Employment Claim definition

Employment Claim means a claim made to the Commission in which any of the following is an issue —
Employment Claim means any actual or threatened action, lawsuit, charge, complaint, audit, inquiry, investigation, grievance, arbitration, claim (including ERISA claims), or federal, state, or local judicial or administrative proceeding of whatever kind involving a demand by, on behalf of or relating to an Employee, Former Employee, or current or former independent contractor, or by or relating to any federal, state, or local Government Entity alleging Liability against a Party or against a Party’s pension, welfare or other benefit plan, or such plan’s administrator, trustee or fiduciary.
Employment Claim means any actual, threatened or potential lawsuit, arbitration, ERISA claim, or federal, state, or local judicial or administrative proceeding of whatever kind involving a demand by or on behalf of or relating to an employee, former employee, job applicant, intern or volunteer, independent contractor, leased employee, or anyone claiming to be an employee or joint employee, or by or relating to a collective bargaining agent of employees, or by or relating to any federal, state, or local government agency alleging liability against an entity as an employer or against an employee pension, welfare or other benefit plan, or an administrator, trustee or fiduciary thereof.

Examples of Employment Claim in a sentence

  • Cash payments to Holders of Allowed Employment Claims shall be made at the option of the Debtor as follows: on the first Periodic Distribution Date occurring after the later of (i) the Effective Date and (ii) the date such Employment Claim becomes an Allowed Claim.

More Definitions of Employment Claim

Employment Claim means any claim based upon a violation or alleged violation of the Employment Laws.
Employment Claim means any Claim to the extent it is brought and maintained by or on behalf of any past, present or prospective employee of the Organization for a Wrongful Act in connection with any actual, alleged or constructive wrongful dismissal, discharge or termination of employment; breach of any oral, written or implied employment contract or quasi-employment contract; employment-related misrepresentation; violation of any federal, state or local statute, regulation, ordinance, common law or public policy concerning employment or discrimination in employment; sexual or other illegal workplace harassment (including without limitation offensive, intimidating, coercive or unwelcome conduct, advances, contact or communications); wrongful failure to employ or promote; wrongful discipline; wrongful deprivation of a career opportunity; wrongful demotion or adverse change in the terms, conditions or status of employment; failure to grant tenure; failure to adopt adequate workplace or employment policies and procedures; Retaliation; negligent hiring; negligent evaluation of employees; wrongful reference; employment-related invasion of privacy; employment-related defamation; employment-related wrongful infliction of emotional distress; or other employment-related torts.
Employment Claim means any actual or threatened lawsuit, arbitration, ERISA claim, or federal, state, or local judicial or administrative proceeding of whatever kind involving a demand by or on behalf of or relating to an employee, former employee, job applicant, intern or volunteer, independent contractor, leased employee, or anyone claiming to be an employee or joint employee, or by or relating to a collective bargaining agent of employees, or by or relating to any federal, state, or local government agency alleging liability against an employer or against an employee pension, welfare or other benefit plan, or an administrator, trustee or fiduciary thereof.
Employment Claim has the meaning given in Clause 6.10;
Employment Claim means a Claim alleging breach of any employment contract, employer-employee relations policies, practices, or any employment related law or regulation or discrimination of any kind.
Employment Claim means any Claim alleging an Employment Practices Wrongful Act against an Insured brought by or on behalf of any past or present Insured Person or any applicant for employment with the Organization.
Employment Claim means: (1) a written demand for monetary, non-monetary or injunctive relief (including any request to toll or waive any statute of limitations); (2) a civil, criminal or arbitration proceeding for monetary, non-monetary or injunctive relief commenced by: (a) the service of a complaint or similar pleading; (b) the return of an indictment, information or similar document (in the case of a criminal proceeding); or (c) the filing of a formal notice of charges; or (3) an administrative or regulatory proceeding commenced by the filing of a notice of charges, formal investigative order, service of a complaint or similar document, including any such proceeding brought by or in association with the Equal Employment Opportunity Commission (“EEOC”) or any similar governmental agency, brought by or on behalf of any past, present or prospective Employee against an Insured, or by or on behalf of any past, present or prospective Outside Entity Employee against an Executive in his or her Outside Capacity, for an Employment Practices Wrongful Act; provided, that Employment Claim does not include any labor or grievance arbitration or other proceeding pursuant to a collective bargaining agreement.
