Adventure Activities definition

Adventure Activities shall include all activities, events or services provided, arranged or organized by the Releasees including, but not limited to: orientation and instruction sessions; surface and air transportation, including all helicopter travel; loading, unloading and travel in or movement around helicopters and watercraft; backcountry travel; multi-day trips and camping; mountaineering; climbing; backpacking; overnight stays in the outdoors; picnicking; fishing; hiking; swimming; use of watercrafts; use of safety equipment including personal floatation devices; accommodation, food, beverage and water supply; and all other activities, events and services in any way connected with or related to these activities.
Adventure Activities shall include all activities, events services provided, arranged, organized, conducted, sponsored or authorized by the Releasees and shall include, but are not limited to: use of rope climbing, zip lines, suspended bridges, ladders, rope swings, cable swings and nets; all travel either within or beyond the designed boundaries, including on all trails; orientation and instructional courses and sessions; and other such activities, events and services in any way connected with or related to Adventure Activities.
Adventure Activities shall include but are not limited to use of skies, snowboards, skiing, climbing, hiking, sightseeing, orientation and instructional courses, seminars and sessions: and other such activities, events and services in any way connected with or related to those activities. I acknowledge that I should seek medical advice if I know or suspect that my physical condition may be incompatible with Adventure Activities. Adventure Activities shall include but is not limited to: all activities, services and use of facilities and equipment either provided, arranged or organized by the Operator including orientation and instructional sessions or classes, guiding, supervision, transportation, accommodation, food, beverage including water supply, use of equipment, and multi-day camping or overnight stays in the outdoors. In this Release Agreement, the term “Negligence” includes the failure by the Releasees to use such care as a reasonably prudent and careful guide, instructor or operator would use under similar circumstances, or breach of any other duty of care imposed by law. Participation in Adventure Activities involves various risks, dangers and hazards including the risk of serious injury, paralysis or death. Adventure Activities often take place in remote wilderness locations, where assistance, medical and first aid services and evacuation may not be readily available and communication may be difficult or not possible. The risks, dangers and hazards that may be encountered include, but are not limited to: slips, trips and falls; impact or collision with objects; encounters with domestic or wild animals including bears and cougars; infectious disease contracted through viruses, bacteria, parasites, and fungi which may be transmitted through direct or indirect contact; negligence of other persons; and NEGLIGENCE ON THE PART OF THE RELEASEES. Adventure Activities shall include all activities, events or services provided, arranged, organized, conducted, sponsored or authorized by THE RELEASEES and shall include, but are not limited to use of ziplines, suspension bridges, structure and equipment or the activities of climbing, rappelling, hiking, sightseeing, snow shoeing, travel to and from the tour areas, including by ski lifts and gondola, back country travel, orientation and instructional courses, seminars and sessions; and other such activities, events and services in any way connected with or related to those activities, whether taking place before, during or following my participation in the Adventure Activities. I acknowledge that I am required to wear an approved helmet and other specified safety equipment, wear adequate sport clothes and keep my hair tightly attached while participating in the Adventure Activities. I am aware that there are guides or instructors available to answer any questions that I may have as to the proper use of the equipment and regarding known risks inherent in the Adventure Activities. I am aware that the Adventure Activities require a good mental, psychological and physical shape and I declare being physically able to participate in these activities. I am also aware that the physical exertion required of Adventure Activities and the forces exerted on the body can activate or aggravate pre-existing physical injuries, conditions, or congenital defects. I acknowledge that I should seek medical advice if I know or suspect that my physical condition may be incompatible with Adventure Activities. I further acknowledge that falling objects pose a serious risk to others and that I will be held responsible for any and all damage or injury caused to property or persons as a result of my dropping, throwing or otherwise releasing any items whatsoever while participating in the Adventure Activities.
