Beta License. In addition to the other terms contained herein, in the event You have downloaded or received beta or pre-release versions of the Software (the “Beta Software”) from Us, subject to Your compliance with all of the terms and conditions of this Agreement, We grant to You a revocable, non-exclusive, non-transferable and non-sublicensable license to install and use the Beta Software strictly for Your internal evaluation and review purposes and not for production purposes (the “Beta License”). You are explicitly not permitted to distribute the Software to any user outside the Organization on whose behalf You have undertaken this license. Your rights to use the Beta Software will immediately terminate upon the earlier of (i) the expiration of the evaluation period established by Us, or (ii) such time that You purchase a license to a non-evaluation version of the Software. We reserve the right to terminate Your Beta License at any time in Our absolute and sole discretion.
Beta License. 2.2.1 Upon Licensee's acceptance of the XXXX, XXX Works grants the Licensee the temporary right to use Beta Versions, subject to the General License Terms in section 2.4 and subject to the following:
2.2.1.1 Licensee may install, use and permit an unlimited number of Authorized Users to use any Beta Version on multiple computers until the End-of-Life date of that Beta Version with no Fees;
2.2.1.2 The End-of-Life date is defined separately for each version of the Software shall be at least three (3) months after the Beta Version is first made available by ALM Works.
Beta License is a license available to the public or only a group(s) of clients, and/or their clients, selected upon Chaos’s discretion, for evaluation or beta copies of Licensed Materials for which Chaos does not typically charge a license fee. Special terms and conditions may apply which in case of conflict with the other terms and conditions stipulated hereunder, will prevail to the extent of such conflict (please refer to the Exhibits to this Agreement). Beta license, or the beta software itself, may automatically expire once the beta process is complete;
Beta License. Subject to the terms of this Agreement and the Restrictions on Use set forth below, FBO grants to Customer, from time to time a worldwide, non-exclusive, non-sub-licensable, and non-transferable limited license for End Users to access and use the Beta Service in accordance with the terms of this Agreement, solely for the purpose of performing internal testing of the Beta Service. “End Users” means individuals (i) who are authorized by Customer to use and access the Beta Service, and (ii) who have been assigned unique user identifications and passwords by Customer. Customer is responsible for End Users’ compliance with this Agreement.
Beta License. 2.2.1. Upon Licensee's acceptance of the XXXX, Teamlead LLC grants the Licensee the temporary right to use Beta Versions, subject to the General License Terms in section 2.4 and subject to the following:
2.2.2. Licensee may install, use and permit unlimited number of Authorized Users to use any Beta Version on multiple computers until the End-of-Life date of that Beta Version with no Fees; End-of-Life date is defined separately for each version of the Software and is at least 6 months after the version is first made available by Teamlead LLC.
Beta License. Subject to the terms and conditions of this Agreement, Netwrix hereby grants to Licensee, and Licensee accepts from Netwrix, a limited, nontransferable, non-exclusive license to use the Software solely for the purpose of testing the Software internally and evaluating the Software for the purpose of providing Feedback to Netwrix. The Software is licensed, not sold to Licensee by Netwrix, for a maximum beta testing period of ninety (90) days from the Software installation date ("Beta Test Period").
Beta License. If this Software has been provided for testing by Licensee without charge, then Summit grants to Licensee only a non-exclusive, non-transferable, limited-term evaluation license solely for internal use of the Software, and solely for the purpose of testing the Software (a “Beta License”). Licensee shall not use the Software pursuant to a Beta License in the productive course of business or for any purpose other than testing the Software as described herein. Such testing will include, but not be limited to (i) development of a product design which uses the full capabilities of the Software, (ii) reporting to Summit of all errors discovered in the Software and working with Summit to isolate the causes of the errors, (iii) writing and evaluation report of the Software at the conclusion of the testing and submitting it to Summit, which report will include test results, bug reports, suggested error corrections, suggestions for improvements to the Software and any other information deemed important by Licensee and (iv) providing bi-weekly status updates by phone to Summit. Licensee will make available to Summit all reports and other materials relating to Licensee’s testing of the Software and Licensee will review and discuss with Summit such reports and other materials, and the testing of the Software generally, at times reasonably convenient to Licensee. All ideas and suggestions for enhancement, improvement, correction and other changes to the Software provided by Licensee to Summit shall become and remain the property of Summit, exclusively, and Licensee shall have no rights therein and no right to compensation therefor. This Beta License shall be effective as of the date Licensee first receives the Software and shall remain in effect only for ninety (90) days, unless this Agreement or this Beta License is terminated prior thereto by either party. A Beta License may be terminated by either party at any time for any reason or for no reason, upon prior written notice to the other party. During the term of a Beta License, Summit shall provide Licensee with telephone support from Summit customer support personnel during Summit’s normal support business hours, subject to Summit’s normal prioritization procedures. Promptly upon the expiration of this Beta License, and without any notice or demand from Summit, Licensee shall return the Software and all related materials to Summit.
Beta License. AGE shall have and BETA hereby grants to AGE a royalty-free, fully paid-up, non-exclusive, perpetual, irrevocable, world-wide right to Use and sublicense any BETA Work Product, BETA Deferred Gap Resolutions and BETA Development Work or BETA Documentary Work Product that is incorporated into any AGE Conversion Gap Resolution, AGE Work Product, AGE Development Work or AGE Documentary Work Product (the “BETA Incorporated Materials”) solely for the internal use of AGE and the AGE Group.
Beta License. Beta licenses are not available under this ELA. Therefore, pursuant to Amendment No. 1 to the ELA License Agreement and solely for the purpose of use of Enterprise License Software, Article 3.2, Beta License, in the License Agreement, is deleted in its entirety.
Beta License. ImagicTV may, at its discretion, deliver to NBTel experimental versions of the DTV Manager System in the form of beta or pre-release versions ("Betas") subject to the following terms:
(i) Subject to all restrictions set forth in this Agreement, ImagicTV grants solely to NBTel a limited, non-exclusive and non- transferable license to use the Betas solely at the address set forth above and only for the purpose of evaluating and testing such Betas. Except as expressly set forth herein, the license granted to NBTel in this Section 2.3 ("Beta License") shall not be for any other purpose, and any other use by NBTel shall constitute a material breach of this Agreement.
(ii) NBTel will supply ImagicTV with an evaluation report every two (2) weeks, with the first evaluation report due two (2) weeks after ImagicTV delivers the applicable Beta (collectively, the "Evaluation Reports"). The Evaluation Reports shall set forth in reasonable detail the tests performed, the results of those tests, problems or deficiencies encountered in the testing process, suggested solutions to the problems and recommended action for modification of the Betas based on NBTel's test results. The Evaluation Reports shall be delivered via electronic mail to the following email address: xxxxxxxxxxxxxxxx@xxxxxxxx.xxx or as otherwise agreed to by the ----------------------------- parties.
(iii) NBTel shall cease using and destroy all copies of any Betas provided hereunder upon the earlier of (a) ImagicTV's delivery of the production version of such software; (
