Availability. The User does not have a right to ongoing and uninterrupted availability of the FREE NOW mediator-App. FREE NOW does, however, endeavor to ensure the greatest possible availability and to remedy interruptions as quickly as possible. Likewise, FREE NOW of FREE NOW does not guarantee that a taxi or, as it may be, a private hire vehicle or a other mobility service is available to be procured.
Availability. (1) The User cannot demand permanent and uninterrupted availability of the app. FREE NOW and its designated cooperation partners will make every effort to achieve the highest level of availability possible and eliminate outages as soon as possible. Neither will FREE NOW or a designated cooperation partner vouch that a taxi will be available when the User hails a taxi.
(2) In addition, FREE NOW has the right to stop services temporarily even without informing the Users individually. A respective notification will be provided in a timely fashion and in general terms only on FREE NOW’s website.
Availability. 10.1. If a digital service (e.g. cloud telephone system, website, cloud services) is provided, DiCommerce does not guarantee uninterrupted availability. Downtimes and resulting disadvantages will not be reimbursed.
10.2. DiCommerce guarantees an annual average availability of 95%, this is justified by necessary maintenance work, updates, as well as technically not responsible downtimes.
Availability. Vantik makes every effort to provide the Vantik platform and access for the customer at all times. However, availability cannot be guaranteed at all times. In particular it can come to short term disturbances due to technical problems or to unforeseen system failures. In addition, it is necessary to carry out maintenance work at certain intervals in order to keep the system up to date and to ensure the greatest possible availability. In the cases described, Xxxxxx is entitled to temporarily suspend the service offer on the durchzuführen. In dem beschriebenen Fällen ist Vantik berechtigt, das Leistungsangebot auf der Vantik Plattform temporär auszusetzen. Im Falle von Wartungsarbeiten oder vorhersehbaren Systemausfällen wird Vantik den Kunden hierüber rechtzeitig in Kenntnis setzen. Vantik bleibt aber jederzeit erreichbar unter xxxxx@xxxxxx.xxx.
Availability. 6.7.1 The availability of the respective agreed services pursuant to Clauses 6.1.1 and 6.1.2 a) to c) of this Agreement shall be 99.0% on an annual average, seven days a week and 24 hours a day. The announcement of downtimes can especially be made on the platform or the website of oculid. This does not affect oculid's right to take appropriate measures at any time, even without announcement, to prevent concrete threats to the security and integrity of the systems.
Availability. The provider endeavors to provide the website 24 hours a day, 7 days a week. The provider guarantees the user that the portal will be accessible by 98% on an annual average.
4.4.1 Access data
Availability. Vantik does not guarantee that the Vantik platform is available to the customer at all times. Availability. 7.1 The Provider guarantees an average annual availability of 97% of the servers used under this contract. 7.2 The server availability of the provided system is basically 24 hours a day, 7 days a week, 365 days a year. The "available usage" includes the times during which the functionalities of the application are available. It amounts to the provided application: Monday - Friday between 09:00 - 17:00 (Central European Time for Germany). The Provider guarantees a usable availability of at least 97.00 % for the application during the aforementioned time window on an annual average. This does not include times when the server cannot be accessed due to technical or other problems that are beyond the control of the Provider or the selected hosting company (force majeure, fault of third parties, etc.). Access to the services may be restricted by the hosting company if the security of the network operation, the maintenance of network integrity, in particular the avoidance of serious disturbances of the network, the software or stored data require so. 7.3 For times outside of the "available use" the Provider is entitled to service and maintain the software and / or hardware systems, security patches or updates to the operating system, data backup, etc. During the planned periods of non-availability, the user has no right to use the application. Updates und Sicherheitspatches die einen androhenden Systemausfall / Datenlecks schließen, können vom Anbieter jederzeit nach Ankündigung an den Anwender eingespielt werden. Direkt hieraus entstehende Verletzungen der Service-Level Vereinbarung gelten nicht als Mangel im Sinne der Service-Level Vereinbarung. Der Anbieter wird versuchen, diese kritischen Updates mit zumutbaren Mitteln ohne Systemausfall einzuspielen.
