Age; Grade Range; Number of Students. The School shall provide instruction to pupils in such ages, grades and estimated numbers in each year of operation as set forth in the Renewal Application. The School agrees that its student enrollment shall not exceed the capacity of the facility or site as set forth in the Certificate of Occupancy.

2.5.2 The Charter School may make modifications as to the number of students in any particular grade, and number of students within a class to accommodate staffing exigencies and attrition patterns provided such modifications are otherwise consistent with this Charter.
2.5.3 Elimination of a grade that the Charter School was scheduled to serve or expansion to serve grade levels not contemplated in the Charter Application shall be material changes to the terms of this Charter and shall require prior written authorization from the Sponsor.
2.5.4 Commencing or continuing instruction where the total number of students enrolled is less than ten percent (10%) of the projected enrollment or the total enrollment of the Charter School is fewer than _#_ ( ) students, whichever number is greater, shall be a material change to the terms of this Charter and shall require prior written approval from the Sponsor. The Sponsor’s approval of increases or decreases in student enrollment will be based on the Charter School’s ability to demonstrate that such material changes in enrollment will not compromise the fiscal and educational integrity of the Charter School.
Age; Grade Range; Number of Students. Each school operated by the Education Corporation shall provide instruction to pupils in such ages, grades, and numbers in each year of operation as set forth in the Terms of Operation (the “Projected Enrollment Structure”), and the Education Corporation shall obtain the prior written permission of the Trustees for variances from those terms, except as specifically set forth in subsections (a) and (b) below.
(a) Each school operated by the Education Corporation may enroll a total number of students different from such number as is set forth in the Projected Enrollment Structure (the “Projected Enrollment”) for such school so long as (i) the total enrollment of such school does not exceed one hundred and twenty percent (120%) of the Projected Enrollment, or

The Charter School shall provide instruction to pupils in such grades and numbers in each year of operation under the Charter as described in the Application, provided that the Charter School, upon making all reasonable efforts to recruit students, may enroll a lesser or greater number of students in each grade, or lesser or great number students from one year to the next, within reason, without being deemed in material breach of the Charter, as long as such enrollment variation does not substantially alter the school’s educational design as described in the Application. Notwithstanding the foregoing sentence, the Charter School must obtain prior written approval from SED prior to (i) enrolling any student, who, if enrolled, would cause the school's enrollment to exceed the total maximum enrollment of the school as set forth in the Application (the "Maximum Enrollment") or (ii) commencing or continuing instruction where the total number of students enrolled is less than eighty-five percent (85%) of the Projected Enrollment for a given academic year as set forth in the Application or the total enrollment is less than fifty (50) students. The Charter School shall demonstrate good-faith efforts to attract and retain a comparable or greater enrollment of students with disabilities, English language learners, and students eligible for free and reduced- price lunch when compared to the enrollment figures for such students in the school district (or if the charter school is located within the City School District of the City of New York, the community school district) in which the charter school is located.
Age; Grade Range; Number of Students. 2.3.1 The Charter School shall provide instruction to pupils in grades 6 through 12.
2.3.2 The number of students in each grade shall not exceed the following: Grade Level Maximum Enrollment 6 300 7 400 8 450 9 400 10 400 11 400 12 275 The maximum total enrollment at the Charter School shall not exceed 2,100 students (the “Maximum Enrollment Number”). In addition, the Charter School shall not enroll new students into the 12th grade after the first day of school for each school year. In the event that the number of students matriculating from the 11th grade to the 12th grade exceeds the maximum enrollment for 12th grade, there is no requirement to unenroll students, however, no new students could be enrolled into the 12th grade.
2.3.3 The Charter School may adjust the number of students served whereby the number of students served may adjusted upward or downward by NVVA in an amount not to exceed ten (10) percent of the Maximum Enrollment Number established in section 2.3.2; however, an increase or decrease in total enrollment by more than 10% from the enrollment established in 2.3.2 shall be a material amendment of this Amended Charter Contract and shall not become effective and the Charter School shall not take action or implement the change requested in the amendment until the amendment is approved, in writing, by the Authority. Authorization to expand may require the Charter School to demonstrate satisfactory academic and financial performance, and organizational compliance.
2.3.4 The Charter School may modify the maximum permitted number of students enrolled in any particular grade, as set forth in section 2.3.2, upon the approval of the Authority’s Executive Director, which approval shall not be unreasonably withheld.

2.3.2 The Charter School may make modify the number of students in any particular grade, and number of students within a class, to accommodate staffing exigencies and attrition patterns provided such modifications are consistent with this Charter Contract.
2.3.3 Elimination of a grade level that the Charter School was scheduled to serve, expansion to serve grade levels not identified in 2.3.1, or an annual increase/decrease in total enrollment by more than 10% shall be a material amendment of this Charter Contract and shall not become effective and the Charter School shall not take action or implement the change requested in the amendment until the amendment is approved, in writing, by the Authority. Authorization to expand may require the Charter School to demonstrate satisfactory academic and financial performance, and organizational compliance.

During the remaining three years of the contract, school years 2023- 24, 2024-25 and 2025-26, the charter school may adjust the number of students served by up to and including 10% of the maximum enrollment established in this section.
2.3.2 The Charter School may modify the number of students in any particular grade, and number of students within a class, to accommodate staffing exigencies and attrition patterns provided such modifications are consistent with this Charter Contract.
2.3.3 Elimination of a grade level that the Charter School was scheduled to serve; expansion to serve grade levels not identified in 2.3.1; or an increase or decrease in total enrollment by more than 10% from the enrollment established in 2.3.1 shall be a material amendment of this Charter Contract and shall not become effective and the Charter School shall not take action or implement the change requested in the amendment until the amendment is approved, in writing, by the Authority. Authorization to expand may require the Charter School to demonstrate satisfactory academic and financial performance, and organizational compliance. 2.3.2 The Charter School may modify the number of students in any particular grade, and number of students within a class, to accommodate staffing exigencies and attrition patterns provided such modifications are consistent with this Charter Contract.
2.3.3 Elimination of a grade level that the Charter School was scheduled to serve; expansion to serve grade levels not identified in 2.3.1; or an increase or decrease in total enrollment by more than 10% from the enrollment established in 2.3.1 shall be a material amendment of this Charter Contract and shall not become effective and the Charter School shall not take action or implement the change requested in the amendment until the amendment is approved, in writing, by the Authority. Authorization to expand may require the Charter School to demonstrate satisfactory academic and financial performance, and organizational compliance. It is the responsibility of the Charter School to request the material amendment required by this section 2.3.3 in a timely manner so as to manage the school’s enrollment to comply with 2.3.3.

2.3.2 The Charter School may modify the number of students in any particular grade, and number of students within a class, to accommodate staffing exigencies and attrition patterns provided such modifications are consistent with this Charter Contract.
2.3.3 Elimination of a grade level that the Charter School was scheduled to serve; expansion to serve grade levels not identified in 2.3.1; or an annual increase or decrease in total enrollment by more than 10% from the enrollment of October 1 of preceding year shall be a material amendment of this Charter Contract and shall not become effective and the Charter School shall not take action or implement the change requested in the amendment until the amendment is approved, in writing, by the Authority. Authorization to expand may require the Charter School to demonstrate satisfactory academic and financial performance, and organizational compliance. Regardless what enrollment projections are contained in the charter school application approved by the Authority, the first year enrollment on October 1 for the Charter School shall serve as the basis for the 10% annual enrollment increase or decrease for the school’s second year; similarly, subsequent years’ enrollment on October 1 shall serve as the basis for the following years’ enrollment. Each year’s enrollment shall be limited to 10% more pupils than the previous year’s October 1 enrollment unless the school’s request for a material amendment is approved by the Authority. For example, a school enrolling 100 pupils any given year may enroll no more than 110 pupils the following year without Authority approval of a material amendment. It is the responsibility of the Charter School to request the material amendment required by this section 2.3.3 in a timely manner so as to manage the school’s enrollment to comply with 2.3.3.
