Basis for Contract Award. This is a competitive best value source selection in which competing Offerors' past performance history will be evaluated on a basis approximately equal to cost or price considerations. By submission of its response (“Proposal”), the Offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. All technically acceptable Proposals shall be treated equally except for price and performance records. Failure to meet a requirement may result in a Proposal being determined technically unacceptable. The City reserves the right to reject any Proposal that takes exception to the solicitation terms and conditions. The evaluation process shall proceed as follows:
Basis for Contract Award. The Government intends to make award to each and all qualifying offerors. A qualified offeror is determined to be a responsible source, submitting a technically acceptable proposal that conforms to the requirements of the solicitation and who the contracting officer has no reason to believe would be likely to offer other than fair and reasonable pricing. Basis for Contract Award a. Award of the Contract, if made, will be done on a best value basis to the highest ranked responsive and responsible proposer whose offer conforms most to the solicitation. The proposal is judged by an integrated assessment of the evaluation criteria that is most advantageous to the ATN, price/cost and other factors considered.
b. ATN may select other than the lowest cost/priced, technically acceptable offer if it is determined that the additional technical merit offered is worth the additional cost in relation to other proposals received. ATN is more concerned with obtaining excellent technical features than with making an award at the lowest overall cost/price to the ATN. However, the ATN will not make an award at a significantly higher overall cost to achieve only slightly superior technical features.
c. Accordingly, ATN may not necessarily make an award to the proposer with the highest technical ranking nor award to the proposer with the lowest priced proposal if doing so would not be in the overall best interest of ATN. For evaluation purposes, if proposals become more technically equivalent, then cost/price becomes more important and may be the deciding factor.
Basis for Contract Award. (1) This is a best value source selection conducted in accordance with Federal Acquisition Regulation (FAR) Part FAR Part 15.3, “Source Selection” as supplemented by Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS). Award will be made to a single Offeror who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), whose proposal conforms to the solicitation requirements (to include all stated terms, conditions, and representations, certifications) and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the Lowest Priced, Technically Acceptable Offer.
(2) Trade-offs between cost/price and non-cost/price factors are not permitted. Unreasonably high/unrealistically low, unbalanced, inaccurate or incomplete price proposals, may be the grounds for eliminating a proposal from competition. Pricing based on competition, inaccurate of incomplete price proposals may be grounds for elimination a proposal from competition. The Government will evaluate proposed prices for reasonableness using price analysis techniques. Proposed prices evaluated as unreasonable may be grounds for eliminating a proposal for competition.

As part of making the assessment, a best value analysis will be performed determining whether or not exceeding the minimum requirements at an associated price provides the best value to the Government.
2. As a basis for award, trade-offs between cost/price and non-cost/price factors are permitted. THEREFORE, THE GOVERNMENT RESERVES THE RIGHT TO AWARD TO OTHER THAN THE LOWEST PROPOSED COST/PRICE. However, the degree of importance of cost/price as a factor in determining award could become greater depending upon the equality of the proposals evaluated in the non-cost/price factors. The greater the equality of proposals within the non-cost/price factors, the more important cost/price becomes in selecting the best value to the Government. The Government will evaluate proposed prices for reasonableness using cost and price analysis techniques. Proposed prices evaluated as unreasonable may be grounds for eliminating a proposal from competition. Unrealistically low costs/prices may be grounds for eliminating a proposal from competition on the basis that the offeror has demonstrated a lack of understanding of the requirement.
