Relevant offences or relevant enforcement action are those listed under the Scrap Metal Dealers Act 2013 (Prescribed Relevant Offences and Relevant Enforcement Action) Regulations 2013.

If the Contractor or any sub-contractor engaged by the Contractor is convicted of any of the Relevant Offences (regardless of whether the conviction arises from this Contract), such conviction(s) will be taken into account in the assessment of the Contractor/sub-contractor’s offer (as the case may be) in future tender or quotation exercises.
The relevant offences are listed in Ofsted: Disqualifications (February 2013) and in DBS: Relevant Offences (September 2014).
Offences designated as “relevant offences”, which lead to automatic consideration for listing, are specified in schedule 1 to the 2007 Act and schedule 1 is modified by the Protection of Vulnerable Groups (Scotland) Act 2007 (Relevant Offences) (Modification Order) 2010.
The Licensing Authority will take a particularly cautious view of any Relevant Offences in accordance with its guidelines at APPENDIX K.
However, the revised Debarment Period will become invalid as soon as the Tenderer is convicted of any of the Relevant Offences subsequent to the Central Tender Board’s determination, and in such a case, the Tenderer is debarred from tendering for this Contract for a period of 5 years from the date of that subsequent conviction.
APPENDIX A – RELEVANT OFFENCES The Scrap Metal Dealers Act 2013 (Prescribed Relevant Offences and Relevant Enforcement Action) Regulations 2013.
For the purpose of debarment, a conviction of any of the Relevant Offences will count irrespective of whether it is obtained under a government or private contract and irrespective of the type of services offered under that contract.
