Court’s responsibility for repairs and liability for damage or loss is limited to that made necessary by or resulting from the negligent act or omission of the Court or Court Personnel.
If such licenses and rights cannot be validly assigned to or passed through to Court by Contractor without a Third Party’s consent, then Contractor will use its best efforts to obtain such consent (at Contractor’s expense) and will indemnify and hold harmless the Court and Court Personnel against all Claims arising from Contractor’s failure to obtain such consent.
