Additional Capital Costs definition

Additional Capital Costs means, in terms of any Drawdown by the Borrower under the Tranche B-2 Facility Amount, the higher of the following two items: (a) the TAIFX3 rate minus the LIBOR minus 0.30% of the annual interest rate, or (b) zero.
Additional Capital Costs means the interest amount calculated by applying a rate of interest equal to 10% per annum to Buyer’s portion of the Adjusted Gain Amount attributable to any Payment by Assignee to Seller from the date of such receipt by Seller up to and including the date of payment to Buyer of such portion of the Adjusted Gain Amount (together with the related Additional Capital Costs) pursuant to Article 10.1(b)(v)(G). The interest amount shall be calculated on a daily basis based on a 360-day year. For the avoidance of doubt, assuming 450 days elapse from the date Seller received a payment from Assignee until the date Buyer’s portion of the Adjusted Gain Amount attributed to such Payment is paid to Buyer, Buyer’s Additional Capital Costs would be calculated by multiplying the amount of the payment by a fraction, the numerator of which would be 450 and the denominator of which would be 360 and the product of which would be multiplied by 10%.
Additional Capital Costs means the capital cost of any expansion or expansions to the Systems as described in section 61 of this Agreement. For clarity, Additional Capital Costs does not include capital repairs, replacements and rehabilitation work to the Systems.
