Account Credentials and Security. 3.1. In the event that we accept you as our Client, we shall open a Trading Account in your name which will allow you to place Orders on our Trading Platform. It is agreed and understood that the Company offers different types of Trading Accounts, which have different margin Requirements and characteristics. 3.2. In order to access the Trading Account, you will be asked to enter your Account Credentials issued by us to you which are confidential and shall be used solely by you. 3.3. You: ● are responsible for ensuring that your Account Credentials remain confidential and for taking such other precautions as may be necessary to ensure they cannot be used by any person other than you or your authorised representative and making sure that a third party is not provided access to your computer for example via using team viewer to turn on or control your computer; ● must notify us immediately if you become aware that your Account Credentials have in any way become compromised or if any third party may be able to access the Trading Platform; and ● You agree we do not have to establish the authority of anyone quoting your Trading Account number or Account Credentials. The use of your Account Credentials by any third party is expressly prohibited. 3.4. If we believe that there is likely to be a breach of security, we may require you to change your Account Credentials or suspend your access to the Trading Platform. We reserve the right to edit, amend or issue you with new Account Credentials or require a change of your Account Credentials at any time by giving notice to you. 3.5. You are responsible for ensuring that you alone control access to your Account Credentials, and that no minor or other person is granted access to the Trading Platform using your Account Credentials. You acknowledge that you are ultimately and solely responsible for all actions on the Trading Platform through your Registration Data including any unauthorized disclosure of your Account Credentials. 3.6. You undertake to immediately notify us immediately first orally and then in writing if you become aware of any loss, theft or use by any other person or entity other than you, of any of your Registration Data, including your Account Credentials. We will then take steps to prevent any further use of such Account Credentials and will issue replacement Account Credentials. In the event that the Company accepts the Client, the Client shall open a Trading Account in the Client’s name which will enable the Client to place Orders on the company’s Trading Platform. In order to access the Trading Account, the Client will be required to enter the Account Credentials issued by the Company which are confidential and shall be used solely by the Client. 10.3. The: Client acknowledges that: 10.3.1. is responsible for ensuring that the Account Credentials remain confidential and for taking such other precautions as may be necessary to ensure they cannot be used by any person other than the Client or the Client’s authorized representative and making sure that a third party is not provided access to the Client’s computer, including among other through the use of remote access and remote-control computer software; 10.3.2. must notify the Company immediately if the Client become aware that the Account Credentials have been compromised or if any third party may have access to the Trading Platform; and 10.3.3. does not provided the authority to any third party for the quoting of the Trading Account number or Account Credentials. The use of Account Credentials by any third party is expressly prohibited. 10.4. If the Company believes that there is likely to be a breach of security the Company may require the Client to change the Account Credentials or suspend the Clients access to the Trading Platform. The Company reserves the right to edit, amend or issue the Client new Account Credentials or require a change of the Client’s Account Credentials at any time by giving notice to the Client. 10.5. The Client is responsible for ensuring that he/she alone control access to its Account Credentials, and that no minor or other person is granted access to the Trading Platform using the Client’s Account Credentials. The Client acknowledges that is ultimately and solely responsible for all actions on the Trading Platform through its Registration Data including any unauthorized disclosure of the Client’s Account Credentials. 10.6. (b) Neither the Company nor any of its Subsidiaries uses, collects, or receives any Personal Information or sensitive non-personally identifiable information and does not become aware of the identity or location of, or identify or locate, any particular Person as a result of any receipt of such Personal Information, in a manner which would materially breach or violate any Privacy Laws and materially and adversely impact the business of the Company and its Subsidiaries, taken as a whole. (c) To the Company’s knowledge, Persons with which the Company or any of its Subsidiaries have contractual relationships have not breached any agreements or any Privacy Laws pertaining to Personal Information and to non-personally identifiable information. (d) To the Company’s knowledge, the Company and its Subsidiaries take all commercially reasonable steps to protect the operation, confidentiality, integrity and security of their respective business systems and websites and all information and transactions stored or contained therein or transmitted thereby against any unauthorized or improper use, access, transmittal, interruption, modification or corruption, and there have been no material breaches of same. Without limiting the generality of the foregoing, each of the Company and its Subsidiaries (i) uses industry standard encryption technology and (ii) has implemented a comprehensive security plan that (1) identifies internal and external risks to the security of the Company’s or its Subsidiaries’ confidential information and Personal Information and (2) implements, monitors and improves adequate and effective safeguards to control those risks.
