Audit Cost. The Recipient will bear its cost of participating in any audit (e.g., mailing or travel expenses). The Energy Commission will bear the cost of conducting the audit unless the audit reveals an error detrimental to the Energy Commission that exceeds more than ten percent (10%) or $5,000 (whichever is greater) of the amount audited. The Recipient will pay the refund as specified in subsection (d), and will reimburse the Energy Commission for reasonable costs and expenses incurred by the Commission in conducting the audit.
Audit Cost. The full cost of each CITY audit shall be borne by CITY, unless one or both of the following conditions exists, in which case LESSEE shall reimburse CITY for all costs of the audit:

Late submission (as defined in OMB Circular A-­‐133) of the single audit report and/or audit transmittal letter is considered non-­‐compliance with this section and may be grounds to impose sanctions.

Audit Cost. Lessor may cause an annual audit of Lessee's books and records to be made by an independent auditor selected by Lessor for purposes of verifying the amount of royalties due to Lessor. All reasonably necessary records shall be made available to Lessor or its agents for such purposes. The fees of the auditor shall be paid by Lessor, unless an understatement of the royalties properly due to Lessor in excess of five percent (5%) of the amount of the royalties reported occurs (giving effect to any agreement or determination pursuant to paragraphs (m) or (n) below, as applicable), in which event Lessee shall pay the fees of the auditor.
Audit Cost. Recipients may be eligible to receive the OHCRIF funds for their institution to conduct an audit if Funds received total $100,000 or more.
