Building and Construction Industry Payments Act 2004. (Qld); Construction Contracts Act 2004 (WA); Construction Contracts (Security of Payments) Act 2004 (NT); Building and Construction Industry Security of Payment Act 2009 (Tas); Building and Construction Industry (Security of Payment) Act 2009 (ACT); Building and Construction Industry Security of Payment Act 2009 (SA); and any legislation in any State or Territory of Australia addressing security of payment in the building and construction industry. Sensitive and Classified Information Any document, drawing, information or communication (whether in written, oral or electronic form) issued or communicated to the Consultant by the Commonwealth, the Commonwealth's Representative or anyone on the Commonwealth's behalf, whether or not owned by the Commonwealth: marked as "sensitive information" or "for official use only"; identified at the time of issue or communication as "Sensitive Information"; marked with a national security classification or as "Classified Information"; identified at the time of issue or communication as "Classified Information"; the Consultant knows or ought to know is subject to, or ought to be treated as Sensitive and Classified Information in accordance with, the provisions of all Commonwealth Requirements and Statutory Requirements (including the Australian Government Protective Security Policy, the Australian Government Protective Security Framework, the Australian Government Protective Security Manual, the Australian Government Physical Security Management Protocol, the Australian Government Personnel Security Management Protocol, the Australian Government Information Security Manual and the Defence Security Manual); and everything recording, containing, setting out or making reference to the document, drawing, information or communication (whether in written, oral or electronic form), including documents, notes, records, memoranda, materials, software, disks and all other media, articles or things.

Building and Construction Industry Payments Act 2004. At the Contractor‟s sole discretion, if there are any disputes or claims for unpaid Goods or services, then the provisions of the Building and Construction Industry Payments Act 2004 may apply.

Site The site for the Works described in the Subcontract Particulars. Site Management Plan The site management plan prepared by the Subconsultant and finalised under clause 7.4, which must set out in adequate detail all procedures the Subconsultant will implement to manage the carrying out of the Subcontract Services on and near the Site, including: the matters set out in the Subcontract Particulars; if the Subcontract Services are to be carried out on or in the vicinity of an airfield, a Method of Work Plan for Airfield Activities; and any other matters required by the Consultant's Representative, in accordance with the Subcontract and the Consultant's Site Management Plan. Special Conditions The document referred to in the Subcontract Particulars.
Building and Construction Industry Payments Act 2004. At the Seller’s sole discretion, if there are any disputes or claims for unpaid Goods and/or Services then the provisions of the Building and Construction Industry Payment Act 2004 may apply. Nothing in this agreement is intended to have the effect of contracting out of any applicable provisions of the Building and Construction Industry Payments Act 2004 of Queensland, except to the extent permitted by the Act where applicable.
