Continuation of Work. Pending the resolution of any dispute or claim pursuant to this Article 11, the Parties agree that performance of all obligations will be pursued diligently.

Pending the final resolution of any Dispute arising under, related to, or involving this Agreement, Contractor agrees to diligently proceed with the performance any Work under Dispute in accordance with the provisions of this Agreement and the JBE’s instructions. Continuation of Work. Pending the resolution of any dispute or claim pursuant to this Article, the Parties agree that performance of all obligations shall be pursued diligently in accordance with the direction of the PHS signatory.

Pending final resolution of any dispute under this Contract, the Contractor will proceed diligently with the performance of its duties and obligations under the Contract Documents, and the Agency will continue to make payments of undisputed amounts in accordance with the Contract Documents.

Continuation of Work. Any Work that commences prior to and extends beyond the expiration date of the current Contract period shall, unless terminated by mutual written agreement between the County and the Awarded Bidder, will continue until completion at the same prices, terms, and conditions.
Continuation of Work. Design-Builder shall continue to perform the Work and Owner shall continue to satisfy its payment obligations to Design-Builder pending final resolution of any dispute or disagreement.
Continuation of Work. Pending resolution of any Dispute pursuant to §15.01 or §14.02, or pursuant to a binding award or determination of a court or in an arbitral proceeding, the Parties will continue to fulfill their respective obligations under this Agreement; provided that the applicable Party may withhold any amount that is the subject of the Dispute from any payment otherwise due under this Agreement during the pendency of any Dispute resolution proceeding. Upon resolution of the Dispute, any Party found owing an amount will promptly pay to the other Party any amount determined to be due, plus interest on the outstanding amount computed at the Federal Funds Rate plus 150 basis points from the date the amount should have been paid until the amount is paid in full. A Party’s undertaking to continue to fulfill its obligations under this 4845-2993-5922, v. 1 Agreement pursuant to this §15.03 shall not override its right to terminate this Agreement as provided in Article V5 hereto.
