ANNUAL INSPECTION AND REPORT. The Property Owner shall, on an annual basis, complete a Treatment Measure Operation and Maintenance Inspection Report (“Annual Report”) using a form available from the County’s Planning Department. The Annual Report shall include all completed Inspection and Maintenance Checklists for the reporting period, as well as a copy of this Operation and Maintenance Agreement, and shall be submitted to the County in order to verify that inspection and maintenance of the applicable stormwater treatment measure(s) have been conducted pursuant to this Agreement. The Annual Report shall be submitted no later than December 31 of each year, signed under penalty of perjury, to the Current Planning Section, Attention: NPDES Planner, or another member of the County staff as subsequently directed in writing by the County. The Property Owner shall provide in the Annual Report a record of the volume of all accumulated sediment removed as a result of the treatment measure(s). The Property Owner shall conduct a minimum of one annual inspection of the stormwater treatment measure(s) before the wet season. This inspection shall occur between August 1st and October 1st each year. More frequent inspections may be required by the Maintenance Plan in Exhibit C. The results of inspections shall be included on an Inspection and Maintenance Checklist(s) form available in the Exhibits to this Agreement and submitted to the County as part of the Annual Report. The property owner shall pay the required fees to cover County staff time spent performing necessary compliance monitoring activities, such as annual report reviews and necessary inspections.

ANNUAL INSPECTION AND REPORT. The Property Owner(s) shall, between August 1st and October 1st of each year, inspect the stormwater treatment measure(s) using the Stormwater Treatment Measures Operating Maintenance Inspection Report (Annual Inspection Report), Best Management Practice (BMP) operation and maintenance fact sheets, which are attached to this agreement as Exhibit D and other appropriate documentation relating to the operation and maintenance of stormwater treatment measure(s). The Annual Inspection Report shall include all completed Inspection and Maintenance Checklists for the reporting period and shall be submitted to the City in order to verify that inspection and maintenance of the applicable stormwater treatment measure(s) have been conducted pursuant to this agreement. The Annual Inspection Report shall be submitted no later than December 31 of each year under penalty or perjury to Code Enforcement Technician, Street Department, 0000 Xxxxx Xxxxxx, Santa Clara Ca 95050 or another member of the City staff as directed by the City. The Property Owner(s) shall provide a record of the volume of all accumulated sediment removed from the stormwater treatment measure(s) in the Annual Inspection Report. More frequent inspections may be required by the maintenance plan (Exhibit C). The results of all inspections shall be recorded on the Inspection and maintenance Checklist(s) attached as Exhibit E.

Hydrodynamic separators are required to be cleaned a minimum of once per seasonal cycle. Inlet filters are required to be serviced by a third party company a minimum of three times per seasonal cycle. Additional information on the required maintenance of the full trash capture device(s) in included in Exhibit C. Maintenance records provided to the Property Owner by the third party company shall be submitted to the City in order to verify that the maintenance of the full trash capture device(s) have been conducted pursuant to this agreement. The maintenance records shall be submitted no later than December 31 of each year, under penalty of perjury, to the City of Dublin Environmental Coordinator at the City of Dublin, 000 Xxxxx Xxxxx, Xxxxxx XX, 00000 or another member of the City staff as directed by the City. The maintenance records shall include the volume of all accumulated sediment and trash removed from the full trash capture device(s).

The Property Owner shall retain each annual report at a location on the Property for a period of at least five (5) years. The City may request Property Owner to provide copies of any or all annual reports prepared during the prior five years in order to verify that inspection and maintenance of the applicable STMs and FDCs have been conducted pursuant to this Agreement. Property Owner shall comply with any such request within five (5) working days.
