Social Responsibility. Acknowledgement and observance of human rights: We expect our suppliers to acknowledge and observe human rights. This especially includes the acknowledgement of the Universal Declaration of Human Rights (UDHR) of the General Assembly of the United Nations and of the European Convention on Human Rights (ECHR). • No discrimination: We expect our suppliers not to discriminate their employees and other persons due to their gender, age, origin and skin color, language, home and social origin, natio- nality, beliefs, religion or world view, conviction or sexual orien- tation, or disability. • Compliance with ILO core labor standards: We expect our suppliers to ensure fair labor conditions according to the defined ILO core labor standards both in their own operations and in their supply chains. These globally endorsed social standards to improve the working and living conditions cover areas such as the prohibition or abolition of forced and com- pulsory labor, the protection of the freedom of association, the right to collective bargaining, equal pay, the prohibition of discrimination on the job, the minimum age for admission to employment, and the elimination of the worst forms of child labor. The full list of agreements including their official names can be viewed e.g. under xxxx://xxx.xxx.xxx/xxxxxx/xxxxxxx-xxx- standards/kernarbeitsnormen/lang--de/index.htm (in German). • Ensuring occupational health and safety: We expect the supplier to respect his employees’ rights with regard to occupa- tional safety and provide them with a healthy work environment. • Compliance: The supplier (entrepreneur) confirms that he has given his personnel suitable instructions in order to prevent and avoid conduct that violates the intentions and motives of national and international conventions against corruption, such as Sections 298 et seq. of the German Criminal Code (StGB) (Offenses against Competition), Sections 331 et seq. of the German Criminal Code (StGB) (Offenses Committed in Public Office), or Section 130 of the German Act on Regu- latory Offenses (OWiG) (Violation of Obligatory Supervision in Operations and Enterprises).
Social Responsibility. (1) For Encory it is of paramount importance that corporate activities take account of the social responsibility to employees and to society as a whole. This applies both to Encory itself and to its suppliers. Encory and the Contractor acknowledge their compliance with the adopted principles and rights set by the International La-bour Organization (ILO) in its “Declaration on fundamental principles and rights at work” (Geneva 06/98), the Directives of the UN Initiative Global Compact (Davos, 01/99) and the UN Guiding Principles on Business and Human Rights (2011). The following principles are of particular importance: - Preservation of human rights, - Elimination of forced, compulsory, and child labor, - Positive and negative freedom of association, - Elimination of discrimination on the basis of gender, race, origin, religion or belief, membership of a trade union or the like, handicap, age, sexual identity, nationality, marital status, political affiliation, veteran status, or other characteristics protected by local laws, - Compliance with occupational safety and health requirements, - Sicherung der Beschäftigungsfähigkeit durch Aus- und Weiterbildung, - Einhaltung von sozialadäquaten Arbeitsbedingungen, - Herstellung von Bedingungen, die es den Mitarbeitern erlauben, einen angemessenen Lebensstandard zu genießen, - Entlohnung, die die Sicherung der Existenz einschließlich sozialer und kultureller Teilhabe ermöglicht, - Verwirklichung von Chancengleichheit und familienfreundlichen Rahmenbedingungen, - Schutz indigener Rechte, - Verbot von Bestechung und Erpressung, - Wahrung von Tierwohl und Tierschutz, insbesondere Beachtung des 3R Prinzips (Replacement, Reduction, Refinement) bei Tierversuchen. - Einhaltung der geltenden Gesetze und Vorschriften. Im Hinblick darauf wird der Auftragnehmer angemessene Maßnahmen ergreifen, um Bestechungsdelikte in seinem Unternehmen zu vermeiden.
(2) Der Auftragnehmer verpflichtet sich, sofern die Leistungserbringung wesentliche Auswirkungen auf die Gesundheit und Sicherheit seiner Mitarbeiter haben kann bzw. haben wird, bis spätestens zwei Jahre nach Auslösung der Encory Bestellung ein zertifiziertes Arbeitsschutzmanagementsystem gemäß OHSAS 18001 oder ISO 45001 oder ein davon abgeleitetes, anerkanntes und zertifiziertes Arbeitsschutzmanagementsystem einzuführen, zu betreiben und Encory durch Vorlage eines entsprechenden Zertifikates nachzuweisen.

Social Responsibility. For S-TEC it is of utmost importance that the business activities of our company reflect social responsibility towards our own staff and towards society in general. This applies to both S-TEC itself and its suppliers. Our aim is to uphold and comply with the guidelines of the UN Initiative Global Compact (Davos, 01/99) as well as the principles and rights as set out in the “Declaration on fundamental principles and rights at work“ (Geneva, 06/98) of the ILO. Allgemeine Bestimmungen 25 General Provisions Stellt der LIEFERANT seine Zahlungen ein oder wird das Insolvenzverfahren über sein Vermögen oder ein sonstiges gerichtliches oder außergerichtliches Vergleichsverfahren beantragt, so ist S-TEC berechtigt, für den nicht erfüllten Teil vom Vertrag zurückzutreten.
