Breach by Resident. Upon any breach by Resident of this Housing Agreement or a prior agreement between Resident and Owner or its affiliates, including community policies, Owner may without separate demand or notice except as provided by law, and in addition to other lawful remedies, do any one or more of the following: (i) collect any charge under this Housing Agreement or community policies, including reimbursement for costs of collection; (ii) terminate this Housing Agreement and/or Resident’s right to occupy the premises, and/or institute an action for eviction; (iii) sue to collect all past due charges and/or unpaid rent and other charges which become due through the End Date or until the bedroom space and all other bedroom spaces at the Property have been filled, with recovery by Owner of any discrepancy in rent rate and any expense incurred in obtaining the new resident contract; (iv) report any information to credit reporting agencies. Without limitation, Owner may terminate this Agreement for non-payment of rent or other charges, or upon any conduct by Resident that is prohibited by or in breach of this Agreement, or if, in the reasonable judgment of Owner, continued residency will or may be detrimental to the educational process or the health, safety and/or welfare of the other residents of the Property or any of the Property’s personnel. Upon any termination as described in this paragraph, Resident: (a) must fully vacate the bedroom space and apartment (including removing all personal belongings) within the time provided in the written notice given by Owner, and will have no further use of or access to the Property, the assigned apartment or bedroom space; and

Owner’s acceptance of rent or other payment following notice to vacate or during the pendency of a legal action will not waive or diminish Owner’s rights under this Housing Agreement or statutory law unless separately and expressly agreed by Owner.

Breach by Resident. Each obligation of the Lease Agreement is material and violation of any obligation or misrepresentation of any information is a breach of the Lease Agreement. Owner may, at its option, enforce the performance of this Lease Agreement and/or may give notice to Resident of its election to terminate the Lease Agreement. If Resident does not pay Rent when due, then Owner may give Resident written notice demanding payment. If Rent is not paid within the time period specified in the notice (but not less than three [3] days after receipt of the notice), then Owner may take any or all actions regarding collections as stated in the Community Handbook. Owner may employ an attorney or collection agency to obtain the overdue Rent, or Owner may terminate this Lease Agreement. If Owner employs an attorney or collection agency, Resident must pay the fees and costs of that attorney or collection agency. If Resident fails to comply with any of the non-monetary terms of the Lease Agreement, including damaging the Premises or violating any of the rules and regulations contained in the Community Handbook, or other restrictions, Owner will give Resident written notice (“Notice of Violation/Breach”) of the violation/breach and that the Lease Agreement will terminate upon a date not less than fourteen (14) days from the receipt of written notice, if the breach is not remedied within that time period. If Resident fails to comply with South Carolina law materially affecting health and safety (Section 27-40- 510 of South Carolina Code), and that non-compliance can be remedied by cleaning or by the repair and/or replacement of a damaged item, and Resident fails (i) to comply as promptly as conditions require in case of emergency or (ii) within fourteen (14) days after written notice by Owner specifying the breach and requesting that Resident remedy it within that period of time, then Owner may enter the Premises and cause the work to be done and Resident shall reimburse Owner for its cost. In addition, Owner shall have all the remedies available to it under the law. Breach by Resident. Violation of the terms within this Lease would be considered a breach of the Lease and may be cause for eviction. Owner may, at its option, enforce the performance of this Lease and/or give notice to Resident of its election to terminate this Lease. If Resident does not pay Rent by the due date, Owner may serve, mail and/or post a 3-Day Notice to Pay Rent or Vacate in accordance with RCW 59.12 et.seq. and/or RCW 59.18 et seq. If the Rent is not paid within the time specified in the 3-Day Notice, Owner may evict the Resident, terminate this Lease and/or pursue all of its rights and remedies under the Lease and Washington law. If Owner employs an attorney or collection agency as a result of a breach or default by Resident under the Lease, Resident assumes all reasonable attorney and collection costs, regardless of whether a lawsuit is filed.
Breach by Resident. If Resident breaches this Lease, Owner will be allowed, at Owner’s discretion, but not by way of limitation, to exercise any or all remedies provided under law.
