Design and Construction Requirements definition

Design and Construction Requirements means all standards, specifications (including the Construction Specifications), procedures, design criteria, design guidelines and other requirements applicable to all design activities included within the Project Work, including the Design, and to all Construction, all as set out in this Agreement as at the Effective Date and as amended, supplemented or replaced from time to time after the Effective Date in accordance with this Agreement.

Design and Construction Requirements means (i) the “Design and Construction Requirements for the New Terminal,” set forth as Part B.1 of the Requirements and Provisions for Work and (ii) the “Design and Construction Requirements for PANYNJ Improvements,” set forth as Part B.2 of the Requirements and Provisions for Work; in each case, as may be amended, revised, supplemented or otherwise modified from time to time.

Design and Construction Requirements means the specifications, drawings, and other technical requirements for the performance of the Design-Build Work set forth in Schedule 3 (General Design-Build Work Requirements) and Schedule 4 (Design and Construction Requirements).

• If Project Co asserts that any aspect of the Design and Construction Requirements is uncertain or ambiguous, either Party may require that the interpretation of that aspect of the Design and Construction Requirements be determined by the Dispute Resolution Procedure if they are not able to resolve the matter through their respective Representatives.

• Notwithstanding any other provision of this Agreement, Project Co’s obligation to conduct the Design and Construction of the Infrastructure in accordance with the Design and Construction Requirements is absolute, and cannot be modified or waived except by amendment of the Design and Construction Requirements made in accordance with Section 6 [Modifications and Change Orders], Schedule 13 [Changes] or as otherwise expressly permitted in accordance with this Agreement.

• Part 4 [Transportation Structures and Building Structures] sets out structural Design and Construction Requirements for all Transportation Structures and Building Structures unless otherwise specified.

• Project Co agrees to install the Infrastructure entirely within the Lands, and acknowledges that it has fully familiarized itself with the Design and Construction Requirements and the Lands and has satisfied itself that no other land outside the Lands is required.

• Project Co shall, at all times during the Term and in all respects, perform the Design and Construction in accordance with Good Industry Practice, the Design and Construction Requirements, and to the standards required by Schedule 5 [D&C Performance Requirements].

More Definitions of Design and Construction Requirements

Design and Construction Requirements means the design and construction requirements set forth in Appendix 2 (Design and Construction Requirements).

Design and Construction Requirements or “D&C Requirements” means the relevant specifications, standards, procedures and other requirements for the design and construction of the Project Facility as set out in Schedule 3 (D&C Requirements);

Design and Construction Requirements means the requirements as to the design of the New Project Facilities as set out in Schedule C.

Design and Construction Requirements means the standards, specifications, procedures, design criteria, design guidelines and other requirements applicable to the Design and the Construction, including the requirements set out in Schedule 2 [Submittal Review Procedure], Schedule 3 [Construction Schedule], Schedule 4 [Design and Construction Protocols], Schedule 5 [D&C Performance Requirements], Schedule 9 [Quality Management], Schedule 10 [Environmental Performance Requirements], Schedule 11 [Construction Safety Requirements], Schedule 12 [Communications and Engagement] and Schedule 28 [Project Approvals and Utility Matters] as amended, supplemented or replaced from time to time after the Effective Date in accordance with the Agreement.

Design and Construction Requirements means the requirements designated as the “Design and Construction Requirements” in Article 4 (Permitting, Design, and Construction) and Appendix 5 (Project Technical Requirements) with which the Company must comply.

Design and Construction Requirements means the design, construction and performance requirements and specifications for the Facility set out in Schedule 5;

Design and Construction Requirements means the relevant specifications, standards, procedures and other requirements for the design and construction of the System and the Public Infrastructure as set out in Schedule 15-2 – Output Specifications – Design and Construction Requirements.
