Common use of Advance Notice of Layoff Clause in Contracts

Advance Notice of Layoff. (a) The Board agrees to notify the employee and the union of layoffs in accordance with the following periods of notice: (i) two (2) weeks of notice where the employee has completed a period of employment of at least six (6) consecutive months, and (ii) after the completion of a period of three (3) consecutive years, one (1) additional week of notice and for each subsequent completed year of employment, an additional week of notice, up to eight (8) weeks of notice. If the employee has not had the opportunity to work the days as provided under this Article, the employee shall be paid for time in lieu of notice. (b) These provisions do not apply to a temporary layoff of two (2) weeks or less as a result of emergency conditions beyond the control of the Employer, such as fire or natural disaster.
