County will determine the number and location of Xxxxx Xxx assignments. Less than year round employees are the Early Elementary Head Secretary, the Later Elementary Head Secretary, the Middle School Head Secretary, the Middle School Office Secretary, the High School Head Secretaries, the High School Office Secretary, the Assistant Principal Secretary, the Xxxx of Students Secretary, the Athletic Director/High School Counselor Secretary, the Special Education Secretary, the Curriculum Secretary and the Academy of Arts and Sciences Secretary.
G. Less then year round employees are required to work the same number of days as their Principal or Director, EXCEPTING HOWEVER the Special Education Secretary. The High School Principal and Assistant Principal work all teacher days plus 30 days. The Middle School Principal and the Curriculum Director work all teacher days plus 25 days. The Director of Special Education works all teacher days, the Special Education Secretary shall not exceed fifty-work all teacher days plus 20 days. High School and Middle School secretaries start date will be three (533) hours except as provided below.
4.2 The normal workday for Detectives weeks prior to the first teacher day. Elementary, Special Education and Academy secretaries start date will consist of the “4/10” work schedule: A work day shall consist of ten (10) consecutive hours including time for lunch. The Normal assigned work week shall be four (4) consecutive days of works followed by three consecutive days of rest, not to exceed forty (40) hours except as provided below.
4.3 The normal work day for the Administrative Sergeant will consist of eight (8) consecutive hours including time for lunch. The normal assigned work week shall be five (5) consecutive days, followed by two (2) days of rest, not weeks prior to exceed forty (40) hours except as provided below, provided that the Administrative Sergeant may work the “4/10” work schedule as described first teacher day. Exceptions to start dates must be approved in Section 4.2 abovewriting based upon mutual agreement.
4.3 The parties may, upon mutual consent, meet and discuss alternative work shifts.
4.4 There shall be three patrol schedules in a calendar year in blocks of four months each: • Schedule “1” is from January through April; • Schedule “2” is from May through August; • Schedule “3” is from September through December. Prior to December 1st of each year, all patrol employees will bid first for squad / shift assignment for the succeeding year. These bids will be based on seniority, with the provisions that squad assignment will last for the entire year. Employees will be allowed to H. Work Schedule. 4.1 SECTION 1. The normal work day for Patrol Officers week shall begin at 12:01 A.M. on Sunday and Sergeants shall consist of the “5/4” work schedule: a end at 12 midnight on Saturday. The work day shall consist of eight (8) hours per day unless an employee is regularly scheduled to work more than eight (8) hours in a ten and six-tenths (10.6) hour work day including time for lunch. The normal Assigned work week shall be five consecutive work days followed by four days of rest, five consecutive work days followed by four days of rest and five consecutive work days followed by five days of rest. The work week shall not exceed fifty-three (53) hours except such as provided below.
4.2 The normal workday for Detectives will consist of the “4/10” work schedule: A work day shall consist of a ten (10) consecutive hours including time for lunchor twelve (12) hour day. The Normal assigned work week day is defined as a span of twenty-four (24) hours beginning at 12:01 a.m. and ending at midnight.
SECTION 2. Each employee shall be permitted a meal period of not less than one-half (1/2) hour after not more than five (5) hours of continuous work. Each employee shall receive at least a thirty (30) minute unpaid meal period, but in no case in excess of a forty-five (45) minute meal period. Employees may receive a meal period of one (1) hour if consistent with operating efficiency and shall be scheduled by the Employer. In such case, forty-five (45) minutes of the meal period shall be unpaid and fifteen (15) minutes shall be paid in lieu of the two ten (10) minute rest periods mentioned in Section 3 of Article VI. The employer shall have the sole discretion of setting the duration of the meal period in accordance with the above minimum and maximum time periods. Employees who are required by their supervisors to be at their assigned station, or are required to attend a mandatory/required meeting, shall receive straight-time pay plus any applicable shift differential during the meal period. This time will be considered as time worked for the computation of overtime.
SECTION 3. Each employee shall receive a rest period during each continuous four (4) consecutive days hours of works followed by three consecutive days work of restnot more than ten (10) minutes. The Employer, at its discretion, may grant additional rest periods or lengthen rest periods; however, whether or not this right is exercised shall not be subject to exceed forty (40) hours except as provided belowthe grievance procedure.

4.4 There shall be three patrol schedules where creating such an opportunity supports the internal and external customer orientation of Xxxxxx Permanente. Section 5. Employees required to change clothes or pick up or return keys or equipment on University premises shall be afforded a reasonable amount of time for these duties.
Section 6. On call Employees required by the University to leave word as to where they may be reached while off University premises shall receive $12.50 for eight (8) through eleven (11) hours on call or $18.50 for twelve (12) through twenty-four (24) hours on call.

25.03 Requests for change in posted work day schedules must be submitted in writing and co- signed by the Employee requesting the changes to days off or Shifts and are subject to the discretion of the Director of Care. In any event it is understood that such change initiated by the Employee and approved by the Employer shall consist not result in overtime compensation or payment, or any other claims on the Employer by any Employee under the terms of a ten this Agreement.
25.04 Shift schedules for full-time and sixpart-tenths time shall provide the following:
(10.6a) hour work day including time for lunchat least two (2) consecutive days of rest per week averaged over one (1) complete cycle of the Shift schedule. The normal Assigned Employer may switch days of rest to accommodate an emergency situation provided the switch is mutually agreed with the Employees affected; and
(b) days of rest on at least four (4) weekends in eight (8). Weekends off shall mean Saturday and Sunday with a minimum of fifty-five (55) hours off duty unless mutually agreed to by the Employer and Employee; and

(d) at least fifteen point five (15.5) hours off duty between Shifts.
25.05 All regular hours worked on a Shift in violation of the provisions of Article 25.04 will be five consecutive paid at the rate of one and one-half times (1 1/2X) the Basic Rate of Pay.
(a) An Employee who volunteers or agrees to work days followed by four additional Shifts which are not designated as the Employee’s scheduled days of rest, shall be paid at straight time rates for all hours worked up to seven point seven five consecutive (7.75) hours in a day and at two times (2X) their Basic Rate of Pay for all hours worked in excess of seven point seven five (7.75) hours in a day.
(b) Where the Employer requires a Full-time or Part-time Employee to work days followed by four on their scheduled days of rest and five consecutive work days followed by five days without the Employee having volunteered or agreed to do so, such Employee will have another day off scheduled immediately adjacent to their remaining day off or be paid two times (2X) their Basic Rate of rest. The work week shall not exceed fifty-three (53) Pay for all hours except as provided belowworked on that day.

Work Schedule. 4.1 The normal work day for Patrol Officers and Sergeants shall consist schedule or shift hours of the “5/4” employees shall be for twenty-eight (28) days in duration and shall be posted at least twenty-eight (28) calendar days in advance of the beginning of the schedule. The Employer shall determine how many employees, if any, will be assigned to each shift.
A. Employees shall be allowed to bid for preferred shifts in accordance with seniority. Employees shall bid for shifts by June 15th, November 15th and March15th in advance of the beginning of the semester. Any changes in schedule are in effect for the full twenty- eight (28) day schedule. An officer’s regularly assigned shift hours will not be changed due to an athletic/special event. Employees assigned to work schedule: a the first shift (days) of the twelve (12) hour workday will begin at 6:00 AM and end the shift at 6:00 PM. Employees assigned to work day shall consist the second shift (nights) of a ten and six-tenths the twelve (10.612) hour work day including will begin at 6:00 PM and end the shift at 6:00 AM. At the beginning of the first shift rotation after May commencement, the University will schedule one officer on the day shift during the weekend time period. This will be in effect for lunchthe next three (3) shift rotations (e.g. three consecutive, twenty-eight calendar day work schedules). 2. In case of restdisasters (man-made or natural) and/or emergencies (including military call back) requiring total or partial mobilization of manpower for the protection of public health, five consecutive work days followed by four days welfare, and safety.
3. Court time as the result of rest and five consecutive work days followed by five days of resta subpoena served, if not less than two (2) weeks' notice is provided.

4.3 The normal work day for the Administrative Sergeant will consist of eight (8) consecutive hours including time for lunch. 4.3 The parties may, upon mutual consent, meet and discuss alternative work shifts.

(a) An Employee who volunteers or agrees to work days followed by four additional shifts which are not designated as her scheduled days of rest, shall be paid at straight time rates for all hours worked up to seven point seven five consecutive (7.75) hours in a day and at two times (2X) her Basic Rate of Pay for all hours worked in excess of seven point seven five (7.75) hours in a day.
(b) Where the Employer requires a Full-time or Part-time Employee to work days followed by four on her scheduled days of rest and five consecutive work days followed by five days of rest. The work week shall not exceed fifty-three (53) hours except as provided below.

Work Schedule. 4.1 A. The normal work day regular workweek for Patrol Officers and Sergeants department personnel shall average forty-two (42) hours.
B. The regular workweek for department personnel on the “platoon system” shall consist of the “5/4” work schedule: a work day shall consist of a ten and six-tenths two (10.62) hour work day including time for lunch. The normal Assigned work week shall be five consecutive work days followed by four days of rest, five consecutive work days followed by four days of rest and five consecutive work days followed by five days of rest. The work week shall not exceed fifty-three (53) hours except as provided below.
4.2 The normal workday for Detectives will consist of the “4/10” work schedule: A work day shall consist of ten (10) hours each, commencing at 0700 hours and concluding at 1700 hours, two (2) consecutive nights of fourteen (14) hours, commencing at 1700 hours including time for lunch. The Normal assigned work week shall be and concluding at 0700 hours, followed by four (4) consecutive “days off”.
C. The District retains the rights of works followed by three consecutive days placing any firefighter hired after the institution of restthe Agreement (hereinafter designated as “new hirees”) on such a schedule they see fit to maintain adequate manpower, so long as the new hirees schedule does not to exceed forty-two (42) hour workweek.
D. Deputy Chief and Fire Inspector shall work a forty (40) hour week scheduled between Monday and Friday for the typical workweek. The schedule shall be between the hours except of 0700 – 1700 on a four (4) (ten (10) hour per day) schedule. The four (4) day schedule they work shall be an alternating schedule and not have the same scheduled day off. The work schedule for the Deputy Chief and Fire Inspector on this assignment, which shall be known as provided belowPlatoon E. The Deputy Chief and Fire Inspector assigned to this schedule shall have the option to take off the holidays listed in Article IX Section 12 of this agreement and receive a normal forty (40) hour salary, or work the listed holidays and receive straight time in addition to their weekly forty (40) hour salary.
4.3 The normal work day for a. It is agreed upon that there are circumstances that necessitate the Administrative Sergeant will consist of Deputy Chief working Monday through Friday, eight (8) consecutive hours including time for lunchper day. The normal assigned work week Fire Chief shall notify the Deputy Chief at least two (2) weeks in advance, unless this schedule change is do to an unforeseen emergency.
E. Whenever the management of The District transfers a member from one shift to another, he shall be five (5) consecutive days, followed by allowed a minimum of two (2) days of rest, not to exceed forty (4048) hours except as provided below, provided that the Administrative Sergeant may work the “4/10” work schedule as described in Section 4.2 above.
4.3 The parties may, upon mutual consent, meet and discuss alternative work shifts.
4.4 There shall be three patrol schedules in a calendar year in blocks of four months each: • Schedule “1” is from January through April; • Schedule “2” is from May through August; • Schedule “3” is from September through December. Prior to December 1st of each year, all patrol employees will bid first for squad / shift assignment for the succeeding year. These bids will be based on seniority, with the provisions that squad assignment will last for the entire year. Employees will be allowed to work the same shift assignment for three consecutive periods, subject to availability. Employees will then bid for vacation within each squad as defined by the current labor agreement. Probationary employees will not be eligible for bidding, including those persons whose probation ends at any time during the succeeding year. Upon approval from the building administrator or program supervisor and the Human Resources department, additional days will be scheduled for employees to report to work when students are not in session. These days can include and not be limited to days at the Administrative Sergeant beginning of the school year, workdays, semester workdays, parent teacher conference period, testing periods and at the end of the school year. Employees will consist of be scheduled to perform activities directly related to his/her position and classification. When possible, these days should be scheduled in advance.
Section C. Employees shall be paid time-and-one-half for all hours worked beyond eight (8) consecutive hours including time for lunch. The normal assigned work week shall be five (5) consecutive daysin any one day, followed by two (2) days of rest, not to exceed and over forty (40) hours except as provided belowin any one week. The allowance of an overtime premium on any hour excludes that hour from consideration for overtime payment on any other basis, provided that the Administrative Sergeant may work the “4/10” work schedule as described in Section 4.2 abovethus eliminating any double or pyramiding of overtime payments.
4.3 The parties maySection D. All overtime shall be divided as equally as possible between full-time employees of each building and/or department, upon mutual consent, meet and discuss alternative work shiftsaccording to their skills.

Section F. Employees shall be paid time-and-one-half for all hours worked on Saturdays and shall be paid double-time for all hours worked on Sundays and holidays. Whenever possible, advance notice of overtime shall be given so that necessary arrangements can be made.
1. In the event the duties attached to a ten-(10) month job are extended as part of a summer school program, or a separate summer school program is created, the person(s) with a satisfactory evaluation who hold the position that is in an extended summer school program or part of a K -12 General Education summer school program, shall continue to perform those assigned duties. If the regular employee in that position declines to work in the summer months, the position will be posted. Paraprofessionals from the specific classification where there are vacancies will be given priority consideration and be offered positions prior to staff from outside the classification and the bargaining unit. The summer job shall be offered to a member with a satisfactory evaluation. If given the summer position it will be as a temporary summer position. If the summer job cannot be filled in the building or with a bargaining unit member, the position will be filled on a temporary basis for the duration of the summer program.
2. In the event a year-round school program is developed and paraprofessional positions are available, representative(s) of LPS shall meet with LPA representative(s) to determine the proposed schedule for paraprofessional assignments, and to develop a posting(s) for such assignment(s). Paraprofessionals currently assigned to a work site where such a schedule is to occur shall be given the first opportunity to accept such an assignment.
a. In the event a paraprofessional currently assigned to such a building does not wish to accept such an assignment, that position shall be posted internally, and the person currently holding the position shall be allowed employees when conditions permitto transfer to a vacant position.
b. If no vacancy exists, the paraprofessional currently holding the position shall be allowed to bump the least senior paraprofessional in his/her classification.

In buildings where more than one secretary is assigned, lunch schedules will be staggered to ensure that a minimum of works followed by three consecutive days of rest, not to exceed two (2) secretaries are present in the office at all times.
E. Pay for authorized overtime over forty (40) hours except as provided below.
4.3 The normal work day for the Administrative Sergeant will consist of eight (8) consecutive hours including time for lunch. The normal assigned work per week shall be five (5) consecutive days, followed by two (2) days computed at time and one-half. Authorized overtime shall be defined as time worked in excess of rest, not to exceed the forty (40) hours except as provided below, provided that hour week when requested by the Administrative Sergeant may employee's immediate supervisor. D. The immediate supervisor and/or Superintendent may, on an individual basis, request a less than 52- week employee to work extra time for lunchat their regular rate of pay, if a need arises. The normal assigned employee has the right to decline this request, but it must be offered in the following order: Office Full-time Part-time Office Clerks Full-time Part-time Office Clerks If the office is still not covered after all ASSOCIATION members have been asked, written notice is to be sent to the ASSOCIATION President prior to contacting a substitute to work. Less than year round employees are the Early Elementary Head Secretary, the Later Elementary Head Secretary, the Middle School Head Secretary, the Middle School Office Secretary, the High School Head Secretaries, the High School Office Secretary, the Assistant Principal Secretary, the Xxxx of Students Secretary, the Athletic X. Xxxx then year round employees are required to work the same number of days as their Principal or Director, EXCEPTING HOWEVER the Special Education Secretary. The High School Principal and Assistant Principal work all teacher days plus 30 days. The Middle School Principal and the Curriculum Director work all teacher days plus 25 days. The Elementary Principals and the Academy Director work all teacher days plus 20 days. Work Schedule. 4.1 25.01 The normal Employer shall post work day schedules, covering eight (8) weeks of work, eight (8) weeks in advance.
25.02 Requests for Patrol Officers and Sergeants specific days off shall consist be submitted in writing to the supervisor two (2) weeks prior to the posting of the “5/4” work schedule: a .
25.03 Requests for change in posted work day schedules must be submitted in writing and co- signed by the Employee requesting the changes to days off or Shifts and are subject to the discretion of the Director of Care. In any event it is understood that such change initiated by the Employee and approved by the Employer shall consist not result in overtime compensation or payment, or any other claims on the Employer by any Employee under the terms of a ten this Agreement.
25.04 Shift schedules for full-time and sixpart-tenths time shall provide the following:
(10.6a) hour work day including time for lunchat least two (2) consecutive days of rest per week averaged over one (1) complete cycle of the Shift schedule. The normal Assigned Employer may switch days of rest to accommodate an Emergency situation provided the switch is mutually agreed with the Employees affected; and
(b) days of rest on at least four (4) weekends in eight (8). Weekends off shall mean Saturday and Sunday with a minimum of fifty-five (55) hours off duty unless mutually agreed to by the Employer and Employee; and
(c) not more than six (6) consecutive days. However, an Employee may, by mutual agreement, work week shall seven (7) consecutive days; and
(d) at least fifteen point five (15.5) hours off duty between Shifts.
25.05 All regular hours worked on a Shift in violation of the provisions of Article 25.04 will be five consecutive paid at the rate of one and one-half times (1 1/2X) the Basic Rate of Pay.
(a) An Employee who volunteers or agrees to work days followed by four additional Shifts which are not designated as their scheduled days of rest, shall be paid at straight time rates for all hours worked up to seven point seven-five consecutive (7.75) hours in a day and at two times (2X) their Basic rate of Pay for all hours worked in excess of seven point seven-five (7.75) hours in a day.
(b) Where the Employer requires a Full-time or Part-time Employee to work days followed by four on their scheduled days of rest and five consecutive work days followed by five days of rest. The work week shall not exceed fifty-three (53) hours except as provided below.
4.2 The normal workday for Detectives will consist of without the “4/10” work schedule: A work day shall consist of ten (10) consecutive hours including time for lunch. The Normal assigned work week shall be four (4) consecutive days of works followed by three consecutive days of rest, not to exceed forty (40) hours except as provided below.
4.3 The normal work day for the Administrative Sergeant will consist of eight (8) consecutive hours including time for lunch. The normal assigned work week shall be five (5) consecutive days, followed by two (2) days of rest, not to exceed forty (40) hours except as provided below, provided that the Administrative Sergeant may work the “4/10” work schedule as described in Section 4.2 above.
4.3 The parties may, upon mutual consent, meet and discuss alternative work shifts.
4.4 There shall be three patrol schedules in a calendar year in blocks of four months each: • Schedule “1” is from January through April; • Schedule “2” is from May through August; • Schedule “3” is from September through December. Prior to December 1st of each year, all patrol employees will bid first for squad / shift assignment for the succeeding year. These bids will be based on seniority, with the provisions that squad assignment will last for the entire year. Employees will be allowed to work the same shift assignment for three consecutive periods, subject to availability. Employees will then bid for vacation within each squad as defined by the current labor agreement. Probationary employees will not be eligible for bidding, including those persons whose probation ends at any time during the succeeding year. Probationary employees will be scheduled by management and may be assigned and rotated to any shift schedule. The Association recognizes that employee performance is of concern to management. As such, management retains the right to move an employee to a different squad and/or shift when it has reasonable cause Employee having volunteered or agreed to do so such Employee will have another day off scheduled immediately adjacent to the Employee’s remaining day off or be paid two times (2X) their Basic Rate of Pay for training, supervision, and/or employee development. In such cases where another employee is displaced, this move will affect the least senior employee whenever possible. all hours worked on that day.
25.07 (a) The Association also recognizes that with current staffing levels it is necessary to move employees to different shifts to facilitate vacation coverage, training, and other time off. Under the 5/4 work schedule this movement will be confined within the same squad as the person taking the time off, and such moves Employer shall be made so as endeavor to minimize the change in shift starting times. Both parties acknowledge that a balance application of experience on day/evening/night Shift rotations within the respective squads can be critical to the Police Department’s overall efficiency. It is agreed that management, after reviewing the bids, has the right to make adjustments to the squad staffing, by reverse seniority, to achieve experiential balance. The above applies except in the following cases, for which management retains full authority and rights for assignment: • Special assignments (which currently includes, but is not limited to, detectives, SRO, crime prevention); • Hardships to any officer; • During times of emergency (as defined in section 30.6 of the current labor agreement). If, at any time during the year, an employee is moved from a non-patrol assignment, then that person shall be assigned to the squad/shift vacated by the employee’s replacement for the remainder of that year. If it is necessary for management to adjust the shift staffing levels or fill long term vacancies, other than those created by regular time off or reassignment of an employee, management shall fill those vacancies as follows: • Management shall ask for volunteers to fill the vacancies and award same based on seniority, except as noted above with regard to time limits for working the same shift and the status of probationary employees; • If volunteers are not available, management shall make the changes it deems necessary to assure adequate coverage for all shifts. In making such changes, management shall affect the least senior employee(s) whenever possible. Employees may be allowed to voluntarily exchange shift assignments up to one work week during any one scheduling period, as long as overtime is not incurred by the affected employees and subject to the approval of a supervisor. Employees may be allowed to exchange shift assignments for longer periods of time as determined by and subject to approval of the Chief of Police or designeefacility.
4.5 Two (2) rest periods of fifteen (15) minutes each shall be allowed employees when conditions permit.
