Approval of Working Drawings. (a) Landlord and Tenant acknowledge that Landlord shall retain Habitec as architect ("Landlord's Architect") to prepare all architectural plans and specifications and shall retain engineers to prepare all engineering plans and specifications required for the construction of the Tenant Improvements in conformance with the base building and tenant improvement standard specifications of the Building (the "Working Drawings"), which Working Drawings shall be delivered to Tenant no later than September 15, 1998, and to prepare drawings and specifications for Changes (as defined below), if any, requested or required pursuant to paragraph 5 below.
(b) Landlord shall submit the completed Working Drawings to Tenant for Tenant's approval. Tenant will provide written approval of the Working Drawings within five business days after such submission. If Tenant disapproves any part of the submission, the disapproval shall include written instructions adequate for Landlord's architect and engineers to revise the Working Drawings. Such revisions shall be subject to Landlord's approval, which shall not be unreasonably withheld. Tenant will finally approve the revised Working Drawings within three business days after submission thereof to Tenant. If Tenant's instructions necessitate (i) revisions to the Working Drawings (as originally submitted) which do not conform with the Space Planning Documents, or (ii) a change of scope relative to the Space Planning Documents, the costs incurred by Landlord as a result of such instructions (including, without limitation, the cost of revising the Working Drawings) shall be promptly borne and paid by Tenant upon demand by Landlord. If Tenant's instructions necessitate revisions that are required for the Working Drawings to conform to the Space Planning Documents, the costs incurred for such revisions shall be borne by Landlord.
(c) If Tenant fails to approve the Working Drawings or the required Working Drawings within the applicable periods set forth in subparagraph 3(b) above, then (A) Landlord shall not be obligated to commence construction of the Tenant Improvements until such approval is given (and all other permits and approvals have been obtained), (B) Tenant shall be responsible for any resulting delay, and the cost of such delay, in Landlord's completion of the Tenant Improvements, and (C) any such delay shall be deemed a Tenant Delay (as defined below).
Approval of Working Drawings. Tenant’s Architect shall submit the Working Drawings to Tenant for review to confirm compliance with the Preliminary Space Plan, and Tenant shall notify Landlord and Tenant’s Architect within three (3) business days after delivery thereof of any requested revisions. Within three (3) business days after receipt of Tenant’s notice, Tenant’s Architect shall make all approved revisions to the Working Drawings and submit two (2) copies thereof to Tenant and Landlord for their final review and approval, which approval shall be given within three (3) business days thereafter. Concurrently with the above review and approval process, Tenant’s Architect may submit all plans and specifications to City and other applicable governmental agencies in an attempt to expedite City approval and issuance of all necessary permits and Licenses to construct the Tenant Improvements as shown on the Working Drawings. Any changes which are required by City or other governmental agencies shall be immediately submitted to Landlord and Tenant for review and reasonable approval.
Approval of Working Drawings. Tenant or Tenant's Architect shall submit the Working Drawings to Landlord for its review and approval, which shall not be unreasonably withheld. Landlord shall notify Tenant within five (5) business days after delivery thereof if the Working Drawings are approved. If Landlord withholds approval, Landlord shall so notify Tenant and specify the reasons for withholding such approval. If the Working Drawings are not approved, within five (5) days after receipt of Landlord's notice, Tenant's Architect shall make all necessary revisions to the Working Drawings and submit two (2) copies thereof to Landlord for its final review and approval, which approval shall not be unreasonably withheld, delayed or conditioned and shall be given within five (5) days thereafter. If no response is given by Landlord within the five (5) day period, approval shall be deemed. Concurrently with the above review and approval process, Tenant may submit all plans and specifications to City and other applicable governmental agencies in an attempt to expedite City approval and issuance of all necessary permits and licenses to construct the Tenant Improvements as shown on the Working Drawings. Any changes which are required by City or other governmental agencies shall be immediately submitted to Landlord for Landlord's review and reasonable approval, and to Tenant for Tenant's review and approval.
Approval of Working Drawings. The Project Engineer represents the Engineer on the project, with full authority to enforce Contract requirements and carry out the Engineer’s orders. If the Contractor fails to respond promptly to the requirements of the Contract or orders from the Engineer:
1. The Project Engineer may use Contracting Agency resources, other contractors, or other means to accomplish the Work, and
2. The Contracting Agency will not be obligated to pay the Contractor, and will deduct from the Contractor’s payments any costs that result when any other means are used to carry out the Contract requirements or Engineer’s orders. At the Contractor’s risk, the Project Engineer may suspend all or part of the Work if:
1. The Contractor fails to fulfill Contract terms, to carry out the Engineer’s orders, or to correct unsafe conditions of any nature;
2. The weather or other conditions are unsuitable; or
3. It is in the public interest. Nothing in these Specifications or in the Contract requires the Engineer to provide the Contractor with direction or advice on how to do the Work. If the Engineer approves or recommends any method or manner for doing the Work or producing materials, the approval or recommendation shall not:
1. Guarantee that following the method or manner will result in compliance with the Contract,
2. Relieve the Contractor of any risks or obligations under the Contract, or 3. Create any Contracting Agency liability.

Landlord or Landlord's Architect shall submit the Working Drawings to Tenant for Tenant's review, and Tenant shall notify Landlord and Landlord's Architect within five (5) days after delivery thereof of any requested revisions. Within five (5) days after receipt of Tenant's notice, Landlord's Architect shall make all approved revisions to the Working Drawings and submit two (2) copies thereof to Tenant for its final review and approval, which approval shall be given within three (3) days thereafter. Concurrently with the above review and approval process, Landlord may submit all plans and specifications to City and other applicable governmental agencies in an attempt to expedite City approval and issuance of all necessary permits and licenses to construct the Tenant Improvements as shown on the Working Drawings. Any changes which are required by City or other governmental entity shall be immediately submitted to Landlord for Landlord's review and reasonable approval, and Landlord shall promptly notify Tenant of such changes.
Approval of Working Drawings. (a) After approval of the Design Development Plans and selection of the Contractor, the Architect shall prepare complete and coordinated architectural plans and specifications required for the construction of the Tenant Improvements in conformance with such Space Plans (the "Working Drawings"), and to prepare drawings and specifications for Changes (as defined below), if any, requested or required pursuant to Paragraph 8 below.
(b) Landlord shall submit the completed and coordinated Working Drawings to Tenant for Tenant's approval. Tenant will provide written approval of the Working Drawings within five (5) business days after such submission. If Tenant disapproves any part of the submission, the disapproval shall include written instructions
Approval of Working Drawings. Within seven (7) business days after the initial proposed Working Drawings are delivered to Landlord, Landlord shall approve or disapprove same in writing and if disapproved, Landlord shall provide Tenant's Architect specific reasons for disapproval; provided that Landlord shall respond within three (3) business days after receipt of any revised Working Drawings. Notwithstanding the foregoing, in the event the Working Drawings are delivered to Landlord during the period of December 20, 2002 through January 2, 2003, Landlord shall have until January 10, 2003 to approve or disapprove such Working Drawings; provided that Landlord shall use reasonable efforts to notify Tenant of such approval or disapproval as soon as reasonably possible. The foregoing process shall continue until the Working Drawings are approved by Landlord; provided that if Landlord fails to respond in the initial seven (7) business day period or any subsequent three (3) business day period, Landlord shall be deemed to have approved the last submitted Working Drawings. For purposes of approval of Working Drawings, the proposed Working Drawings will be considered delivered to Landlord upon delivery to Xxx Xxxxxxx, Transwestern Commercial Services, 0000 Xxxxxx Xxxxxx Xxxx, Xxxxx 000X, Xxxxxx, Xxxxx 00000 and to Xxxx Xxxxxx, Transwestern Commercial Services, 0000 Xxxxxx Xxxxxx Xxxx, Xxxxx 000X, Xxxxxx, Xxxxx 00000. For communications to Tenant or Tenant's Architect under this Work Letter, such communications shall be sent to Xxxxxx Xxxxxx, Good, Xxxxxx & Xxxxxxx, 0000 Xxxxxxxx, Xxxxx 000, Xxxxxx, Xxxxx 00000 and to Xxxxxx Communications, Inc., 0000 Xxxxxxxxx Xxxxxx, Xxxxx Xxxxxxx, Xxxxxxxxxx, 00000, Attention: Xxxxxx Xxxxxx, Director, Program and Systems Support Operations and Professional Services.
Approval of Working Drawings. Working Drawings have been approved by ---------------------------- both Landlord and Tenant as attached hereto in Exhibit B-1.

Approval of Working Drawings. Such plans and specifications, together with the Design Build Plans are hereinafter referred to as the "Working Drawings". Landlord shall also retain Landlord's Architect and engineers to prepare drawings and specifications for Changes (as defined below), if any, requested or required pursuant to paragraph 6 below. As used herein, the term "Design Build Plans" means the plans for plumbing, HVAC and electrical, which plans will be developed by subcontractors in each of the plumbing, HVAC and electrical trade disciplines. The Contractor will request design build proposals from no fewer than two (2) qualified subcontractors in each of the plumbing, HVAC and electrical trade disciplines.
