Qualified Occupant definition

Qualified Occupant means a person aged 18 or older, along with his or her Dependents, if any, who at all times during ownership or occupancy of the Unit, resides and is employed within the County year round, an average of at least 30 hours per week on an annual basis. “Employed within the County,” also referred to as “Local Employment”, shall mean that the person earns his or her living from a business or organization operating in and serving the County, which requires his or her physical presence within the boundaries of Summit County in order to complete the task or furnish the service, by working in the County at such business or organization an average of at least 30 hours per week on an annual basis.
Qualified Occupant means a person 18 years of age or older who, during the entire period of his or her occupancy of the Property, earns his or her living by working in Summit County, Colorado at least 30 hours per week for a business located in and serving Summit County, together with such person’s spouse and minor children, if any.
Qualified Occupant means a person who meets the eligibility criteria for tenancy as set out in Schedule “B”;

Examples of Qualified Occupant in a sentence

  • The date on which the Administrator notifies the Subject Property Owner and/or Occupant(s) that he or she must verify compliance with the terms of this Covenant and receive approval as a Qualified Owner or Qualified Occupant.

  • The Administrator may, at any time, require any Occupant to verify that he or she is a Qualified Occupant and/or is otherwise fully compliant with this Covenant.

  • The Administrator may, at any time: (1) require the Subject Property Owner to verify that he or she is a Qualified Owner, (2) require the Subject Property Owner to verify that any Occupant is a Qualified Occupant, (3) require the Subject Property Owner to verify that he or she has not defaulted in any Secured Obligation related to the Subject Property, and/or (4) require the Subject Property Owner to verify that he or she is otherwise fully compliant with this Covenant.

  • A person who receives approval as a Qualified Tenant must meet the requirements for approval as a Qualified Occupant for as long as they occupy the Subject Property.

  • Any: (1) Ownership Applicant, Rental Applicant, Subject Property Owner or Occupant who does not meet one or more of the requirements for approval as a Qualified Purchaser, Qualified Tenant, Qualified Owner, or Qualified Occupant, respectively, may apply to the Administrator for an exception to any such requirement.

Qualified Occupant means an individual who: works an average of 30 hours or more per week at a business in Eagle County, Colorado that holds a valid and current business license, or pays sales taxes, or is otherwise generally recognized as a legitimate business; and earns at least 75% of their income from such business. For example, if an individual worked 60 hours per week for one half of the year at such a business in Eagle County, Colorado, and worked elsewhere for the other half of the year, such person would be a Qualified Occupant. A Qualified Occupant also includes an individual who: was a Qualified Occupant when the individual purchased the Property, but then retired while owning the Property; was 60 years of age or older at the time of retirement; for the 5 years immediately prior to retirement, worked an average of 30 hours or more per week at a business in Eagle County, Colorado that held a valid and current business license, or paid sales taxes, or was otherwise generally recognized as a legitimate business; earned at least 75% of their income from such business during such 5-year period; and does not work for a business outside of Eagle County, Colorado.
Qualified Occupant means a natural person eighteen (18) years of age or older,
Qualified Occupant means: 4.10.1 A natural person eighteen (18) years of age or older, together with such person’s Dependent (or Dependents if more than one), if any, who (i) at all times during ownership or occupancy of the Restricted Unit, earns his or her living from a business operating in and serving Summit County, by working at such business an average of at least thirty (30) hours per week on an annual basis, or (ii) is a person who is approved, in writing, by SCHA or the Town which approval shall be based upon criteria including, place of voter registration, place of automobile registration, and driver’s license address and other qualifications established by SCHA or the Town from time to time. 4.10.2 For individuals claiming self-employment, their business must be based and registered in Summit County, encompass at least 30 hours of work per week on an annual basis, and provide a significant and primary percentage of their service or product locally in or to Summit County and its residents. If a person is a work from home employee for a business, the person must work at least 30 hours per week on an annual basis and spend a significant percentage of his/her time providing goods and/or services locally in or to Summit County and its residents, whether or not for profit. 4.10.3 Compliance with each of these criteria is not necessary; in certifying Qualified Occupants, SCHA or the Town shall consider the criteria cumulatively as they relate to the intent and purpose of this Restrictive Covenant. A person over 65 years of age shall remain a Qualified Occupant regardless of his or her working status, so long as he or she has occupied the Restricted Unit for not less than four (4) years. The term “business” as used herein shall mean an enterprise or organization having a valid business license issued by the appropriate Summit County governmental entity and providing goods and/or services, whether for profit, and shall include, but not be limited to, educational, religious, governmental and other similar institutions. A Qualified Occupant who becomes disabled after commencing ownership or occupancy of a Restricted Unit so that he or she cannot work the required number of hours each week required by this Restrictive Covenant shall remain a Qualified Occupant; provided that such person is permitted to occupy the Restricted Unit only for a maximum period of one (1) year following the commencement of said person’s disability, unless a longer period of occupancy is authorized i...
