Export 11.1 Alle Lieferungen und Leistungen werden vom Anbieter unter Einhaltung der derzeit gültigen AWG/AWV/EG-Dual-Use-Verordnungen sowie der US- Ausfuhrbestimmungen geliefert und sind zur Benutzung und zum Verbleib in dem mit dem Kunden vereinbarten Lieferland bestimmt. 11.2 Bei grenzüberschreitender Lieferung oder Leistung trägt der Kunde die anfallenden Zölle, Gebühren und sonstigen Abgaben, soweit einzelvertraglich nichts Abweichendes geregelt ist. 11.3 Beabsichtigt der Kunde die (Wieder-)Ausfuhr, ist er verpflichtet, die hierzu erforderlichen Genehmigungen, insbesondere der jeweiligen Außenwirtschaftsbehörde, einzuholen, bevor er die Produkte exportiert. Er wird sich eigenständig über die jeweils gültigen Bestimmungen und Verordnungen informieren und die (Wieder-)Ausfuhr eigenverantwortlich abwickeln. Der Anbieter hat insoweit keinerlei Auskunfts-, Beratungs-, oder Mitwirkungspflicht. 11.4 Verletzt der Kunde bei der (Wieder-)Aus- bzw. Einfuhr in ein anderes Land die für eine solche geltenden gesetzlichen Bestimmungen und wird der Anbieter deshalb von dem Ausfuhr- oder Einfuhrland oder einem Transitstaat aufgrund der dortigen gesetzlichen Bestimmungen in Anspruch genommen, verpflichtet sich der Kunde, den Anbieter von allen insoweit entstehenden finanziellen Verpflichtungen freizustellen und ist dem Anbieter darüber hinaus für den aus der bestimmungswidrig erfolgten (Wieder-)Aus– bzw. Einfuhr entstandenen Schaden ersatzpflichtig.

Software Ist Gegenstand des Vertrages die Überlassung von Software, gilt folgendes: 11.1 Sofern nicht individuell etwas anderes vereinbart ist, erhält der Kunde an den erworbenen Programmen ein einfaches Recht, die Software für eigene Zwecke zu nutzen. Der Kunde ist zur Weitergabe der vertragsgegenständlichen Software nur mit unserer vorherigen schriftlichen Zustimmung berechtigt. Der Kunde ist nicht berechtigt, die Software für andere einzusetzen oder Dritten zur Datenverarbeitung zur Verfügung zu stellen, auch nicht durch Nutzung auf eigenen Rechnern des Kunden. 11.2 Der Kunde ist nicht berechtigt, Unterlizenzen zu erteilen. 11.3 Der Kunde ist nicht berechtigt, die Software zu kopieren, Vervielfältigungsstücke zu verbreiten, die Software zu bearbeiten oder öffentlich zugänglich zu machen. Als Ausnahme zum Kopierverbot ist der Kunde berechtigt, eine Sicherungskopie zu fertigen. 11.4 Der Kunde führt schriftliche Aufzeichnungen über die von ihm erworbenen Lizenzen sowie deren Einsatz. Jede Änderung des Aufstellungsortes der Programme ist schriftlich festzuhalten. 11.5 Alle über vorstehende Rechtseinräumung hinausgehenden Rechte, seien es Urheberrechte, gewerbliche Schutze oder andere Rechte, stehen ausschließlich uns zu. 11.6 Enthält der dem Kunden überlassene Datenträger aus technischen Gründen Software, die von der dem Kunden gewährten Softwarelizenz nicht umfasst ist, darf diese Software nur aufgrund einer gesonderten Lizenz genutzt werden, die vom Kunden zu beschaffen ist. Die Software kann technische Mittel zur Verhinderung der Nutzung nicht lizenzierter Software aufweisen. 11.7 Der Kunde wird auf allen vollständigen und auf teilweisen Kopien der Software unsere Urheberrechtsvermerke und alle sonstigen Hinweise für gewerbliche Schutzrechte auf uns in der Weise anbringen bzw. belassen, wie sie in der Originalversion der Software festgelegt sind. 11.8 Der Kunde hat keinen Anspruch auf Überlassung des Quellcodes. 11.9 Wir liefern die vertragsgegenständlichen Programme durch Übergabe des Programmdatenträgers. Wünscht der Kunde die Installation durch uns, ist dies eine Zusatzleistung, die durch Zusatzauftrag als Dienstleistung in Auftrag gegeben werden kann. Das gilt auch für die Einweisung in das Programm. Eine solche wird durch uns gegen gesonderten Auftrag und gesonderte Vergütung nach Aufwand entsprechend dem jeweils gültigen Stundensatz gemäß unseren jeweils gültigen Preislisten zuzüglich Reisekosten und Spesen erbracht. 11.10 ist Gegenstand unserer Leistung die Lieferung von fremder Software, ist der Kunde verpflichtet, sich über die Lizenzbestimmungen des Herstellers zu informieren und diese zu beachten. 11.11 Dokumentationen, insbesondere von Fremdanbietern, werden in der Weise ausgeliefert, wie sie vom Hersteller zur Verfügung gestellt werden. Das kann auch eine Auslieferung in einer Fremdsprache bedeuten. Wir sind nicht verpflichtet, Dokumentationen über Programme von Fremdherstellern in die deutsche Sprache zu übersetzen.
Service Level Agreement Das folgende Verfügbarkeits-Service-Level-Agreement („SLA“) wird von IBM, so wie im Berechtigungsnachweis angegeben, für den Cloud-Service bereitgestellt. Das SLA stellt keine Gewährleistung dar. Es wird nur Kunden zur Verfügung gestellt und gilt ausschließlich für Produktionsumgebungen.
Liability of the Hotel 7.1 The hotel is liable for harm inflicted on life, limb and physical health. Further it is liable for other damage caused with full intent or gross negligence or due to inten- tional or grossly negligent violation of obligations typical for the contract. A breach of obligation of the hotel is deemed to be the equivalent to a breach of a statutory rep- resentative or vicarious agent. All other claims for damages are excluded, if not de- termined differently in this No. 7. Should disruptions or defects in the performance of the hotel occur, the hotel shall act to remedy such upon knowledge thereof or upon objection by the customer made without undue delay. The customer shall be obliged to undertake actions reasonable for him to eliminate the disruption and to keep any possible damage to a minimum. 7.2 The hotel is liable to the customer for property brought into the hotel in accordance with the statutory provisions. It recommends the use of the hotel or room safe. If the guest wishes to bring with him money, securities, stocks, bonds or valuables with a value of more than 800 EUR or other things with a value of more than 3500 EUR, a separate safekeeping agreement is necessary. 7.3 Insofar as a parking space is provided to the customer in the hotel garage or a hotel parking lot, this does not constitute a safekeeping agreement, even if a fee is ex- changed. The hotel only assumes liability for loss of or damage to motor vehicles parked or manoeuvred on the hotel’s property and the contents thereof only pursu- ant to the preceding No. 7.1, sentences 1 to 4. 7.4 Wake-up calls are carried out by the hotel with the greatest possible diligence. Messages, mail, and merchandise deliveries for guests shall be handled with care. The hotel will deliver, hold, and, for a fee, forward such items (on request). The ho- tel only assumes liability according to the preceding No. 7, sentences 1 to 4. 8.1 Amendments and supplements to the contract, the acceptance of offers or these general terms and conditions should be made in written form. Definitions 2.1. Account – the personal user account created on the Website for each Customer who has concluded a Master Loan Agreement with Ferratum. 2.2. Calculator – a tool made available on the Website to enable the Customer to calculate the Loan Interest in relation to the desired Loan amount and repayment period. 2.3. Common Message Services – include SMS, E-Mail or similar commonly used electronic message services. 2.4. Creditor – see below 2.8 2.5. Customer – an Eligible Customer, who entered into a Master Loan Agreement with the Creditor, or has declared such intent. 2.6. Due Amounts – in the event of a withdrawal from or termination of the Master Loan Agreement, this means the accumulated Loan amounts under the Master Loan Agreement with the Customer together with the accrued Loan Interest on these accumulated Loan amounts. For the purpose of calculating the pro-rata Loan Interest due, Ferratum shall take into account the daily interest rate stipulated in Appendix 1, attached to these Standard Terms and forming an integral part hereof. 2.7. Eligible Customer – any natural person having reached or exceeded the age of 18 years with permanent residence in the Federal Republic of Germany. 2.8. Ferratum – the credit institution indicated in clause 1 above, also referred to as the Creditor. 2.9. Info Sheet – the Standard European Consumer Credit Information Sheet regarding the Loans, which forms an integral part of the Master Loan Agreement. 2.10. Invoice – the document which contains the Loan amount, the date of application for the Loan, amount due in respect of each instalment and the instalment repayment dates, and any other fees and charges payable in terms of the Master Loan Agreement and which is considered, until the repayment of all amounts due thereunder, to form an integral part of the Loan Agreement. 2.11. Loan – each individual loan of Ferratum to a Customer received or applied for under the Master Loan Agreement which has been issued by Ferratum upon an application by the Customer for an amount which is not lower than fifty Euro (€50) and not higher than one thousand five hundred Euro (€1500) and which has a repayment period of no longer than sixty two (62) days. 2.12. Loan Application – the Customer's offer to enter into a Loan under a valid Master Loan Agreement with Ferratum, such offer following the form and procedure set forth by Ferratum. 2.13. Loan Interest – the interest payable by the Customer in respect of the Loan calculated as specified in Appendix 1. 2.14. Master Loan Agreement – a framework agreement between a Customer and Ferratum for an indefinite period which includes these Standard Terms, the 2.15. Politically Exposed Person - a natural person who is or has been entrusted with a prominent public function, and includes such individual’s immediate family members or persons known to be close associates of such persons. This does not include middle ranking or more junior officials, as well as persons who have ceased to be entrusted with a prominent public function for a period of at least twelve months. 2.16.
