Changes to the Products a The Company may: i change the specifications of the Products at any time by notice in writing to the Distributor; and ii add or remove a Product from the scope of the Agreement at any time by notice in writing to the Distributor. On receipt of that notice, the definition of Products in the Agreement is deemed to be amended in accordance with the notice. b A change to the specifications of a Product or the removal of a Product under clause 2.6a will not apply to any Order accepted by the Company before the Company’s notice.

Changes to the Products. Magnusmode Limited may add, delete, or change the features or functions of the Products at any time, at Magnusmode Limited’s sole discretion. If Magnusmode Limited deems it reasonably practicable to do so and if the change adversely affects your usage of the Products, Magnusmode Limited will notify you of the change as soon as reasonably practicable after it is implemented, which notice may be given electronically. Magnusmode Limited may cause the Products to be temporarily unavailable to you, either with or without prior notice, for site maintenance, security, or other reasons, and you acknowledge that factors beyond reasonable control, such as telecommunications failure or equipment failure, may also cause the Products to be unavailable to you.
Changes to the Products. The Supplier may at its sole discretion vary or stop the sale of any Product without notice. Notwithstanding the foregoing, the Supplier will endeavour to give reasonable notice to the Distributor where possible.

Such notice shall include a full description of the proposed change and sufficient samples of the proposed new product for BCI to determine if the new product meets each and all of the specifications for such Product in Exhibit A, correlates in all respects with the Product or requires any operating software change for the BCI System. BCI will complete such determination promptly, but in no event longer than four (4) months after receipt of such samples. If BCI determines that the proposed new product either does not meet specifications or does not correlate with the existing Product, then Affymetrix will, at its option, either not make the change or continue to sell BCI the existing Product for the remainder of the term of this Agreement. If BCI determines that the proposed new product meets specifications and correlates with the existing Product but requires a change to the operating software for the BCI System, then Affymetrix agrees to and shall: (a) continue to sell BCI the existing Product until the introduction of BCI's next regularly scheduled software modification for the effected BCI System and (b) provide sufficient samples of the new product at the prices specified in Paragraph 4.3, for BCI to perform system validation. If BCI determines that the proposed new product meets specifications, correlates with the existing Product and does not require any change to the operating software, then Affymetrix may make the desired changes and introduce the new product on ninety (90) days prior written notice.

An EC request will include sufficient information for evaluation of its feasibility and cost impact. ESGW will respond to EC requests in writing and provide cost and other relevant data within a time period that is reasonable considering the magnitude of the EC. 9.2 EXABYTE may, from time to time, change the specifications for the Products or the work required of ESGW hereunder and ESGW agrees to make commercially reasonable efforts to comply. Changes to the Products. ATS reserves the right, in its sole discretion and without incurring any liability to Representative, to alter the specifications for any Product, discontinue the manufacture of any Product, discontinue the development of any new product, whether or not such product has been announced publicly, or commence the manufacture and sale of new products having features which make any Product wholly or partially obsolete, whether or not Representative is granted any rights in respect of such new products. Notwithstanding the foregoing, ATS shall use best efforts to provide Representative with prompt notice of such decisions.

Changes to the Products. The list of Products may be revised or amended from time to time at the discretion of KDDIA, without the consent of Customer, by providing written notice of such revision or amendment. Any such revision or amendment will be effective on the later of the date of the notice or the date specified in the notice for the revision or amendment. U.S. Assemblies will make OpenROUTE requested engineering changes ("EC") to the Products as required by the OpenROUTE EC. U.S. Assemblies will respond to EC requests in writing and provide cost and other relevant data within a time period that is reasonable considering the magnitude of the EC. 10.2 OpenROUTE may from time to time change the specifications for the Products or the work required of U.S. Assemblies hereunder and U.S. Assemblies agrees to implement the change per OpenROUTE's requested schedule, including a stop work order. In the event a stop work order is issued, OpenROUTE agrees to resolve the stop work order within 30 days from the issue date. If changes result in a change in U.S. Assemblies' costs or in the time for performance, a price adjustment will be made. Any adjustment must be in writing and U.S. Assemblies shall not be required to implement such change until the Parties have mutually agreed upon the price. In the event of a change necessitated by safety requirements, or law, U.S. Assemblies agrees to implement said change as soon as possible. 10.3 U.S. Assemblies agrees not to make any changes in its processes or manufacturing standards which would effect form, fit or function of the Product, without first obtaining written agreement from OpenROUTE 10.4 U.S. Assemblies agrees to provide OpenROUTE with two hundred and seventy (270) days' notice in the event they will no longer be able or willing to produce product for OpenROUTE, and will allow OpenROUTE the opportunity to place a last time buy of product.
