BID AND CONSTRUCTION SUPPORT. It is our understanding that City’s construction management team will have primary responsibility for construction management inspection and will be taking lead in responding to day-to-day construction support activities and that our role will be very limited. To that end, we have assumed 60-hours for this task which will include the following: • We will attend a pre-bid meeting, respond to all bidder’s requests for information (RFIs), and support the City’s coordination efforts to inform plan-holders of significant responses to RFIs and prepare addenda as necessary. • Attend and prepare information for an internal handoff meeting from the design team to the construction management team. BKF will be prepared to address: possible Construction pitfalls, items for the construction management team to be aware of (special working hours, shortened timelines for submittal reviews, etc.). • Attend the pre-construction meeting. • Attend 1 construction progress meeting. • Participate in the final inspection and development of punch lists. • Respond to RFIs, which includes clarifying or providing revisions or additional detail where necessary on the plans and specifications. Response to RFIs shall be timely in order to avoid construction delays and claims. • Review and respond to all submittals within the period allocated in the contract documents and as necessary to avoid construction delays and claims. • Review proposed substitutions, if any, for conformance to plans and technical specifications. • Review and make recommendations on proposed changes to the contract (Request for Quotations and Contract Change Orders). • Prepare Record Drawings based upon red-lines provided by the contractor and field reviews. The Record Drawings shall be prepared digitally, using AutoCAD. Final Record Drawings shall be submitted electronically, in PDF and CAD format. • Participate in the “Lessons Learned Meeting” with all parties at the end of the project. BID AND CONSTRUCTION SUPPORT. The BCA design team will provide assistance to the County during the bidding process. This assistance includes responding to questions from the contractors regarding the design, assisting in preparation of addendums, attending the pre-construction meeting and providing recommendations on the award of contract. We will also provide assistance to the County during construction. This assistance includes responding to requests for information, assisting in contract change orders, reviewing shop drawings, reviewing falsework drawings, and preparing as- built record drawings upon completion of construction.

Unless the context shall otherwise require, any reference to any statute, regulation, rule, Tariff, technical reference, technical publication, or any publication of Telecommunications industry administrative or technical standards, shall be deemed to be a reference to the most recent version or edition (including any amendments, supplements, addenda, or successor) of that statute, regulation, rule, Tariff, technical reference, technical publication, or any publication of Telecommunications industry administrative or technical standards that is in effect. Provided however, that nothing in this Section 2.1 shall be deemed or considered to limit or amend the provisions of Section 2.2. In the event a change in a law, rule, regulation or interpretation thereof would materially change this Agreement, the terms of Section 2.2 shall prevail over the terms of this Section 2.1. In the case of any material change, any reference in this Agreement to such law, rule, regulation or interpretation thereof will be to such law, rule, regulation or interpretation thereof in effect immediately prior to such change until the processes set forth in Section 2.2 are implemented. The existing configuration of either Party's network may not be in compliance with the latest release of technical references, technical publications, or publications of Telecommunications industry administrative or technical standards.
