1. Representation #12 - Environmental Conditions. Loan No. 6104195 (Hallandale Place Shopping Center) - The related Mortgaged Property has been impacted by former on-site dry cleaning operations. The Borrower has applied for and received an Order of Eligibility from the Florida Drycleaning Solvent Cleanup Program, which provides for the costs of cleanup of the site to be borne by the Florida Hazardous Waste Management Trust Fund, subject to payment of a deductible by the borrower of $10,000. A reserve in the amount of the deductible was funded at closing. Loan No. 6104149 (Tri-Main Center) and Loan No. 6104304 (North Dixie Plaza) - Each of the Borrowers under these Xxxxxxxx Xxxxx xxxx xxxxxxxx xx provide secured creditor environmental insurance policies for the benefit of the lender and its successors.
2. Representation #14 - Insurance. Loan No. 6104293 (Coleman Center) - While the related Mortgaged Property xx xxxxxxx xx x xxxxx xxxx, a Flood Elevation Certificate has been included on the related survey reflecting that the material improvements on the Mortgaged Property are all located a elevations above the flood level mark. The only improvements below the flood level elevation are pavixx, curb cuts and sewer drainage structures.
3. Representation #22 -
Access Routes. At the time of origination of the Mortgage Loan (based upon a representation from Mortgagor and a review of the survey), the Mortgagor had sufficient rights with respect to ingress and egress and similar matters identified in the appraisal of the Mortgaged Property as being critical to the appraised value thereof.
Access Routes. The Contractor has inspected the Site and shall be deemed to have been satisfied as to the suitability and availability of access routes to the Site. The Contractor shall use best efforts to prevent any utility, road, bridge or railway from being damaged by the Contractor’s traffic or by the Contractor’s personnel. Such efforts shall include the proper use of appropriate vehicles and routes. The Contractor shall notify the Project Manager by an advance written notice, of any anticipated transport or use of traffic by the Contractor which may cause damage to roads or utilities, and shall present the measures to be implemented thereby in order to avoid such damage.

To the best of the Borrower's knowledge, at the time of origination, the Mortgaged Property was (i) contiguous to a physically open, dedicated all-weather public street, (ii) had all necessary permits and approvals for ingress and egress, (iii) was adequately serviced by public or private water, public or private sewer systems and utilities, and (iv) was on a separate tax parcel, separate and apart from any other property owned by the Mortgagor or any other Person.

Based upon the information provided Borrower in the Pledged Asset Documents, at the Closing Date of such Pledged Eligible Asset, (i) the underlying borrower had sufficient rights with respect to amenities, ingress and egress and similar matters to support the intended use described in the Underwriting Transmittal, and (ii) to the best of Borrower's knowledge, such Property was receiving or has access to adequate services from public or private water, sewer and other utilities.

Access Routes. Estates and Wayleaves Section will supply the Project Manager or the contractors with one marked up copy of the agreed routes and a number of blank maps, as requested. Only agreed access routes shall be used. Should it be necessary to deviate from an agreed access route agreed by the occupier (usually at the request of an occupier), the Project Manager shall advise the Estates and Wayleaves Section, in writing, as soon as possible, with a copy of the revised map. When access is arranged, agreement shall be obtained from the occupier for the removal of fences and xxxxxx and, unless otherwise approved, a temporary fence shall be erected immediately after their removal. Access roads shall be kept clean and tidy and in useable condition to the reasonable satisfaction of the occupier until all site work is complete. It is important to keep to agreed accesses, in particular when using vehicles. Every effort shall be made to minimise the inconvenience to the owners and occupiers of the property or land.
