Exclusion Certificate definition

Exclusion Certificate means a writing delivered to the Secretary of Si2 that certifies that a Member will not ▇▇▇▇▇ ▇ ▇▇▇▇ License with respect to specific Necessary Patent Claims and sets forth the information identified in Section II.C of Attachment C. However, a Member cannot submit an Exclusion Certificate covering Necessary Patent Claims to the extent such claims are required by a Contribution made by that Member. Pre-emptive Exclusion Certificates (as defined in Section III.C.2 of Attachment C) constitute Exclusion Certificates. A Member shall have a continuing obligation to update the status of any Necessary Patent Claims within sixty (60) days which such Member has excluded pursuant to an Exclusion Certificate.
Exclusion Certificate means a written communication delivered to the Secretary that; (i) certifies that a Member does not grant the Reciprocal License with respect to specific Necessary Patent Claims for a Draft Specification; and (ii) optionally, includes Specific License Terms if the Member desires to grant a license to the specifically excluded Necessary Patent Claims.

Examples of Exclusion Certificate in a sentence

  • If a Member fails to submit a Working Group Exclusion Certificate (a) prior to the expiration of an applicable Ratification Period, or (b) within sixty (60) days of becoming a Member, the Member shall be deemed to have granted the Reciprocal License for any Ratified Specifications.

  • An Exclusion Certificate effectively excludes a Necessary Patent Claim whether or not the Certificate includes specific license terms under which the Member is willing to license the Necessary Patent Claim.

  • The Working Group Exclusion Certificate shall be effective on the date of the posting of the certificate if accepted by the Board as below.

  • After rescinding a Working Group Exclusion Certificate through attendance, the Member may re-submit a Working Group Exclusion Certificate after the working group has produced any subsequent Ratified Specification.

  • Failure of such former Member to submit a RAND License Certificate, a Reciprocal License Certificate or an Exclusion Certificate prior to such deadline will have the consequences set forth in Section III.C.3.

  • Prior to the end of the relevant Exclusion Period following a Call for Patents, or in the case of new Project Members prior to the deadline specified in Section III.E.3, a Member shall submit a RAND License Certificate, Reciprocal License Certificate or an Exclusion Certificate with respect to the disclosed Necessary Patent Claim.
