New Data definition

New Data means (a) a modified version of User Data or Customer Data or (b) new data created with reference to User Data or Customer Data, in each case whether through aggregation, cleansing, scrubbing, reverse engineering, extraction or other means, such that (i) with respect to modified User Data or new data created with reference thereto, the applicable User has been de-identified in accordance with 45 CFR section 164.514, as applicable and (ii) with respect to modified Customer Data or new data created with reference thereto, Customer has been de-identified in accordance with 45 CFR section 164.514, as applicable.
New Data has the meaning set forth in Section 9.3.
New Data means, in respect of Licensed Product, all data, information, or results generated in the performance of any preclinical studies (including pharmacological and toxicological studies), clinical studies, or chemistry, manufacturing, control and analytical studies in respect of Licensed Product conducted by or on behalf of Licensee or its Affiliates in the course of carrying out the development and commercialization of Licensed Product in accordance with this Agreement.

New Data means the results of analyzing District Data as permitted under this Agreement, including any data generated by or for Primus as part of the Joint Development Program.
