There are some circumstances, usually for children who have a Statement of SEN where there is a statutory right for parents to appeal against a decision of the Local Authority.
For most children, including those who have a Statement of SEN in the mainstream sector, the ‘qualifying school’ is the school that is declared by the Council to be the school or academy serving the area in which the child’s home address falls.
