Action Item 7. By December 1, 2021, the District will update its website and handbooks to include the name, office location, email address, and phone number of its Section 504 Coordinator.

By March 1, 2022, the District will consult with the SRO regarding its policy governing SRO access to educational records of students with disabilities, including the portions of the student’s IEP, 504 plan, or behavior plan that address accommodations or approaches related to behavioral concerns, under The Family Educational Rights and Privacy ACT (FERPA) (20 U.S.C. § 1232g; 24 CFR Part 99). This will include the District’s practice that whenever an SRO is anticipated to be involved with a student with a disability, the District will make a staff member available to assist the SRO in understanding this information.

Action Item 7. If, during the 2015-2016 school year, the District’s investigations of alleged Title IX discrimination determine that any student enrolled in CMISD has been subjected to sexual harassment or sexual violence by any of its employees, students, or a third party, the District will offer counseling services to such a student. The District will also evaluate the student to determine whether the student is in need of other remedial measures to address the effects of the harassment. The District’s evaluation must be conducted by a certified counselor knowledgeable about the emotional and mental effects of sexual harassment and sexual violence. If it is determined that the student is in need of further counseling or other remedial measures, the District will provide such counseling and/or remedial measures.
Action Item 7. In order to settle this matter, the School District will conduct an investigation to assess whether the alleged perpetrator created a sexually hostile environment for any student during the 2017- 2018 school year. If the District concludes that such an environment existed, it shall assess whether such an environment still exists, take steps to remedy or prevent that environment, and prevent its recurrence.
Action Item 7. The District will conduct training for all District Administrators and employees with responsibility for the evaluation, placement, and provision of services to students under Section 504, including, but not limited to, all Principals, Assistant Principals who are members of Section 504 teams, Section 504 Team Chairpersons, nurses, counselors, other related service providers, and members of the Student’s Section 504 team during the 2015-2016 school year. By December 1, 2017, the NEISD will provide written notice to the Complainant of the outcome of its investigation and, if the NEISD substantiates the harassment as a result of the investigation, the NEISD will issue, by certified mail, a written offer to the Student to provide counseling/academic/therapy services for the assessment and/or treatment of any psychological harm or any of the lingering effects from the harassment. The NEISD’s letter will inform the Student and the Complainant that they have ten (10) calendar days from the date of the letter to accept the offer by providing written notice of their acceptance.
Action Item 7. Within ninety (90) calendar days after the School’s receipt of OCR’s approval of the revised Procedure, the School will provide training regarding the prohibitions against disability harassment and discrimination (other protected bases may also be included in this training) to all faculty, staff and administrators within the School. The training will include instruction regarding the following: (a) the requirements of Section 504, including that disability harassment and discrimination is prohibited and will not be tolerated; (b) what types of conduct constitutes such harassment and discrimination; (c) the negative impact that such harassment and discrimination has on the educational environment; (d) how faculty, staff and administrators are expected to respond to such harassment and discrimination that they experience or witness, or of which they otherwise know, including the reporting avenues available; (e) the responsibility of faculty, staff and administrators to report incidents of possible harassment and discrimination, and the procedures for doing so; and (f) where, how, and to whom instances of disability harassment and discrimination are to be reported.
