Assumption of Risk and Waiver of Liability. I, on behalf of myself and my minor child, and his/her other parent, heirs, successors, assigns and legal representatives (all of whom, including myself, are hereinafter referred to as the “Releasors”) acknowledge and fully understand that s/he will be en- gaging in activities that include the risk of injury or death resulting not only from my child’s actions, inactions, or negligence, but the actions, inactions, or negligence of others. These risks include, but are not limited to, equipment used during the activity, conditions that exist on the premises, physical contact between participants or with instructors, and other risks that may not be known to Releasors or are not reasonably foreseeable. On behalf of Releasors, I understand and knowingly agree to assume the risk for my child’s participation in such activities. I, on behalf of Releasors, hereby re- lease and forever discharge the Foundation, the University, the University System of Maryland (“USM”), the State of Maryland and their employees, agents, officers, trustees and representatives (in their official and individual capacities) (all releasees are hereinafter referred to as the “Releasees”) from any and all liability whatsoever for any and all damages, losses or injuries (including death), s/he sustain to his/her person or property or both, including but not limited to any claims, demands, actions, causes of action, judgments, damages, expenses and costs, including attorneys’ fees, which arise out of, result from, occur during or are connected in any manner with my child’s participation in the Activity and/or any travel incident thereto except for such damages or injury as may be caused by the gross negligence or actual malice of Releasees. I agree that Releasors will not hold Releasees responsible for loss of my child’s personal property.
Assumption of Risk and Waiver of Liability. This Assumption of Risk and Waiver of Liability (“Assumption of Risk”) is applicable to Resident’s license to occupy a Unit, and constitutes a material inducement to University’s agreement to enter into the Student Housing and Meal Plan License Agreement (“Agreement”). Terms not otherwise defined herein shall have the meaning ascribed thereto in the Agreement. By electronically submitting the Agreement, Resident (and Resident’s parent or legal guardian on behalf of themselves and the Resident if Resident is under eighteen (18) years of age) confirms that they understand and acknowledge that the decision to reside in University Housing is voluntary. They further understand and agree that residing in Housing involves certain risks which include potential exposure to communicable diseases and infections, including without limitation COVID-19. Knowing this information and the risks related to residing in Housing, in consideration of issuance of the Agreement, Resident (and Resident’s parent or legal guardian, if applicable) expressly and knowingly agree as follows:

Participant hereby ASSUMES THE RISK of participating in the activities described in Appendix A: Project Description and RELEASES FROM LIABILITY, WAIVES, DISCHARGES AND COVENANTS NOT TO XXX the State of Iowa; Board of Regents, State of Iowa; and Iowa State University; and their officers, servants, agents, or employees, including students participating in the Project, for any liability, claim, and/or cause of action arising out of or related to any loss, damage, or injury, including death, involving Participant or Participant’s property. Participant further agrees that this Participation Agreement shall bind the members of Participant’s family and spouse, heirs, assigns and personal representatives.

Assumption of Risk and Waiver of Liability. Parent specifically acknowledges that the “RP” activities will involve maneuvering a boat, sailboard or other watercraft on deep waters in potentially hazardous conditions which may include, among other things, strong winds and high waves, sudden and unexpected immersion in deep waters and collisions with other watercraft or stationary objects, such as docks, pilings, and buoys. With knowledge of the dangers involved, Xxxxxx hereby voluntarily requests that his/her Child be allowed to take part in the “RP” activities. PARENT XXXXXX ACCEPTS ANY AND ALL RISKS TO HIS/HER CHILD OF INJURY, DEATH AND PROPERTY DAMAGE ARISING FROM PARTICIPATION IN THE “RP” ACTIVITIES AND THE USE OF THE “RP” FACILITIES AND PROPERTY, WHETHER OR NOT CAUSED BY THE NEGLIGENCE OR GROSS NEGLIGENCE of “RP” and its directors, officers, employees, volunteers, members and/or members of “RP” members’ families. Parent does hereby release and forever discharge “RP” and its directors, officers, employees, volunteers, members and members of “RP” members’ families and their successors and assigns from any and all liability, claims and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from his/her Child’s participation in “RP” activities. Parent understands that this Release discharges “RP” from any liability or claim that the Parent or Child may have against “RP” with respect to any bodily injury, personal injury, illness, death or property damage that may result from his/her Child’s participation in “RP” activities, whether caused by the negligence or gross negligence of “RP”, its directors, officers, employees, volunteers, members and members of “RP” members’ families or other participants in “RP” activities or otherwise arising. Parent also understands that “RP” does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance in the event of injury or illness. Assumption of Risk and Waiver of Liability. Lessee acknowledges that there are or may be risks of harm encountered in visiting or entering the Farm or any other premises where the Cows are located including but not limited to visiting and/or interacting with the Cows and/or other animals that may be found in the vicinity of the Cows. Lessee hereby assumes the risk of any and all such harm and also hereby waives any and all right to make, file, or pursue any claim, demand, suit, action, cause of action, damages, etc. against the Lessor or any of Lessor’s agents, employees, representatives, principals, lessors, lessees, vendors, contractors, subcontractors, etc. that arises out of or in any way relates to any injury, illness, death, loss or damage caused, in whole or in part, by (a) the handling or consumption of raw milk produced by the Cows, (b) the handling or consumption of raw dairy products that Lessor processes at Lessee’s request from the milk produced by the Cows, (c) visiting or entering the Farm or any premises where the Cows are located, (d) the care and/or boarding of the Cows by Lessor.
Assumption of Risk and Waiver of Liability. RELATING TO COVID-19 AND COMMUNITY POOL VISITATION I acknowledge the following: that the novel coronavirus, known as COVID-19, has been declared a worldwide pandemic; that COVID-19 is extremely contagious and believed to spread from person-to- person contact, even in people exhibiting no symptoms; that federal, state, and local governments and related health agencies recommend social distancing (maintaining at least 6 feet’s distance from others), among other things, and avoiding large gatherings of people; that, as permitted, while my community is allowing a restricted opening of my community’s pool (sometimes referred to as the “Facility”), the dangers of the spread of COVID-19 still exist, and may continue to exist even after the pandemic is over; and that, the Facility cannot guarantee that I, or my child(ren) or other dependents, will not be exposed and become infected with COVID-19 while at the pool; and that visiting the pool could increase our risk of contracting COVID- 19. By signing this agreement, I acknowledge the contagious nature of COVID- 19 and voluntarily assume the risk that any and all of my children or other dependents, and I, could be exposed to or become infected by COVID-19 by entering, visiting, or using the pool. I acknowledge and understand that such exposure to COVID-19 could result in infection that may cause bodily injury, illness, permanent disability, or death. I understand that the risk of becoming exposed to or infected by COVID-19 at the pool may result from the actions, omissions, or negligence of me or others, including but not limited to the Facility owners, its affiliates, managers, employees or representatives of any of them, or other residents. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any and all injury or damage to my child(ren), or me (including but not limited to bodily injury, disability, or death), as well as any and all other illness, damage, loss, claims, liabilities, or expenses, of any kind, that my child(ren), or I may suffer, sustain, or incur in any way arising out of or in connection with entry or usage of the Facility pool (all of the above constituting the “Claims”).

INDEMNIFICATION I expressly agree to indemnify and hold harmless Our Lady of the Fields Camp and Retreat Center and all the Camp Parties from any liability to me or any third party, resulting from or in any way relating to my participation and/or participation in any and all activities and events. AGREEMENT NOT TO XXX I expressly agree not to xxx Our Lady of the Fields Camp and Retreat Center and all the Camp Parties for any claim, present or future, that I may have on my behalf, that may result from or in any way be connected to, my participation in any and all activities and events. COVID-19 By signing this agreement form, I acknowledging that there is an inherent risk of exposure to COVID-19 in any public place where people are present. By attending Our Lady of the Fields Camp and Retreat Center, I voluntarily assume all risks related to exposure to COVID-19 and agree not to hold Our Lady of the Fields Camp and Retreat Center; or any of their affiliates, directors, officers, employees, agents, contractors, or volunteers liable for any illness or injury.
Assumption of Risk and Waiver of Liability. Assumption of risk: I understand and acknowledge that borrowing and using the recreational equipment owned by the United Townships of Head, Xxxxx & Xxxxx carries hazard and risk. The specific risks vary from one activity to another. Risks include but are not limited to: minor injuries such as scratches, bruises, sprain and strains; major injuries such as eye injury or loss of sight, joint or back injuries, spinal and head injuries, heart attacks, and concussions; catastrophic injuries including paralysis and potentially death and loss of or damage to property. I understand the hazards and risks associated with borrowing and using the recreational equipment owned by the United Townships of Head, Xxxxx and Xxxxx and xxxxx accept full responsibility for all risk of injury or loss of life to myself and my authorized users, and the loss of or damage to property which may arise out of borrowing this equipment. Waiver of Liability and Release Agreement: In consideration of being permitted to borrow the recreational equipment owned by the United Townships of Head, Xxxxx and Xxxxx, I specifically release and forever discharge the United Townships of Head, Xxxxx & Xxxxx, its officers, employees, contractors, members, volunteers and agents from any and all liability or claims for injury, illness, death or loss of or damage to property which I may suffer while borrowing the recreational equipment. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damage caused by the negligence of the Municipality of the United Townships of Head, Xxxxx & Xxxxx, its officers, employees, contractors, members, volunteers and agents. It is my intent by the Waiver of Liability and Release Agreement to release the United Townships of Head, Xxxxx and Xxxxx and hold it harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by the negligence of the United Townships of Head, Xxxxx and Xxxxx, or whether based upon breach of contract, breach of warranty, or any other legal theory. In signing this document, I fully recognize that if injury, illness, death or damage occurs while engaged in borrowing and using the recreational equipment, I will have no right to make a claim or file a lawsuit against the United Townships of Head, Xxxxx and Xxxxx, its officers, employees, contractors, members, volunteers and agents.
