Should the Parties be unable to reach an agreement, the Settlement Administrator will evaluate the evidence submitted by the Class Member and make a decision as to whether a person is a Class Member and/or the number of Compensable Workweeks that should be applied and the Individual Settlement Payment to which the Class Member is entitled.
If a Class Member was included in the Class Information and disagrees with the number of Compensable Workweeks stated on the Class Notice, the Class Member must send a letter (by mail or facsimile) or email to the Settlement Administrator by the Response Deadline stating the reasons why they dispute the number of Compensable Workweeks and provide any supporting documentation.
If there is a dispute, the Parties will attempt to agree upon the amount of Compensable Workweeks once a dispute is raised, but if an agreement cannot be reached, the Settlement Administrator will be directed to decide.
The Claims Administrator will divide $113,178 by the total number of Compensable Workweeks worked by all Class Members who, at any time during the Class Period, worked overtime during a pay period for which they also received a bonus or other nondiscretionary pay.
