Manpower Requirements. 5.1. For the purpose of providing the services, the service provider's work team will, at all times, include excellent and experienced service provider professionals of the type required by the Tender documents, including the Agreement, in the composition and number as required to perform the service provider's obligations under the Agreement as best as possible.
5.2. Without derogating from the stated, the services will be supplied to the Company by the Service Provider by means of staff personnel on his behalf that will be introduced by him as part of his Tender Proposal, and by the subcontractor approved by the Company (insofar as relevant) (together, above and herein: “staff personnel”).
5.3. Without derogating from any provision of the provisions of the Agreement, it is clarified that the staff personnel employed on behalf of the Service Provider must participate actively in all stages of the provision of services, including attending meetings of the Company and/or the Ministry of Transport and/or any other entity as may be required for the provision of services and the frequency required to do so. Thus, as well as cooperate with any such entity, as stated, will assist with respect to the provision of the Services, and all as required by the Company from time to time.
5.4. It is clarified that the Company will be entitled to instruct on the replacement or on the removal of any of the Service Provider’s staff personnel, immediately, of anyone of the staff personnel, at any time and at its sole discretion, without bearing any responsibility toward the Service Provider and/or the staff personnel. Should the Company act as stated in this Clause, the Service Provider undertakes to provide an alternative staff member, and all subject to the advanced approval by the Company.
5.5. The Service Provider undertakes to pay the staff personnel under his employ their full salary and consideration, including the required social security rights, all in accordance with provisions of the law.
5.6. The mentioned in this Clause is among the primary points of the Agreement, and its violation will be deemed a Material Breach of the Agreement.

Manpower Requirements. 10.1. For the purpose of providing the Services, the Service Provider's work team shall, at all times, include excellent professionals and experienced in providing Services of the kind required according to the Tender documents, including the Agreement, in the composition and number as approved by the Steering Committee.
10.2. Without derogating from the aforesaid, the Services will be provided to the Company by the Service Provider through staff members on its behalf presented by him in its Bid to the Tender, who fully meet all the requirements set forth in the Tender Documents, as well as by other staff members approved in advance by the Steering Committee (hereinabove and hereinafter: the "Staff Members").
10.3. Without derogating from any provision of the provisions of the Agreement, it is clarified that the staff members on behalf of the Service Provider must actively participate in all stages of the provision of Services, including attending meetings of the Company and/or of the Ministry of Transportat and/or of any other party as may be required for the provision of the Services and at the frequency required for this purpose, and shall also cooperate with any such party, in order to assist in connection with the provision of the Services, all according to the Company's demand from time to time.
10.4. The Service Provider undertakes to continue to employ the staff members as proposed by him in the Service Provider's Bid for the entire term of the agreement, unless the Company has authorized it otherwise in advance and in writing. For the avoidance of doubt, the replacement of the staff members, without the Company's prior written approval, will constitute a material breach of the agreement. Notwithstanding the aforesaid, it is agreed that where any of the staff members are temporarily unable (in other words, illness, reserve duty, vacation leave, etc.) to perform their duties in the framework of the Services, the Service Provider may offer another staff member as a substitute, subject to receiving the Company's prior approval .
10.5. It is clarified that the Company is entitled to order the replacement of any of the staff members or the removal of any of the staff members immediately at any time and according to its sole discretion, and without it bearing any liability towards the Service Provider and/or the staff members. Manpower Requirements. At any time during the period for completion of the Work, the District may determine in its reasonable discretion that the Contractor or any of its subcontractors is not employing sufficient manpower on the Work to reasonably complete the Work or any component thereof within the scheduled amount of time. In such event, within forty-eight hours of any request by the District, the Contractor shall provide such additional manpower, or shall ensure that the subcontractor provides such additional manpower, as the District determines is necessary to ensure completion of the Work in a timely manner. Any failure by the Contractor or subcontractor upon the District’s request to provide such additional manpower as is required by the District shall constitute grounds for termination of the Contractor and/or the subcontractor. As an alternative to termination, the District, in its sole discretion, may determine to supplement the workforce of the Contractor or the subcontractor in order to ensure timely completion of the Work, and the cost thereof shall be deducted from amounts due to the Contractor pursuant to the Contract, and no such action by the District shall be

Manpower Requirements. 9.1. HOMESTAR Security will ensure that the client receive their full manpower compliment on each shift every day of the week.
9.2. HOMESTAR Security will ensure that the correct graded and ranked Security Officer is placed on site each shift.
9.3. From time to time, there may be certain instances where the Client will not be content with Security Officers. HOMESTAR Security will ensure that these Security Officers are removed from site and replaced with a suitably trained Security Officer of the same rank. Before commencement of his/her duties, a minimum of one full day/night’s training will be supplied at no additional cost to the Client.
Manpower Requirements. 4, paragraph two (2) shall be deleted in its entirety and replaced with: All work performed under the Contract will be accomplished by regular, permanent employees of the Company or its sub-contractors. The work schedule and total hours are subject to modification by the Authority. B. XXXXXXXXX agrees that all stagehands will work under the direction of the ARTIST'S production staff. For no reason shall these hands be used for any other purpose unless authorized by ARTIST'S staff.

Any failure by the Contractor or subcontractor to comply with the terms of this provision shall constitute grounds for termination of the Contractor and/or the subcontractor. As an alternative to termination, the District, in its sole discretion, may determine to supplement the work-force of the Contractor or the subcontractor in order to ensure timely completion of the Work. If the parties mutually agree to the cost(s) incurred by the District herein, then the cost(s) shall be deducted from amounts due to the Contractor pursuant to the Contract, and no such action by the District shall be deemed or construed to constitute interference by the District with the Contract or the Contractor's right to perform the Work. Provided however, if the parties cannot agree on the cost(s) incurred by the District, then the District may withhold any disputed amounts pending resolution by the parties as provided for in Part 12 of the General Conditions.
