Day Work Week. In the event a school implements a modified calendar consisting of a four-day full class schedule with an optional fifth day for students and where the modified four-day calendar results in a substantial decrease in food service operations, a special food service staffing shall be developed for the fifth day. Employees whose services are not needed at the site on the optional fifth day or whose work hours are reduced due to reduced food service operations will be given the option to work a day at another school if work is available, use personal reasons leave, or take a day off without pay provided, however, that no more than six (6) schools implement such a modified four-day calendar. In the event that more than six (6) schools implement such a modified four-day calendar, the parties agree to enter into impact bargaining on this issue.

Day Work Week. The work period for unit employees, for the purposes of the Fair Labor Standards Act (FLSA), shall be a fixed and regularly recurring period of time consisting of one-hundred and sixty-eight (168) consecutive hours consisting of seven (7) consecutive twenty-four (24) hour periods.

18.04 Overtime will be paid at time and one half (1.5) the hourly rate in accordance with the appropriate legislation. The Company will provide as much advance notice of the need for overtime as possible.

Holiday pay is the difference between hours worked and forty (40) hours. If the employee is on a schedule of five (5) days of eight (8) hours each, the employee would have thirty-two (32) work hours and eight (8) hours of holiday pay (40 hours total). If the employee does not get the specified day off and works five (5) full days in the week, then the employee receives eight (8) hours of holiday time in addition to the full five (5) days of worked time (total of 48 hours), plus premium pay for the eight (8) hours over forty, since holiday hours count towards the computation of overtime. Employee works three (3) full days and gets the day off to observe the holiday. The employee receives forty (40) hours of pay. Holiday time is the difference between hours worked and forty (40) hours. If the employee is on a schedule of four (4) days of ten (10) hours each, the employee would have thirty (30) work hours and ten (10) hours of holiday pay (40 hours total). If the employee is on a schedule of two (2) days of eight (8) hours and two (2) days of twelve (12) hours, then the employee’s holiday time would be either eight (8) or twelve (12) hours, depending upon which three (3) days were worked and on which day the holiday fell.
