Foundation Shipper definition

Foundation Shipper means a Shipper holding one or more FTS Agreements utilized to support the initial certification of the System which were entered into prior to the Commencement Date, hereinafter shall be referred to as “Foundation Shipper” or “Shipper”; provided that, unless otherwise mutually agreed by TIGER and the Foundation Shipper, such Shipper must hold in the aggregate at least 900,000 Dth/d of firm capacity for a minimum term of fifteen (15) years under such FTS Agreements as of the Commencement Date.
Foundation Shipper means the Foundation Shipper in relation to the Pipeline or its direct or indirect assignee or novatee under the Gas Transportation Agreement between the Foundation Shipper and the Service Provider in existence prior to the date of this agreement.

  • Should Transporter elect in the future to expand the Project or a lateral directly connected to the Project on a forward haul basis, an Anchor Shipper or a Foundation Shipper shall have a right to participate in that project (“OVC Expansion Project”).

Foundation Shipper means a Shipper holding one or more Service Agreement(s) and/or Confirmation(s) for transportation of intrastate gas that were utilized to support the initial construction of a pipeline described therein (the “New Pipeline”) and which were entered into prior to the initial in-service date of the New Pipeline (the “FS Intrastate Confirmation(s)”). Such Shipper must hold in the aggregate a certain percentage of the Firm capacity of the New Pipeline for a minimum term as specified under such FS Intrastate Confirmation(s) as of the in-service date of the New Pipeline.
Foundation Shipper means a shipper that meets the requirements to be a Foundation Shipper set forth in Adelphia’s Open Season Notice as specified in Section 4(a)(ii).
