Beta Software definition

Beta Software means any version of Software prior to a generally available commercial release of such Software.
Beta Software means any Software that has been designated as a non-production version, including software labeled as “beta,” “pre-release,” or “candidate.”
Beta Software means either: (1) a complete new version of the Software which is a pre-release version only, is still undergoing development and testing at Hyland and is not a Hyland commercially released product; or (2) a potential new Software module which is included in a commercially-released version of the Software, but which is not available for commercial licensing by User or Hyland’s other customers generally and is still undergoing development and testing at Hyland. From time to time Hyland may make Beta Software available for User’s use in the Test Systems; and User may elect to license and use the Beta Software in the Test Systems. Except for the provisions of Section 5(a), (b) and (c) and Section 6 of this EULA, which shall not apply with respect to any Beta Software, User acknowledges and agrees that all Beta Software delivered in accordance with this paragraph shall be considered to be “Software” for all purposes of this EULA. Notwithstanding anything to the contrary, as to any Beta Software, this EULA and the limited license granted hereby will terminate on the earliest of: (1) ten

  • If you are found to be using the Evaluation or Beta Software beyond the terms contained in this Section you shall immediately pay ThreatModeler a license Fee for such Software and all terms under this Agreement will be binding.

  • Upon receipt of a later unreleased version of the Beta Software or release by ThreatModeler of a publicly released commercial version of the Beta Software, whether as a stand-alone product or as part of a larger product, Licensee agrees to return or destroy all earlier Beta Software received from ThreatModeler and to abide by the terms of the End User License Agreement for any such later versions of the Beta Software.

  • Except for Evaluation Software, Beta Software or freeware, which is subject to Section 7 below, if no Term is included in the above-described materials, then the Term shall be for one (1) year from the date of purchase unless earlier terminated as set forth herein.

  • Licensee acknowledges that ThreatModeler has not promised or guaranteed to Licensee that freeware or Beta Software will be announced or made available to anyone in the future that ThreatModeler has no express or implied obligation to Licensee to announce or introduce the Beta Software, and that ThreatModeler may not introduce a product similar to or compatible with the Beta Software.

  • You shall return Evaluation and Beta Software and any Documentation at the end of the evaluation or loan period or when sooner terminated by ThreatModeler for convenience by giving you ten (10) days’ written notice, whichever occurs first.

From time to time Hyland may make Beta Software available for User’s use in the Test Systems; and User may elect to license and use the Beta Software in the Test Systems. Except for the provisions of Section 5(a), (b) and (c) and Section 6 of this EULA, which shall not apply with respect to any Beta Software, User acknowledges and agrees that all Beta Software delivered in accordance with this paragraph shall be considered to be “Software” for all purposes of this EULA. Notwithstanding anything to the contrary, as to any Beta Software, this EULA and the limited license granted hereby will terminate on the earliest of: (1) ten (10) days after the date of delivery by either party to the other party of written notice of termination of the beta testing period for such Beta Software; or (2) the date of Hyland’s commercial release of the final version of such Beta Software for licensing to its end users generally. Upon expiration or other termination of such period, User immediately shall discontinue any and all of use of the Beta Software and related documentation and remove or permit Hyland to deactivate the Beta Software. The expiration or termination of this EULA as to any Beta Software shall not affect the continuation of this EULA as to any other Software that has been licensed and is in use by User in accordance with the terms of this EULA.
Beta Software has the meaning set forth in Section 2.5.
Beta Software means software that is undergoing testing and that the Cloud Provider does not warrant is fit for production usage;
