Categorical Exclusion Documentation. The Categorical Exclusion (CE) document includes gathering and documenting information applicable to the project and the resulting impacts to the built, natural, and social environment. Due to anticipated acquisition of temporary and permanent right-of-way for the project, it is anticipated that a Level 2 CE will be necessary. It is anticipated that less than 10 acres of permanent or temporary right- of-way will be required for this project. No relocations of people or business are anticipated for the project. WSP will prepare a Draft CE Level 2, using the current INDOT template. Inventoried information will be included in a study area exhibit(s). The CE form will be submitted to INDOT Greenfield District for review and comment. This scope assumes up to two rounds of revisions based on INDOT comments. WSP will submit a revised CE Level 2 for approval and release for public involvement. Following certification of the public involvement package in the Public Involvement task, the CE will be updated to address public comments and submitted to INDOT Greenfield District for final review and approval. If more than 0.5 acre of right‐of‐way would be required for the project, a public notice would be published after INDOT releases the CE for Public Involvement. WSP will assist the INDOT Greenfield District in coordinating public involvement activities, including the advertising of the public hearing opportunity and documenting all activities undertaken during public involvement in the CE Level 2. The notice will solicit the public for the opportunity to request a public meeting or hearing. After the comment period, the WSP will prepare a public involvement packet and CE cover sheet and submit to INDOT Greenfield District for review and signature/certification. This task does not include a public hearing or public meeting. WSP will prepare the summary database for inclusion of mitigation commitments resulting from the NEPA process into future phases of the project. The database spreadsheet will be submitted to INDOT Greenfield District. It is anticipated that the project will qualify as a Regional General Permit (RGP). • Prepare and submit application for a Section 404 permit from the U.S. Army Corps of Engineers (ACOE) and obtain approved jurisdictional determination. • Prepare and submit application for a Section 401 Water Quality Certification (WQC) Regional General Permit Notification form to the Indiana Department of Environmental Management (IDEM). Categorical Exclusion Documentation. At completion of the alternatives analysis, Consultant shall assemble the FRA CE Worksheet in accordance with the FRA CE Companion Guide, which includes: • A detailed description of the project action • An environmental review of impacts including social and economic conditions, and natural and biological resources as described above. • Records of public and agency consultation • Documentation confirming compliance with environmental laws, such as the Endangered Species Act, Clean Water Act (CWA), and National Historic Preservation ActMitigation measures • Supporting studies and reports Once reviewed by FRA, approval will be documented in with the signature of the approving official on the CE worksheet. This process may take three to six months following the submission of the CE documentation.

  • Schedule Updates the Contractor agrees to maintain the Work duration schedule updates on an ongoing basis and, when the County requests it, include the updates in its payment request. The Contractor may be required to submit a narrative report with each monthly update which shall include a description of current and anticipated problem areas, delaying factors and their impact, and an explanation of corrective action taken or proposed. Failure to do so may be considered a material breach of the Contract. Any additional or unanticipated costs or expense required to maintain the schedules shall be solely the Contractor’s obligation and Contractor agrees not to charge the County.
