The Design Professional shall prepare any responses to reasonable requests from the Contractor for additional information about the Contact Documents.
Shop drawings are the Contractor’s manufacturer, Subcontractor, supplier, vendor or the Contractor’s detailed drawings showing particularized method for assembly, specifics to a manufacturer, manufacturer component installation requirements, specifics as to a manufactured item, alterations to a manufactured, a custom created item, or drawn version of more detailed information expanding on the Architect’s design shown in the Contact Documents.
Contractor shall leave the site of the Work clean, and restore to original condition all property not designated for alteration by the Contact Documents.
The Owner may at his option accept Work which is not in accordance with the requirements of the Contact Documents instead of requiring its removal and correction.
Other tests, inspections, and approvals required by the Contact Documents shall also be made at the appropriate times.
If such Work was inspected and found not to be in conformance with the Contact Documents, the Contractor shall pay the cost of uncovering and replacement without a change in Contract Time.
The Contractor shall promptly correct Work rejected by the Architect for failing to conform to the requirements of the Contact Documents, whether observed before or after Substantial Completion and whether or not fabricated, installed, or completed.
If the Architect's inspection discloses any item, whether or not included on the Contractor's list, which is not in accordance with the requirements of the Contact Documents, the Contractor shall, before issuance of the Certificate of Substantial Completion, complete or correct such item upon notification by the Architect.
This Agreement and the terms of the Contact Documents shall be binding upon the parties and may not be waived, modified, amended or altered except by a writing signed by Contractor and Owner.
The Design Builder will review and respond with reasonable promptness but not more than five (5) business days from receipt to properly prepare any reasonable requests from the Design-Builder for additional information about the Contact Documents.
