Aboriginal and Xxxxxx Xxxxxx Islander Leave. 50.1 Aboriginal and Xxxxxx Xxxxxx Islander Employees are entitled to paid leave up to a maximum of five (5) working days, and unpaid leave up to an additional ten (10) working days, per calendar year for the purpose of:
Aboriginal and Xxxxxx Xxxxxx Islander Leave. In consultation with their manager/supervisor Employees who identify and are accepted as members of Aboriginal or Xxxxxx Xxxxxx Islander communities and/or of descent, shall be entitled, to paid leave up to maximum of three (3) working days and leave without pay of up to a maximum of ten (10) working days per calendar year. This is for the purpose of fulfilling ceremonial obligations of a traditional or urban nature and may include relevant cultural events, initiation, birthing and naming, funerals and smoking or cleansing and sacred site or land ceremonies.

Such duties may include initiation, birthing and naming, funerals, smoking or cleansing and sacred site or land ceremonies, provided that in the case of funerals, where the employee is entitled to paid leave under clause 62 (Compassionate Leave), the entitlement to Indigenous Australians Leave shall not apply. Satisfactory evidence, such as a statutory declaration, may be required.
Aboriginal and Xxxxxx Xxxxxx Islander Leave o Employees who identify as and are accepted as members of Aboriginal and Xxxxxx Xxxxxx Islander communities shall be entitled to up to 5 working days of unpaid leave per calendar year for the purpose of ▪ fulfilling ceremonial obligations which may be “traditional” or “urban”in nature and may include tombstone openings, attendance at funerals, smoking of houses, initiation ceremonies or such ceremonies deemed by the elders to be significant, and ▪ to prepare for and attend community organisation business, National Aboriginal and Islander Day Observation Committee (NAIDOC) Week functions, or other relevant cultural events. o The employee may be required by the Chief Executive Officer to provide reasonable evidence to establish that he/she has an obligation under Aboriginal and Xxxxxx Xxxxxx Islander custom and/or traditional law to participate in these activities. o Under normal circumstances the employee must provide at least 2 weeks notice in writing (usually by furnishing an 'application for leave' form) of the employee's intention to take leave pursuant to this clause. o Approval of all Aboriginal and Xxxxxx Xxxxxx Islander leave will be subject to operational requirements but shall not be unreasonably withheld. o Leave taken in accordance with the provisions of this clause shall count as service for all purposes.
